സര്‍ക്കാര്‍ പുതിയ മദ്യ നയം പ്രഖ്യാപിച്ചതോടെ ചിലര്‍ പള്ളികളില്‍ വൈന്‍ ഉപയോഗിക്കുന്നതിനെതിരെ രംഗത്തെത്തി. ഒരു പക്ഷെ അവരുടെ ആദായ മാര്‍ഗത്തിന് ഭീഷണി ആയതുകൊണ്ടാകാം.
എന്തുമാകട്ടെ, എല്ലാ വൈനിനും സര്‍ക്കാര്‍ ലൈസന്‍സ് വേണ്ട. ഇത് പറഞ്ഞത് കേരളത്തിലെ ഹൈക്കോടതിയാണ്. വെറുതെ പറഞ്ഞതല്ല. അബ്കാരി നിയമം വായിച്ചു പഠിച്ചു പറഞ്ഞതാണ്‌. നിയമപ്രകാരം 8 % മുതല്‍ 15 % ശതമാനം വരെയാണ് വൈനില്‍ അനുവദിച്ചിട്ടുള്ള അല്കാഹോള്‍ അളവ്. അതില്‍ കുറവ് അല്കാഹോള്‍ ഉള്ള രീതിയിലും വൈന്‍ ഉണ്ടാക്കാം. അതിനൊന്നും ലൈസന്‍സ് വേണ്ട.അതുകൊണ്ട് ലൈസന്‍സ് എടുത്തു കളഞ്ഞു പള്ളികളിലെ വൈന്‍ ഉപയോഗം നിയമ വിരുധമാക്കാമെന്ന് കരുതുന്നവര്‍ ഇതൊന്നു വായിക്കൂ.

ABKARI ACT, 1077 (KERALA) -- S.2(10) -- Non - alcoholic beverages -- Beverages with less than 0. 50% alcohol content can be sold without any licence from the Excise authorities as the same is not an alcoholic drink -- Winery Rules, 1970 ( Kerala), R.2(12) -- Foreign Liquor Rules, 1953 (Kerala), R.3.
In order to come under the definition of wine in abkari act, alcahol content ranging from 8% to 15% is needed. So if the alcahol cotent is less than .5 %, it does not come under the definition of alcahol.
The production and marketing of wine is covered by licence under the Kerala Winery Rules, 1970. 'Wine', as defined under R.2(12), means 'the product obtained on alcoholic fermentation of grape juice or pulp or juice of any other fruit natural or forfeited, the alcoholic content of which does not exceed 42 per cent of proof spirit'R.3 of the Foreign Liquor Rules specifically states that the maximum strength at which beer shall be sold is 6% v/v and the alcoholic content of wine which shall be sold is 8% v/v to 15.5% v/v De - alcoholized wine, containing insignificant percentage of alcohol ranging from 0.20% to 0.41%, outside the scope of Abkari Laws of Kerala.

മദ്യം നിരോധിച്ചാല്‍ കേരളീയര്‍ വ്യാജ മദ്യം കുടിക്കാന്‍ വെമ്പല്‍ കൊള്ളുമെന്നും അപകടത്തില്‍ പെടുമെന്നും പറയുന്നത് 
ബലാത്സംഗങ്ങള്‍ ഒഴിവാക്കാന്‍ വേശ്യാവൃത്തി നിയമപരമാക്കണം എന്ന് പറയുന്നത് പോലെയാണ്;

കേരളത്തിന്റെ മദ്യ നയത്തിന്റെ തെറ്റും ശരിയും തീരുമാനിക്കാന്‍ ചര്ച്ചതകള്‍ നടക്കട്ടെ. പക്ഷെ ഒരു കാര്യം ആര് പറഞ്ഞാലും ശരിയല്ല. മദ്യം നിരോധിച്ചാല്‍ കേരളീയര്‍ വ്യാജ മദ്യം കുടിക്കാന്‍ വെമ്പല്‍ കൊള്ളുമെന്നും അപകടത്തില്‍ പെടുമെന്നും പറയുന്ന വാദം വെറുതെയാണ്. വ്യാജ ഉണ്ടാകുമെന്നും ഒരുപാടു മണിച്ചന്മാര്‍ ഉണ്ടാകുമെന്നും പറയുന്നത് കണ്ണടച്ച് ഇരുട്ടാക്കുന്നത് പോലെയാണ്. ബലാത്സംഗങ്ങള്‍ ഒഴിവാക്കാന്‍ വേശ്യാവൃത്തി നിയമപരമാക്കണം എന്ന് പറയുന്നത് പോലെയാണ് അത്.

അമേരിക്കയില്‍ മദ്യം നിരോധിച്ചിട്ടു കള്ള വാറ്റും ക്രിമിനലുകളും ഉണ്ടായെന്ന ചരിത്രം ഒരു മുന്‍ സുപ്രീം കോടതി ജഡ്ജി പറഞ്ഞതില്‍ കഥയില്ല. കാരണം അമേരിക്കയിലെ സംസ്ക്കാരമല്ല കേരളത്തിലെത്. അവിടെ ആണും പെണ്ണും മദ്യം കുടിക്കും. അതിന്റെ പേരില്‍ കുടുംബം തകരാറില്ല; അവിടെ കുടുംബം തകരാന്‍ മറ്റു ഒരുപാടു കാര്യങ്ങളുണ്ടല്ലോ. അവിടെ ആരും മദ്യം കഴിചു ഭാര്യയെ തല്ലാറില്ല. കള്ള് കുടിച്ചു ആരും വഴിയില്‍ കിടക്കാറും ഇല്ല. അതുമായി കേരളത്തെ താരതമ്യം ചെയ്യണ്ട.

എന്റെ ഒരുപാടു സുഹൃത്തുക്കള്‍ ഞായറാഴ്ചകളിലും മറ്റു ആഘോഷ ദിവസങ്ങളിലും മദ്യം ഉപയോഗിക്കുന്നവരാണ്. ഒരുമിച്ചു കൂടുമ്പോള്‍ അവര്‍ ചിലപ്പോള്‍ മദ്യം വാങ്ങും, കുടിക്കും. അതൊക്കെ മദ്യം സുലഭമായി ലഭ്യമായതുകൊണ്ടാണ്. മദ്യം നിരോധിച്ചാല്‍ ചിലപ്പോള്‍, അതില്‍ നിന്നും ഒരു പുതിയ കച്ചവടമായി ക്രിമിനല്‍ മനസ്സുള്ളവര്‍, കാശുണ്ടാക്കാന്‍ എന്തും ചെയ്യുന്നവര്‍, വ്യാജ മദ്യം ഉണ്ടാക്കുമായിരിക്കും. പക്ഷെ ഞാന്‍ സൂചിപിച്ച എന്റെ സുഹൃത്തുക്കള്‍ മുന്പ്യ മദ്യം നിയമവിധേയമായിരുന്നപ്പോള്‍ ഉപയോഗിച്ചിരുന്ന പോലെ വ്യാജ മദ്യം വാങ്ങി കുടിക്കില്ല. ഒരുമിച്ചു കൂടുമ്പോള്‍ അവര്‍ ചെലപ്പോ ഇനി പിരിവിട്ടു വല്ലതും വാങ്ങി കടിക്കും (കഴിക്കും) അല്ലാതെ വ്യാജന്‍ അന്വേഷിച്ചു പോകും എന്നത് വെറുതെ.

അതിനു കാരണം പലതാണ്...

ഒന്ന് – വ്യാജ മദ്യം കുടിക്കുന്നത് അപകടമാണെന്ന് അറിഞ്ഞു കൊണ്ട് സ്വന്തം കുടുംബത്തെ സ്നേഹിക്കുന്ന ആരും കുടിക്കില്ല.

രണ്ട് – വ്യാജ മദ്യം ഉണ്ടാക്കുന്നത് നിയമ വിരുദ്ധമാണെന്ന് അറിയുന്നവര്‍ ധൈര്യമായി അത് കുടിക്കാന്‍ ഒരുമ്പെടില്ല. നിയമത്തെയും സ്വന്തം ആരോഗ്യത്തെയും അവര്‍ ഭയക്കും. പിന്നെ അത്രയ്ക്ക് മദ്യ ഭ്രാന്തന്മാര്‍ മാത്രമേ കുടിക്കൂ. അത് സാധാരണക്കാരാവില്ല.

ഇന്ത്യയില്‍ കഞ്ചാവ് തുടങ്ങിയ ലഹരി ഉപയോഗിക്കുന്നത് കുറ്റമാണ്. എന്നാലും ചിലര്‍ അത് ഉപയോഗിക്കുന്ന ഒരുപാടു കേസുകള്‍ ഉണ്ടാകുന്നുണ്ട്. എന്ന് വച്ച് കഞ്ചാവ് നിയമപരമാക്കാനാകുമോ ? അതുപോലെ മദ്യം നിരോധിച്ചാല്‍ വ്യാജ മദ്യം ഉണ്ടാകും എന്ന കാരണത്താല്‍ മദ്യം നിരോധിക്കരുത് എന്ന് പറയുന്നതില്‍ എന്ത് യുക്തിയാണ് ഉള്ളത് ?

BEFORE THE HONOURABLE SPECIAL COMMITTEE
FOR RECONSIDERING THE CRZ NORMS AND TO FORM THE COASTAL ZONE MANAGEMENT PLAN

Subject:-    Rectification of anomalies in Coastal Regulation Zone Notification 2011.

                  This representation is submitted before you, to bring your attention towards the hardships being faced by the Kerala Coastal community in General and Latin Catholics in Particular pursuant to the implementation of CRZ Notification 2011 (Coastal Regulation Zone Notification 2011).
                  Obviously, the CRZ Notification was drafted by the Central Government, with a view to ensure livelihood security to the fisher communities and other local communities, living in coastal areas, to conserve and protect coastal stretches, its unique environment and its marine area and to promote development through sustainable manner based on scientific principles taking in to account the dangers of natural hazards in the coastal areas, sea level rise due to global warming and restricts the setting up and expansion of any industrial operations.
                  Though the Notification was with the above said intentions, it resulted in making the lives of Coastal Community in Kerala extreme pathetic. Even the construction of residential houses are banned as per the Notification and the Coastal people cannot use their traditional piece of land accordance to their wish. We hereby point out certain anomalies in the Notification which needs immediate attention and interference warranted from your part.
The anomalies
As per section 7 of the Notification, CRZ  areas are classified in to CRZ I, CRZ II, CRZ III, CRZ IV & Areas requiring special consideration (CRZ V).
In Kerala, all Panchayaths are classified in CRZ III. No construction is possible up to 200 mts from HTL on the landward side in case of seafront and 100 mts along tidal influence water bodies or width of creek whichever is less to be earmarked as No Development Zone. Therefore, even a small house cannot be constructed in this area and the traditional plots owned by the coastal communities cannot be used for constructing their homestead and the right to home is denied.(section 8(i)(III)
Whereas, the Corporation and Municipal areas are classified in CRZ II, wherein the buildings shall be permitted only on landwards side of the exiting road, or on the landward side of existing authorized structures.(section 8 (i)(II)
At the same time, a special category is included as “CRZ for Kerala” and it was notified that, all the islands in backwaters of Kerala shall be covered  under the CRZ notification. 50 mts from the backwaters are treated as CRZ area an no new construction is permitted; except the repair or reconstruction of existing dwelling units of local communities.(section 8(i)(V)(2).
Taking account of the circumstances, Kerala need more relaxations in construction of dwelling houses. And therefore, necessary amendments are to be incorporated in the CRZ Notification 2011 so as to enable the house construction of common man, without any hindrance.
Right to Home
The above said provisions are against the right to home of coastal communities. They cannot construct even a small dwelling unit in their traditional plot if it falls under this CRZ area. Infact, the intention of the Notification was to protect the coastal area and people, this kind of restriction to dwelling units turned this notification as nightmare to the coastal folk. They cannot use their plots for any useful purpose and there is no market value for such land. The Coastal people are deprived of all Government Schemes and benefits for house construction since their plot is in CRZ area.
Amendment sought
In order to rectify the above mentioned anomalies, we kindly request you to amend the Notification so as to enable coastal people a decent living, by protection their right to home.
1.    Amend the clauses in section 8 (i)(II) and section 8(i)(III so as to enable the Construction of residential homes in the CRZ II and CRZ III, especially among the side of backwaters and protect the right to home of people in coastal area in Kerala.
2.    Include all Islands in Kerala under CRZ II category. (So as to enable the constructions towards the landward side of the proposed or existing road or numbered structures)
3.    Direct the State Governments to withdraw the Government Orders and Circulars issued for the strict implementation of CRZ Notification and do not disturb the already issued building numbers.
4.    Include special housing schemes and projects for thickly populated area in Kerala without any CRZ restrictions. Permit the house constructions of at least 2000 Sq Feet.
5.   The small streams, canals and such water bodies which are influenced by tidal water are now included in CRZ; it need to be amended. Small streams etc with less than 20 metre width need to be excluded from CRZ.
6.   Taking account of the density of population, construction towards the landward side of the existing structures need to be permitted.

Amendment (2014) to Consumer Protection Act...Article .. opinion.

ALL THAT GLITTERS ARE NOT GOLD
(Personal Opinion on the proposed amendments over Consumer Protection Act)

Amendments to the Consumer Protection Act are round the corner. Some of the new proposed amendments are able to cover a couple of lacunae which ought to have been addressed in the Consumer law. But under the guise of covering up such infirmities, blatant violation of the right to represent cannot be curtailed; but that is on the cards, which will be revealed on a closer look over the proposed amendments. So beware, all that glitters are not gold.

ALLOWING AGENTS FOR CLIENTS
A new regulation - Consumer Protection (Procedure for allowing appearance of Agents or representatives or Voluntary Organisations before the Consumer Forum), Regulations, 2014 has been drafted by the Union Government and discussions are going on. Through this regulation, agents are allowed to present the case before the Consumer Forums. Just like lawyers, the agents/representatives/consumer activists can present the case for others. It is not clear, what are the criteria or checks and balances adopted to verify the credentials claimed by those persons who claims to fall under these categories. By way of a special power of attorney, it can be done.
 
By a bare reading, this provision may seem better to help the consumer. But we must bear in mind about the hard reality of state of affairs. Will there be any accountability for such persons ? Who will monitor their activities? Obviously, it is not the question of professional challenge to lawyers; it is a different aspect and do not want to discuss it here. But, despite of the presence of Bar Council and other disciplinary measures, there are reported incidents of lawyers duping clients. It’s not just a professional misconduct, in fact it points to the deterioration of values in the society. Right from the priests to school policemen, it is there.
But here, by allowing such agents, what is the benefit being availed to the litigant ? If the agent, on the basis of the Power of Attorney, act in accordance of his whims and fancies and even if attempt to defraud the client, what is the remedial measure ? No institutions such as Bar Council can intervene and it may remain only as a “black collar crime”.

LAWYERS BANNED
The new proposed amendment in Section 13(8) read so:
The Court shall not allow the engagement of an advocate by either party to the complaint, unless the value of the goods and services & compensation claimed, if any, exceeds Rs. 5 lakh, provided, that the complainant may engage an expert if the complaint requires technical expertise.

Whereas in case of State Commission, the proposed amendment to Section 18(2) read so:
 No advocates will appear before the State Forum for any parties unless the billed value of goods/r services claimed in a complaint is fifty lakhs or above.

Whereas in case of National Commission, the proposed amendment to Section 22(3) read so:
Provided further that no advocates shall appear for any parties before the
National Forum unless the claim is above rupees one crore and fifty lakhs.

The reason for the new amendment to exclude lawyers in some of the above mentioned cases is to expedite the proceedings in the consumer courts and to avoid unnecessary delay.  If it is read at a stretch, one may feel that the one and only reason for the delay in consumer courts is the engagement of lawyers. Is it so?

THIS IS NOT THE FIRST INSTANCE
Similar incidents of banning lawyers under the camouflage to expedite the proceedings are there. For example, as per section 17 of Welfare of Parents and Senior Citizens Act legal practitioners are not permitted to appear for applicants; whereas it allows to appoint a ‘person of his choice’. When the issue was challenged before the High Court of Kerala, [2013 KHC 2716] it was held that, no legislation can water down the mandatory provision under section 30 of the Advocates Act 1961 with effect from 15/6/11. So also, the provision in Family Court Act in connection with obtaining sanction for appointing lawyer of his own choice is also not now in existence. Therefore, whatever be the flimsy and silly reason raised by the ‘babus’ who draft the legislation, the wisdom of democracy may not allow it; so long as the section 30 of the Advocates Act remain intact.
 
POSTIVE APSETCS
The proposed amendment includes conferring a right upon the authority and they can act against those traders who are violating consumer rights and can impose administrative penalty. Besides, the authority can conduct investigations, either suo-motu or on a complaint, into violations of consumer rights and conduct search and seizure of documents/records/articles and other forms of evidence, summon delinquent manufacturers, advertisers and service providers to record oral evidence and direct production of documents and records. This apart, the authority can order recall of goods or withdrawal of services found to be unsafe or hazardous and order reimbursement of the price of the goods (or services) so recalled, to purchasers of such goods or services.
There are also steps to install a Central Consumer Protection Authority. The objective of the Central Authority will be to prevent the exploitation of consumers and violation of their rights and to promote, protect and enforce the rights of consumers. Cases can be resolved through mediation and conciliation, as per the new proposed amendment. Apart from appointing retired judges as the head of the consumer courts, the ministry was considering appointing members through the state public service commission at the state level and through the Union Public Service Commission at the national level. Currently, 621 district consumer fora, 35 state consumer commissions and the National Consumer Disputes Redressal Commissions at the apex level are functioning.
But one thing we must bear in mind. Whatever be the new amendments, if it is to be positively implemented, the right to represent and right to heard of a consumer need to be accepted. Mere figures of pending cases and delayed orders may not be a short cut to water down the fundamental right of being heard, in just and proper sense.

ഒരു കിലോ വരെ  കഞ്ചാവ് കൈവശം കൊണ്ടുനടന്നാലും ജാമ്യം കിട്ടാവുന്ന കുറ്റം മാത്രമാണ്. പരമാവധി 3 വര്‍ഷം ശിക്ഷ അല്ലെങ്കില്‍ പതിനായിരം രൂപ പിഴ അത്രയ ഉള്ളു. ഇന്ന് ഇന്ത്യയിലെ നാര്‍ക്കോട്ടിക്ക് നിയമം അങ്ങനെയാണ്. അതുകൊണ്ടാണ് കഞ്ഞാവിന്റെ ഉപയോഗം കൂടിവരുന്നതും. മുന്‍പ് ഇതേ കുറ്റം സെഷന്‍സ് കോടതി കേസും, വലിയ ശിക്ഷ ഉള്ളതുമായിരുന്നു. പക്ഷെ അധികാരത്തിലിരിക്കുന്നവര്‍ തന്നെ ഇത് ദുരുപയോഗം ചെയ്തു കേസുകള്‍ രജിസ്റ്റര്‍ ചെയ്യുന്നുവെന്നതും ഈ നിയമ ഭേദഗതിക്ക് കാരണമായി. ഒരു വലിയ നാശത്തിനു, ഒരു തലമുറയുടെ തന്നെ പാപ്പരത്തിന് കാരണമായി മാറുന്ന മയക്കുമരുന്നിനു അടിമയായി മാറുന്നത് ചെറിയ തുടക്കത്തിലൂടെയാണ്.
എന്ന് കേരളത്തില്‍ കൊച്ചിയില്‍  സ്കൂള്‍ കുട്ടികള്‍ വരെ കഞ്ചാവ് ഉപയോഗിക്കുന്നു എന്ന അന്വേഷണത്തില്‍ പോലീസ് എത്തിയത് ബോബ് മാര്‍ലിയിലാണ്. ഈ ജമൈക്കന്‍ സംഗീത കലാകാരന്റെ ചിത്രമുള്ള ടി ഷര്‍ട്ടുകള്‍, കൈ ചൈനുകള്‍, ലോക്കറ്റുകള്‍ മുതലായവ ധരിച്ചു നടക്കുന്നവരില്‍ കൂടുതലും മയക്കുമരുന്ന് ഉപയോഗിക്കുന്നവരനാണ് എന്നാണ് പോലീസ് പറയുന്നത്.
എന്തായാലും സംസ്ഥാന സര്‍ക്കാര്‍ ക്ലീന്‍ ക്യാമ്പസ്‌ - സൈഫ് ക്യാമ്പസ്‌ എന്നീ പേരില്‍ മയക്കുമരുന്നിനെതിരെ ക്യാമ്പൈന്‍ നടക്കുന്നുണ്ട്. ഈ ക്യാമ്പൈന്‍ ഭാഗമായി ഇത് വരെ 1386  റയിടുകള്‍ നടന്നു. 134 കേസുകള്‍ രജിസ്റ്റര്‍ ചെയ്തു.  131 പേരെ അറസ്റ്റ് ചെയ്തു. സ്കൂള്‍ വിജിലന്‍സ് കമ്മിറ്റികളിലൂടെയും സ്ടുടെന്റ്റ്‌ പോലീസ് കാടെറ്റ്കളിലൂടെയുമാണ് ക്യാമ്പൈന്‍ നടക്കുന്നത്.

കോഴിക്കും ആന്റി ബയോടിക്സ് എന്ന് കേട്ടപ്പോള്‍ മത്തായിക്ക് ഉത്സാഹമായി. ഇനിയിപ്പോ പനി വന്നാല്‍ വേറെ മരുന്ന് വേണ്ടല്ലോ, കോഴിയിറച്ചി വാങ്ങിയാല്‍ മതി. പനിയും മാറും, ഇറച്ചിയും തിന്നാം. പിന്നെയാണ് മത്തായിക്ക് മനസ്സിലായത്‌ അത് മനുഷ്യനെ കൊല്ലാനുള്ള ആന്റി ബയോടിക്കാണെന്ന്.
ഇടയ്ക്കിടെ ഹോട്ടലുകളില്‍ നിന്ന് പഴകിയ ഭക്ഷണം പിടിച്ചുവെന്നും ഹോട്ടല്‍ അടപ്പിച്ചുവെന്നും വാര്‍ത്ത കാണുമ്പോള്‍ മത്തായിക്ക് ഫുഡ്‌ സെയ്ഫ്ടി ഉദ്യോഗസ്ഥരോട് ബഹുമാനവും ആദരവും തോന്നുമായിരുന്നു. പക്ഷെ പിന്നെയാണ് മനസ്സിലായത്‌ മുന്‍പുണ്ടായിരുന്ന ഭക്ഷ്യ വസ്തുക്കളില്‍ മായം ചേര്‍ക്കല്‍ നിരോധന നിയമത്തിനു പകരം പുതിയതായി വന്ന ഭക്ഷ്യ സുരക്ഷയും നിലവാരവും നിയമം ഇനിയും കാര്യമായി കേരളത്തില്‍ നടപ്പിലായിട്ടില്ല എന്നും ഇപ്പോള്‍ നടക്കുന്ന റെയ്ഡുകള്‍ കണ്ണി പൊടിയിടാനുള്ള പെട്ടി കേസുകള്‍ മാത്രമാണെന്ന്.

ഫുഡ് സെയ്ഫ്ടി & സ്റ്റാണ്ടാര്‍ദ്സ് നിയമം (Food Safety and Standards Act 2006)
2006 ലെ ഈ നിയമം 2011 ആഗസ്റ്റ്‌  5 നു ഇന്ത്യയെമ്പാടും നടപ്പിലായി. പക്ഷെ ഭക്ഷണത്തിലെ മായം കണ്ടുപിടിക്കാന്‍ പരിശോധന നടത്താനുള്ള ലബോറട്ടറി ഇന്നും സ്ഥാപിച്ചിട്ടില്ല. നിയമത്തില്‍ ഉണ്ടാക്കേണ്ട പ്രത്യേക കോടതികളും ഇല്ല. മായം കലര്‍ന്ന ഭക്ഷണം ആണെന്ന് അന്ഗീകൃത ലബോറട്ടറിയില്‍ പരിശോധന നടത്തി റിപ്പോര്‍ട്ട് വന്നാല്‍ മാത്രമാണ് കുറ്റക്കാര്‍ക്കെതിരെ ഈ നിയമപ്രകാരം നടപടി പറ്റുകയുള്ളു. ലാബ്‌ ഉണ്ടായിട്ടു വേണ്ടേ പരിശോധന നടത്താന്‍. മുമ്പുണ്ടായിരുന്ന നിയമത്തില്‍ പാലിച്ചു പോന്നിരുന്ന പരിശോധനാ രീതി നിയമപരമല്ല എന്ന് പെപ്സികോ കേസില്‍ സുപ്രിം കോടതി കണ്ടെത്തിയിരുന്നു. എന്നാല്‍ ഈ രീതി (DGHS Director General of Health Service Manual) ഉപയോഗിച്ചാണ് നാളിതുവരെ ഭക്ഷ്യ വസ്തുക്കളില്‍ മായം ചേര്‍ക്കല്‍ സംബന്ധിച്ച എല്ലാ പരിശോധനകളും നടത്തിയിരുന്നത്.
പുതിയ നിയമം വന്നാലെങ്കിലും കൃത്യമായി ലാബുകള്‍ സ്താപിക്കുമെന്നു കരുതിയെങ്കില്‍ തെറ്റി. ഇപ്പോഴും പരിശോധനക്കായി ലാബില്ല. പിന്നെ ഉദ്യോഗസ്ഥര്‍ പെട്ടി കേസു ഈടാക്കി വിടുകയല്ലാതെ എന്ത് ചെയ്യാന്‍. ?
National Accreditation Board for Testing and Calibration Laboratories (NABL) എന്ന ദേശീയ തലത്തില്‍ അംഗീകാരം ഉള്ള ലാബുകളാണ് വേണ്ടത്. നിലവില്‍ മുന്ന് മേഖലാ ലാബുകളാണ് കേരളത്തിലുള്ളത്. തിരുവനന്തപുരം, എറണാകുളം, കോഴിക്കോട് എന്നീ സ്ഥലങ്ങളില്‍ ഉള്ള മുന്ന് ലാബുകള്‍ക്കും ദേശീയ അക്രിടിഷന്‍ ലഭിച്ചിട്ടില്ല. അതില്ലാത്തിടത്തോളം കാലം ഇവിടെ നടത്തുന്ന ഒരു പരിശോധനയും നിയമപരമായി നിലനില്‍ക്കില്ല. മാത്രമല്ല, ലാബുകളിലെ അടിസ്ഥാന സൌകര്യങ്ങള്‍ വികസിപ്പിക്കണമെന്നും ആവശ്യമുയര്‍ന്നിട്ടു വര്‍ഷങ്ങളായി.

കഥയറിയാതെ ആട്ടം തുടരുന്നു 
ഹോട്ടലുകളിലെ റെയ്ഡു വാര്‍ത്തകള്‍ കണ്ടു എത്രയെത്ര മത്തായിമാര്‍ നമ്മുടെ നിയമസംവിധാനത്തെക്കുറിച്ചു അഭിമാനം കൊള്ളുന്നുണ്ടാവും ?. ഹോട്ടല് അടപ്പിച്ചു പെറ്റി കേസെടുപ്പിച്ചു മുന്നം ദിവസം അത് തുറക്കുന്നത് വാര്‍ത്തയാകാറില്ല. യഥാര്‍ത്ഥത്തില്‍ ഉണ്ടാകേണ്ട ലാബും കോടതിയും ഇനിയും ഇല്ല എന്ന് ആര്‍ക്കറിയാം
മായം കലര്‍ന്നതെന്ന് സംശയിക്കുന്ന ഭക്ഷണം ഫുഡ് സെയ്ഫ്ടി ഓഫിസര്‍ സാമ്പിള്‍ പരിശോധന നടത്തി ഫൈന്‍ ഈടാക്കേണ്ട കുറ്റം മാത്രമേയുള്ളൂ എങ്കില്‍ ഫൈന്‍ അടപ്പിക്കണം. ഗുരുതരമായ കുറ്റം ആണെങ്കില്‍ ഫുഡ് സെയ്ഫ്ടി കമ്മിഷണര്‍ക്ക് റിപ്പോര്‍ട്ട്‌ നല്‍കണം. മുന്ന് വര്‍ഷത്തില്‍ താഴെ ശിക്ഷയുള്ള കുറ്റം ആണെങ്കില്‍ സാധാരണ കോടതിയിലും, അതിനു മുകളില്‍ ശിക്ഷ ഉള്ള കുറ്റം ആണെങ്കില്‍ പ്രത്യേക കോടതിയിലും വിചാരണ നടത്തണം. 

ഇവിടെ പ്രശ്നം അതല്ല, പരിശോധിക്കാന്‍ ഉള്ള ലാബ്‌ തന്നെ നിയമപ്രകാരം അംഗീകാരം ഉള്ളതല്ല, അതിനു പുറമേ വലിയ കുറ്റങ്ങളുടെ വിചാരണക്ക് പ്രത്യേക കോടതിയുമില്ല. പിന്നെ പിടിക്കപ്പെടുന്നവരോട് കുറ്റം സമ്മതിക്കാന്‍ നിര്‍ബന്ധിച്ചു പിടിച്ച കേസുകളുടെ എണ്ണവും വാര്‍ത്തയും ഫയലാക്കി കണക്കുണ്ടാക്കാനല്ലാതെ എന്ത് ചെയ്യാനാകും.

നിശാ ക്ലബും വേണ്ട ... DJ പാര്‍ട്ടികളും വേണ്ട.... ?

കേരളത്തില്‍ നിശാ ക്ലബ്‌ പരിപാടികളും DJ പാര്‍ട്ടികളും നിരോധിക്കുന്ന കാര്യം പരിഗണനയില്‍ എന്ന് വാര്‍ത്ത.

........കൊച്ചി മറൈന്‍ഡ്രൈവ് മഴവില്‍പ്പാലത്തിനു സമീപത്തെ ബോട്ടുജെട്ടിയില്‍ യാത്ര പുറപ്പെടാനായി കിടന്നിരുന്ന ബോട്ടിലായിരുന്നു മിന്നല്‍ പരിശോധന. പാര്‍ട്ടിക്കിടെ ഉപയോഗിക്കാനായി കരുതിയിരുന്ന 256 ബോട്ടില്‍ ബിയര്‍, 10 കുപ്പി വിദേശമദ്യം എന്നിവയും പത്ത് ഗ്രാമോളം കഞ്ചാവുമാണ് പോലീസ് പിടിച്ചെടുത്തത്.........

ഈ വാര്‍ത്തയുള്‍പ്പെടെ കൊച്ചിയിലെ ചില നക്ഷത്ര ഹോട്ടലുകളില്‍ നിന്ന് കഴിഞ്ഞ ദിവസം നടന്ന രാത്രി പാര്ട്ടികല്‍ക്കിടെ കഞ്ചാവ് പിടിച്ചെടുത്തതും ഇതിനു കാരണമായി.  നിശാ ക്ലബ്‌ ഡാന്‍സ് പരിപാടികളും DJ പാര്‍ട്ടികളുടെയും പേരില്‍ നടക്കും ആഭാസങ്ങളും ലഹരി ഉപയോഗങ്ങളും തടയണമെന്നതില്‍ തര്‍ക്കമില്ല. ഐ ടി കമ്പനികളിലും മറ്റും ജോലി ചെയ്യുന്നവര്‍ക്ക് വീക്ക്‌ ഏന്‍ഡ് ആഘോഷിക്കാന്‍ ഇത് അനിവാര്യമാണത്രെ...എല്ല് മുറിയും ഞരമ്പ്‌ മുറുകെയും പണിയെടുക്കുന്ന വേറെയും ആളുകള്‍ ഉണ്ട്; അവര്‍ക്കൊന്നും ഈ ന്യൂ ജനറേഷന്‍ വിളിപ്പെരില്ലാത്തത് കൊണ്ട് അത് അനിവാര്യമല്ലത്രെ. എന്തായാലും ഈ ആഭാസവും ലഹരിക്കച്ചവടവും നിര്‍ത്തണം. അതിനൊക്കെ പോകാന്‍ പാകത്തിന് വളര്‍ത്തിയെടുത്ത വീട്ടുകാരെ ആദ്യം ചൂരലിനടിക്കണം. അതിനെ മോറല്‍ പോലീസിംഗ് എന്നോ സദാചാരക്കരെന്നോ വിളിച്ചു കളിയാക്കണ്ട.

പക്ഷെ ഒരു കാര്യം ബഹുമാന്യരായ നിയമനിര്‍മാതാക്കളും അത് നടപ്പാക്കുന്ന ഏമാന്മാരും മനസ്സിലാക്കണം. ഒരു ബോട്ടില്‍ നിന്നോ ഹോട്ടലില്‍ നിന്നോ പാര്‍ട്ടിക്കിടയില്‍ നിന്ന് കഞ്ചാവ് കണ്ടെത്തി എന്ന് പറഞ്ഞു കേരളത്തില്‍ നിശാ ക്ലബ്‌ പരിപാടികളും DJ പാര്‍ട്ടികളും നിരോധിക്കുമെന്ന് വിളിച്ചുപറയുന്നതിനു മുമ്പ് അത് നിയമപരമായി നിലനില്‍ക്കുമോ എന്ന് കൂടി അറിയണം.
ഇന്ത്യന്‍ ഭരണ ഘടന വാഗ്ദാനം ചെയ്യുന്ന മൌലീക അവകാശങ്ങളില്‍ ഒന്നാണ് ആവിഷ്കാര സ്വാതന്ത്ര്യം. ക്ലബുകളില്‍ ഡാന്‍സ് കളിക്കുന്നതിനു നിയന്ത്രണങ്ങള്‍ കൊണ്ടുവരാം,  DJ പാര്‍ട്ടികള്‍ക്ക് നിയമ ലങ്ഘനങ്ങള്‍ ഉണ്ടാകരുതെന്ന് പറയാം...അതിനപ്പുറത്ത് അതൊക്കെ പാടെ നിരോധിക്കാന്‍ ഇതെന്താ പാക്കിസ്തനാണോ ?

ഇന്ത്യന്‍ ഹോട്ടല്‍ കേസില്‍ ആദ്യം ബോംബെ ഹൈക്കോടതിയും പിന്നെ സുപ്രിം കോടതിയും കഴിഞ്ഞ വര്ഷം പറഞ്ഞ വിധികള്‍ മാത്രം കണ്ടാല്‍ മതി ഇത്തരം പ്രസ്താവനകളുടെ നിലനില്‍പ്പ്‌ വിലയിരുത്താന്‍. ബോംബയില്‍ ഹോടലുകളില്‍ ഡാന്‍സ് ബാര്‍ നിരോധിക്കാന്‍ ബോംബെ പോലീസ് നിയമത്തില്‍ ഭേദഗതികള്‍ വരുത്തി  33, 33ബി എന്നീ രണ്ടു വകുപ്പല്‍ കൂട്ടിച്ചേര്‍ത്തു ഡാന്‍സ് ബാറുകള്‍ നിരോധിക്കന്‍ തീരുമാനിച്ചു. ഉദ്ദേശം നല്ലതായിരുന്നു, കാരണം ആയിരക്കണക്കിന് പെണ്‍കുട്ടികളുടെ മാനം നശിപ്പിച്ചു പണം ഉണ്ടാക്കുന്ന ഇടപാടായിരുന്നു. പക്ഷെ നിയമപരമായി നിലനില്ല്‍ക്കത്തക്ക രീതിയില്‍ നിയമമുണ്ടാക്കത്തത് കാരണം ബോംബെ ഹൈക്കോടതി അത് തള്ളി. സര്‍ക്കാര്‍ അപ്പീല്‍ നല്‍കിയെങ്കിലും സുപ്രിം കോടതിയും അത് തള്ളി. (2013 (8) SCC 519)

ദയവു ചെയ്തു കേരളത്തില്‍ നിശാ ക്ലബ്‌ പരിപാടികളും DJ പാര്‍ട്ടികളും നിരോധിക്കാന്‍ നിയമം ഉണ്ടാക്കാന്‍ തയ്യാറെടുക്കുന്ന സാറന്മാര്‍ എല്ലാ വശവും ഒന്ന് പരിശോധിക്കണം.
നിയമം പാലിച്ചു നടത്താന്‍ തയ്യാറുള്ള ഒരു നിശാ ക്ലബ്‌ എങ്ങനെ നിരോധിക്കും ? ആവിഷ്കാര സ്വാതന്ത്ര്യം എന്താ രാത്രി പാടില്ലേ ?

DJ പാര്‍ട്ടി നടത്തുന്നത് എന്താ കുറ്റമാണോ ? അവിടെ കഞ്ചാവ് ഉണ്ടെങ്കില്‍ അത് NDPS നിയമമനുസരിച്ച് കുറ്റം. പക്ഷെ കഞ്ചാവ് DJ പാര്‍ട്ടിയിലും നിശാ ക്ലബ്‌ഇലും  എന്നല്ല ആശ്രമത്തില്‍ ഉപയോഗിച്ചാലും കുറ്റം തന്നെയാണ്. അപ്പോള്‍ നിരോധിക്കേണ്ടതും പിടിക്കേണ്ടതും നിയമവിരുദ്ധമായി ലഹരി ഉപയോഗിക്കുന്നവരെയാണ്... അല്ലാതെ പാര്‍ടികള്‍ തന്നെ നിരോധിചിട്ടെന്തു കാര്യം.

പിന്നെ ധാര്‍മ്മികതയുടെ കാര്യം. അത് കുടംബത്തില്‍ നിന്ന് തുടങ്ങണം. മതബോധനതിലും വേദ പാരായണത്തിലും വളരണം. ഇന്നിറങ്ങുന്ന എത്രയെത്ര സിനിമകളില്‍ ആഭാസ ഡാന്‍സ് ഉണ്ട് ? DJ പാര്‍ട്ടിയുണ്ട് ? എന്താ സെന്‍സര്‍ ബോര്‍ഡ്‌ അതൊക്കെ നിരോധിക്കാത്തത് ? സെന്‍സര്‍ ബോര്‍ഡിനെ ചട്ടങ്ങള്‍ അനുസരിച്ചേ കാര്യങ്ങള്‍ ചെയ്യാനാകൂ..


അപ്പൊ ഒന്ന് വ്യക്തം. നല്ല ഉദ്ദേശം കൊണ്ട് മാത്രം കാര്യമില്ല, നല്ല നിയമം കൂടിയാകണം. അതാണ് ഇന്ത്യന്‍ ഭരണ ഘടനയുടെ പ്രത്യേകത. നിശാ ക്ലബ്‌ പരിപാടികളും DJ പാര്‍ട്ടികളും നിരോധിക്കുമെന്നൊക്കെ പറയാനും കേള്‍ക്കാനും രസമാണ്. പക്ഷെ മൂന്നാറില്‍ ഇടിച്ചു നിരത്തിയതിനു നിയമവിരുദ്ധമെന്നു പിന്നീട്  ഹൈക്കോടതി ഉത്തരവിട്ടതുപോലെ, ബഹളം കഴിയുമ്പോള്‍ നിശാ ക്ലബ്‌ പരിപാടികളും DJ പാര്‍ട്ടികളും പാടെ  നിരോധിക്കുന്നതിനു    സര്ക്കാിരിനു എന്ത് അവകാശമെന്ന് അധികാരകേന്ദ്രങ്ങള്‍ ചോദിക്കുന്നത് കേള്‍പ്പിക്കരുത്.....

രാജാവിനെക്കാളും വലിയ രാജഭക്തി .....

കേരളത്തിലെ മുഖ്യ മന്ത്രി ജനങ്ങളുടെ ബുദ്ധിമുട്ട് മനസ്സിലാക്കി തീര ദേശ നിയന്ത്രണ വിജ്ഞാപനത്തില്‍ സാധാരണക്കാരുടെ ഭാവന നിര്‍മ്മാണത്തിന് ഇളവു നല്‍കണമെന്ന് ആവശ്യപെട്ട് കേന്ദ്ര മന്ത്രാലയത്തെ സമീപിക്കുമ്പോള്‍ ഇവിടെ കേരളത്തിനെ ഉദ്യോഗസ്ഥ വൃന്ദം വിജ്ഞാപനം ശക്തമായി നടപ്പിലാക്കാന്‍ വെമ്പല്‍ കൊള്ളുകയാണ്. സുപ്രീം കോടതിയില്‍ കൊടുത്ത സത്യവാങ്ങ്മൂലത്തിനു അത് എതിരാണ് എന്നതാണ് കാരണം.

ഒരുവശത്ത് നിയന്ത്രണം നടപ്പിലാക്കാന്‍ ഉത്തരവുകള്‍ പറക്കുമ്പോള്‍, മറുവശത്ത് സാധാരണക്കാരന്റെ ഭവന നിര്‍മ്മാണത്തിന് സാധ്യത അന്വേഷിക്കുന്നു.

ആലപ്പുഴ: മത്സ്യത്തൊഴിലാളികള്‍ക്ക് വിനയാകുന്ന തീരദേശ പരിപാലന നിയമം (സിആര്‍ഇസഡ്) കര്‍ശനമായി നടപ്പാക്കാന്‍ മന്ത്രിസഭാ യോഗം തീരുമാനിച്ചു. ഇതുസംബന്ധിച്ച് തീരദേശ പരിപാലന അതോറിറ്റി (ശാസ്ത്ര സാങ്കേതിക വകുപ്പ്) നേരത്തേ ഇറക്കിയ രണ്ട് സര്‍ക്കുലര്‍ മരവിപ്പിച്ച നടപടി മന്ത്രിസഭായോഗം റദ്ദാക്കി. തീരദേശത്തെ വീടുകള്‍ക്ക് അനംഗീകൃത നമ്പര്‍ (യുഎ നമ്പര്‍) പോലും നല്‍കാന്‍ പഞ്ചായത്തുകള്‍ക്ക് ഇനി കഴിയില്ല. വേലിയേറ്റ രേഖയില്‍ നിന്ന് 200 മീറ്ററിനുള്ളില്‍ ഒരു വീടും നിര്‍മിക്കാനാകില്ല. 500 മീറ്റര്‍ പരിധിയില്‍ വീടുവയ്ക്കണമെങ്കില്‍ തീരപരിപാലന അതോറിറ്റിയുടെ അനുമതി വേണം.

വേമ്പനാട് അടക്കമുള്ള കായല്‍തീരത്ത് 100 മീറ്ററിനുള്ളിലും നിര്‍മാണ പ്രവര്‍ത്തനം പാടില്ല. ഇത് ലംഘിച്ച് വീട് വയ്ക്കുകയോ അനുമതി നല്‍കുകയോ ചെയ്താല്‍ ഏഴുവര്‍ഷം തടവും ഒന്നര ലക്ഷം രൂപ പിഴയും ശിക്ഷ ലഭിക്കും. മന്ത്രിസഭാ തീരുമാനത്തിന്റെ അടിസ്ഥാനത്തില്‍ നിയമം കര്‍ശനമാക്കാന്‍ ചീഫ് സെക്രട്ടറി ഉദ്യോഗസ്ഥരുടെ അടിയന്തിര യോഗം വിളിച്ച് നിര്‍ദേശം നല്‍കി. നിയമം ബാധകമാകുന്ന ജില്ലകളിലെ കലക്ടര്‍, തഹസില്‍ദാര്‍മാര്‍, ടൗണ്‍ പ്ലാനര്‍മാര്‍, പഞ്ചായത്ത്-മുനിസിപ്പല്‍ സെക്രട്ടറിമാര്‍ എന്നിവര്‍ക്കായി പ്രത്യേക ശില്‍പശാലകള്‍ സംഘടിപ്പിച്ചു തുടങ്ങി.

അതോറിറ്റിയുടെ അനുമതിയില്ലാതെ കെട്ടിടങ്ങള്‍ക്ക് നമ്പര്‍ നല്‍കിയാല്‍ തദ്ദേശസ്ഥാപന സെക്രട്ടറിമാര്‍ ക്രിമിനല്‍ നടപടി നേരിടേണ്ടിവരുമെന്ന് ശില്‍പശാലയില്‍ മുന്നറിയിപ്പ് നല്‍കി. തീരപരിപാലന നിയമത്തിലെ വ്യവസ്ഥകള്‍ കര്‍ശനമായി നടപ്പാക്കണമെന്ന് കാട്ടി കഴിഞ്ഞ ജനുവരിയിലാണ് ശാസ്ത്ര സാങ്കേതിക വകുപ്പ് രണ്ട് സര്‍ക്കുലറുകള്‍ ഇറക്കിയത്. ഇതിനെതിരെ വ്യാപക പ്രതിഷേധം ഉയര്‍ന്നതിനെ തുടര്‍ന്ന് സര്‍ക്കുലര്‍ മരവിപ്പിക്കുമെന്ന് മുഖ്യമന്ത്രി ഉമ്മന്‍ചാണ്ടി നിയമസഭയില്‍ ഉറപ്പുനല്‍കി. സര്‍ക്കുലര്‍ മരവിപ്പിക്കാന്‍ മന്ത്രിസഭായോഗം തീരുമാനിക്കുകയും ചെയ്തു. ഈ തീരുമാനമാണ് സര്‍ക്കാര്‍ ഇപ്പോള്‍ തിരുത്തിയത്.

തീരമേഖലയില്‍ മറ്റ് നിര്‍മാണങ്ങള്‍ തടഞ്ഞ് മത്സ്യത്തൊഴിലാളികളെയും പരിസ്ഥിതിയെയും സംരക്ഷിക്കാനുള്ള നിയമം ഫലത്തില്‍ മത്സ്യത്തൊഴിലാളികള്‍ക്ക് ദ്രോഹമായി. മത്സ്യത്തൊഴിലാളികള്‍ക്കുള്ള ഈ നിയന്ത്രണം പക്ഷേ റിസോര്‍ട്ട് നിര്‍മിക്കുന്നതിലില്ല. അഞ്ചു കോടിയില്‍ കൂടുതല്‍ മുതല്‍മുടക്കുള്ള പദ്ധതികള്‍ക്ക് കേന്ദ്രത്തില്‍ നിന്ന് അനുമതി വാങ്ങാനാകും. തീരദേശ പരിപാലന നിയമം നടപ്പാക്കാത്തതിനെതിരെ സുപ്രീംകോടതി സ്വമേധയാ എടുത്ത കേസില്‍ നിയമം കര്‍ശനമായി നടപ്പാക്കുമെന്ന് കേരള സര്‍ക്കാര്‍ സത്യവാങ്മൂലം നല്‍കിയിരുന്നു. ഇതിന്റെ അടിസ്ഥാനത്തിലാണ് സംസ്ഥാന അതോറിറ്റി തദ്ദേശ സ്ഥാപനങ്ങള്‍ക്ക് സര്‍ക്കുലര്‍ അയച്ചത്.

സത്യവാങ്മൂലം നിലനില്‍ക്കെ സര്‍ക്കുലര്‍ മരവിപ്പിക്കുന്നത് കോടതി വിരുദ്ധമാകുമെന്ന് ചീഫ് സെക്രട്ടറി റിപ്പോര്‍ട്ട് നല്‍കിയിരുന്നു. തീരദേശ പരിപാലന നിയമത്തിലെ വ്യവസ്ഥകളില്‍ ഇളവ് വേണമെങ്കില്‍ കേന്ദ്രസര്‍ക്കാര്‍ പുതിയ വിജ്ഞാപനം ഇറക്കണമെന്നും ചീഫ് സെക്രട്ടറിയുടെ റിപ്പോര്‍ട്ടില്‍ പറയുന്നു. മാര്‍ച്ചില്‍ തന്നെ റിപ്പോര്‍ട്ട് മുഖ്യമന്ത്രിക്ക് നല്‍കിയെങ്കിലും തെരഞ്ഞെടുപ്പ് തിരിച്ചടി ഭയന്ന് പുറത്തുവിട്ടില്ല. നിയമത്തില്‍ ഇളവ് നല്‍കി പുതിയ വിജ്ഞാപനത്തിനായി ഒരു അപേക്ഷ നല്‍കിയതല്ലാതെ കേന്ദ്രത്തില്‍ സമ്മര്‍ദ്ദം ചെലുത്താന്‍ യുഡിഎഫ് സര്‍ക്കാര്‍ ഇതുവരെ തയ്യാറായിട്ടില്ല.

PRAVASI LEGAL AID CELL - NORKA- TO HELP THE ACCUSED IN FOREIGN JAILS

The incidents which deny the legal rights to the Indian prisoners in foreign jail are increasing. The effort by State to help the pravasi people by constituting legal aid cell and related help are a great relief for their families. Most of the countries only permit their native lawyers to represent the accused/defendant in the proceedings; especially in the Arab countries, all the proceedings are in Arabic and it cause expensive for the victims to get the help of the lawyer in foreign country.

TIGHTEN THE LEGAL BELT; BEFORE CHARGING CASES ON SEAT BELT
Obviously, the decision by Transport Commissioner of Kerala to take stringent measures against those who fail to wear seat belt while driving cars is a good move indeed. It can reduce death rate in accidents. But the latest ultimatum by the officials that they would charge cases against those who are not wearing seat belt; is legally sustainable?
Off course, the issue is hyper technical. But law is law. Recently, an enforcement officer of Motor Vehicles Department declared in a news paper that, they will charge fine ranging from Rs 100 to Rs 500. How dare he can say so, when the legislature through the provisions of Motor Vehicles Act Section 177, categorically describes that the fine for first offence is Rs 100 and Rs 300 for subsequent offence.
Law is trite
Law is trite that, the Rule 1389(iii) of Central Motor Vehicle rules 1989 make it mandatory to wear seat belts for all those who travel in car; even if it is rear sears, facing front. The good intention and industrious activities to curb Motor Accidents in Kerala by strict implementation of various provisions of Motor Vehicle Act in Kerala need to be appreciated.           
But the directive to register cases for not using seat belts are not legally sustainable. Reasons are hyper technical. For those who plead guilty, can pay fine and go; well and good. But those who are not willing to pay fine by pleading guilty; should have been charged properly. There arises the hyper technical issue of bar under Section 155(2) of Code of Criminal Procedure Code.
The offences related to violation of the Rule 138(iii) of Central Motor Vehicle rules 1989 are not cognizable in nature. It means, the police/motor vehicle officials cannot register a case; instead they can only seek sanction from the magistrate to proceed with the case.  This aspect is discussed by Hon’ble High Court of Kerala in Mahboob vs. State of Kerala (2011 2 KHC 261). It was categorically held that even the offences U/Sec. 184, 185 etc of that the Motor Vehicle Act are non cognizable in nature.  Obviously  either the transport officials or the police officials are not having any power to register a case or to start investigation coming under the violation of any of the provisions of Motor Vehicle Act including 138(iii) of Central Motor Vehicle Rules (wearing Seat belt) with reference to the provisions in Chapter 12 of the Cr.P.C especially Sec. 155(2)
          Admittedly the Motor vehicle inspector acting Under Section 213(iii) exercise the powers of police which are exercisable by police under the Motor Vehicles Act.  No officer empowered under Motor Vehicle Act is having jurisdiction to register a case to start an investigation in respect of violation of provision in rules in 138(iii) of the Central Motor Vehicles Rules 1989.  Therefore the option available is to apply sanction for an order from the concerned Magistrate Court to register the said case and the file charge.
          Be that it so, how the officials can give ultimatum through the media that, all those who are not wearing seat belts will be charged with cases?

MONEY LENDING LICENSE IN KERALA

Operation KUBERA - the 2014 action of Kerala Police to book illegal money lenders made the money lenders who are doing the business without license to run from pillar to post.
There are instances where some people are using this as an occasion to file a petition against the money lender, whom they owed and thereafter, to get rid of the liability for ever.
However, if proper steps are taken, money lending business can be conducted legally, in all sense.
The Kerala Government legislated Kerala Money-lenders Act, 1958 to regulate the business of money lenders.
The details of legal formalities-

Sec 3. Money-lender to obtain licence.― (1) From the date on which the provisions of this Act are brought into force in any area, no person, firm or joint family [18].[“or
unincorporated association of individuals shall commence or”] carry on or continue business as a money-lender at any place in such area without a licence obtained under this Act or in contravention of the terms thereof:

Provided that nothing in this section shall be deemed to prohibit a person who has applied for a licence to carry on or to continue business as a money-lender pending orders on his application.
(2) Where a money-lender has more than one shop or place of business, whether in the same town or village or in different towns or, villages he shall obtain a separate licence in respect of each shop or place of business.


TABLE OF AMOUNT TO BE DEPOSITED
1. A licensee who lends less than one lakh rupees in

2. A licensee who lends one lakh rupees or above but
less than five lakh rupees in an year
                                                          Ten thousand rupees
3. A licensee who lends five lakh rupees or above but
less than ten lakh rupees in an year
                                                           Fifty thousand rupees
4. A licensee who lends ten lakh rupees or above, but
less than twenty-five lakh rupees in an year
                                                           One lakh rupees
5. A licensee who lends twenty-five lakh rupees or
above, but less than fifty lakh rupees in an year
                                                            One lakh and fifty
                                                            thousand rupees
6. A licensee who lends fifty lakh rupees or above, in
an year

                                                             Two lakh rupees.
