ദേശിയ പാത 47 ബൈ പാസിൽ കുമ്പളം പാലം, ടോൾ പിരിവ്, കണ്ണാടിക്കാട് മീടിയൻ മുതലായ വിഷയങ്ങളിൽ എറണാകുളം പെർമനന്റ് ലോക അദാലത്ത് ബെഞ്ചിൽ ഹർജികൾ നിലവിലുണ്ട്. ഈ സാഹചര്യത്തിൽ ഇവയെ ഒന്നായി നേരിടാൻ, ദേശിയ പാത നിയമം വകുപ്പ് 28 പ്രകാരം യാതൊരു ഹർജികളും കോടതിയിൽ നിലനിൽക്കില്ല എന്നാ വാദം ഉന്നയിച്ചു ദേശിയ പാത അധികൃതർ കോടതി നടപടികൾ നിർത്തലാക്കാൻ ഉപ ഹർജി നല്കിയിരുന്നു. എന്നാൽ ഈ ഉപ ഹർജിയിൽ വിശദമായ വാദം കേട്ട ബെഞ്ച്‌, ലീഗൽ സർവീസസ് അതോറിടി നിയമം വകുപ്പ് 25 പ്രകാരം പെർമനന്റ് ലോക അദാലതിനു നടപടികൾ തുടരാൻ അധികാരമുണ്ടെന്ന് വിധിച്ചു. കേസുകൾ വീണ്ടും തുടർ നടപടികൾ നടക്കും.

ഇനി മെട്രോ റെയിൽ വരുമത്രെ. അവൻ നിങ്ങളെ വലിച്ചുകൊണ്ടുപോകും .അവന്റെ വാറഴിക്കാൻ ഞാൻ യോഗ്യനല്ല. പിന്നെ നിങ്ങൾക്ക്  എൻറെ തണലും ആവശ്യമില്ല : കാരണം അവന്റെ മുറികൾ  ശിതീകരിച്ചതാണ് .

എന്നാൽ ഈ സൗകര്യം മെട്രോ റയിലിന്  മാത്രമാണ് കേട്ടോ. നിങ്ങൾ  മറ്റേതെങ്കിലും  മരം മുറിക്കാൻ നോക്കിയാൽ നടക്കില്ല. കാരണം - Kerala Preservation of Trees Act, 1986. നിങ്ങളെ കോടതിയിൽ എത്തിക്കും. 

 4.      Restriction regarding cutting, etc., of trees.-(1) No person shall, without the previous permission in writing of the authorized officer, cut, uproot or burn, or cause to be cut, uprooted or burnt, any tree.

(2)    The permission under sub-section (1) shall not be refused if--

(a)     the tree constitutes a danger to life or property; or


(b)    the tree is dead, diseased or windfallen:

ഇനി നിങ്ങൾ രണ്ടും കല്പിച്ചു മരം വെട്ടിയാൽ, 

9.      Penalties.-Whoever contravenes any of the provisions of section 4 or sub-section (2) of section 5 or a direction contained in a notification under sub-section (1) of section 5 or any of the terms and conditions subject to which a permission has been granted under this Act shall be punishable,-

(a)     in the case of first offence, with imprisonment for a term which shall not be less than six months but which may extend to two years, and with fine which shall not be less than five hundred rupees but which may extend to two thousand rupees; and
(b)    in the case of a second or subsequent offence, with imprisonment for a  term which shall not be less than one year but which may extend to three years, and with fine which shall not be less than one thousand rupees but which may extend to five thousand rupees..

പക്ഷെ മെട്രോ റയിലിന്  ആയതു കൊണ്ട് ഇതൊന്നും കുഴപ്പമില്ല . സാധാരണക്കാരൻ ആണെങ്കിൽ മാത്രമേ ഈ നിയമം ബാധകമുള്ളൂ. അപ്പൊ നിങ്ങൾ ചോദിക്കും പോതുകാര്യത്തിനു ഇലവുണ്ടല്ലോ എന്ന്. എന്നാൽ കേട്ടോ,   Kerala Preservation of Trees Act, 1986. നിയമത്തിൽ അങ്ങനെ ഒരു ഇളവില്ല. 
ആകെ രണ്ടു കാര്യങ്ങൾ ഉണ്ടെങ്കിൽ മാത്രമേ മരം മുറിക്കാൻ അനുവദിക്കൂ 

(a)     the tree constitutes a danger to life or property; or


(b)    the tree is dead, diseased or windfallen:

എന്താ സംശയമുണ്ടോ --- നിയമം മുഴുവനും വായിച്ചു നോക്കിക്കോ .

A relief for disabled persons ...Judgment of Supreme Court in Civil Appeal No.9096/2013- dated 8-10-13.

The concluding portion of the judgment read so-
Conclusion
Para 49- Employment is a key factor in the empowerment and inclusion of people with disabilities. It is an alarming reality that the disabled people are out of job not because of their disability comes in the way of their functioning rather it is social and practical barriers that prevent them from joining the workforce. As a result, many disabled people live in poverty and in deplorable conditions. They are denied the right to make a useful contribution to their own lives and to the lives of their families and community.
Para 50- The Union of India, the State Governments as well as the Union Territories have a categorical obligation under the Constitution of India and under various international treaties relating to human rights in general and treaties for disabled persons in particular, to protect the rights of disabled persons. Even though the Act was enacted way back in 1995, the disabled people have failed to get required benefit until today.
Para 51- Thus, after thoughtful consideration, we are of the view that the computation of reservation for persons with disabilities has to be computed in case of group A, B, C and D posts in a identical manner, computing 3% reservation on total number of vacancies in the cadre strength, which is the intention of the legislature. Accordingly certain clauses in the OM dated 29-12-2005 which are contrary to the above reasoning are struck down and we direct the appropriate government to issue new office memorandum in consistant with the decision renderd by this Court.
Directions-
(i)                  We hereby direct the appellant herein to issue an appropriate order modifying the OM dated 29-12-2005 and the subsequent OMs consistent with this Court’s order within three months from the date of passing of this Judgment.
(ii)                We hereby direct the “appropriate Government” to compute the number of vacancies available in all the “establishments” and further identify the posts of disabled persons within a period of three months from today and implement the same without default.

(iii)               The appellant herein shall issue instructions to all the department/public sector undertakings/Governement companies declaring that the non observance of the scheme of reservation for persons with disabilities should be considered as an act of non-obedience and nodal officer in the department/public sector undertakings/Governement Companies, responsible for the proper strict implementation of reservation for person with disabilities, be departmentally proceeded against for default.

ന്യൂഡല്‍ഹി: ക്രിമിനല്‍ നടപടിച്ചട്ട പ്രകാരം പോലീസ് സ്വമേധയാ കേസെടുക്കേണ്ട കുറ്റങ്ങളില്‍ പരാതി ലഭിച്ചാല്‍, പ്രാഥമിക അന്വേഷണമില്ലാതെതന്നെ പ്രഥമവിവര റിപ്പോര്‍ട്ട് (എഫ്.ഐ.ആര്‍.) രജിസ്റ്റര്‍ചെയ്യണമെന്ന് സുപ്രീംകോടതി വ്യക്തമാക്കി. ഇത്തരം പരാതികളില്‍ എഫ്.ഐ.ആര്‍. രജിസ്റ്റര്‍ ചെയ്യാത്ത പോലീസ് ഉദ്യോഗസ്ഥര്‍ക്കെതിരെ നടപടിയെടുക്കണമെന്ന് ചീഫ് ജസ്റ്റിസ് പി. സദാശിവം അധ്യക്ഷനായ അഞ്ചംഗ ഭരണഘടനാബെഞ്ച് വിധിച്ചു. 

ക്രിമിനല്‍ നടപടിച്ചട്ടത്തിലെ വ്യവസ്ഥകള്‍ വളരെ വ്യക്തമാണെന്നും എഫ്.ഐ.ആര്‍. എന്നത് നിര്‍ബന്ധമാണെന്നും കോടതി പറഞ്ഞു. ഉത്തര്‍പ്രദേശില്‍ തട്ടിക്കൊണ്ടുപോയ ആറുവയസ്സുകാരന്റെ അച്ഛന്‍ സമര്‍പ്പിച്ച ഹര്‍ജിയിലാണ് സുപ്രീംകോടതിയുടെ വിധി. എഫ്.ഐ.ആര്‍. രജിസ്റ്റര്‍ചെയ്യുന്നതിന് ഉത്തര്‍പ്രദേശ് പോലീസ് കൈക്കൂലി ചോദിച്ചിരുന്നു. 

സ്വമേധയാ കേസെടുക്കേണ്ട കുറ്റങ്ങളില്‍പ്പെടുന്നതെന്ന് സൂചനയില്ലാത്ത പരാതികളില്‍ ആവശ്യമെങ്കില്‍ പ്രാഥമികാന്വേഷണം നടത്താമെന്ന് കോടതി വ്യക്തമാക്കി. അത്തരം കുറ്റമാണെന്ന് പ്രാഥമികാന്വേഷണത്തില്‍ കണ്ടെത്തിയാല്‍ എഫ്.ഐ.ആര്‍. തയ്യാറാക്കണം. പരാതിയില്‍ കഴമ്പില്ലെന്ന് കണ്ടെത്തിയാല്‍ അക്കാര്യം ഏഴുദിവസത്തിനകം പരാതിക്കാരനെ കാര്യകാരണസഹിതം അറിയിക്കണമെന്നും ജസ്റ്റിസുമാരായ ബി.എസ്. ചൗഹാന്‍, രഞ്ജനപ്രകാശ് ദേശായ്, രഞ്ജന്‍ ഗൊഗോയ്, എസ്.എ. ബോബ്‌ഡെ എന്നിവരുള്‍പ്പെട്ട ബെഞ്ച് വ്യക്തമാക്കി. 

ലഭിച്ച വിവരത്തിന്റെ സത്യാവസ്ഥ കണ്ടെത്തുന്നതിനല്ല പ്രാഥമികാന്വേഷണം. ലഭിച്ച വിവരം അല്ലെങ്കില്‍ പരാതി ക്രിമിനല്‍ നടപടിച്ചട്ടപ്രകാരം സ്വമേധയാ കേസെടുക്കേണ്ട വിഭാഗത്തില്‍പ്പെടുന്നതാണോ എന്ന് കണ്ടെത്തുന്നതിനാണ്. സ്വത്തുതര്‍ക്കം, കുടുംബവഴക്ക്, സാമ്പത്തികകുറ്റങ്ങള്‍, അഴിമതിക്കേസുകള്‍, സംഭവം നടന്ന് വളരെ വൈകിലഭിക്കുന്ന പരാതികള്‍ തുടങ്ങിയവയിലാണ് പ്രാഥമികാന്വേഷണം നടത്തേണ്ടതെന്ന് കോടതി വിശദീകരിച്ചു. 

പ്രാഥമികാന്വേഷണം ഏഴുദിവസത്തിനുള്ളില്‍ പൂര്‍ത്തിയാക്കണം. ജനറല്‍ ഡയറിയില്‍ കാലതാമസം വിശദീകരിക്കണം. പോലീസ്‌സ്റ്റേഷനില്‍ ലഭിക്കുന്ന എല്ലാ വിവരങ്ങളുടെയും രേഖയാണ് ജനറല്‍ ഡയറി. അതിനാല്‍, എഫ്.ഐ.ആര്‍. തയ്യാറാക്കുന്നതും പ്രാഥമികാന്വേഷണം നടത്താനുള്ള തീരുമാനവുമുള്‍പ്പെടെയുള്ള കാര്യങ്ങള്‍ സൂക്ഷ്മമായി രേഖപ്പെടുത്തിയിരിക്കണം. 
ക്രിമിനല്‍ നടപടിച്ചട്ടത്തില്‍ പോലീസ് സ്വമേധയാ കേസെടുക്കേണ്ട കുറ്റങ്ങള്‍ വിശദീകരിച്ചിട്ടുണ്ട്. മൂന്നുകൊല്ലത്തിലധികം ശിക്ഷ ലഭിക്കാവുന്ന ഇത്തരം കുറ്റങ്ങളില്‍ വാറന്റില്ലാതെതന്നെ ഒരാളെ അറസ്റ്റുചെയ്യാന്‍ പോലീസ് ഉദ്യോഗസ്ഥന് അധികാരമുണ്ട്. കോടതി വഴി മാത്രമേ ജാമ്യം ലഭിക്കൂ. 
പോലീസിന് ലഭിക്കുന്ന പരാതിയില്‍ ഇത്തരം കുറ്റത്തെക്കുറിച്ചാണ് പറയുന്നതെങ്കില്‍ എഫ്.ഐ.ആര്‍. എടുത്തേ പറ്റൂ. പരാതി സത്യമാണോയെന്നും മറ്റുമുള്ള കാര്യങ്ങള്‍ എഫ്.ഐ.ആര്‍. തയ്യാറാക്കിയ ശേഷമുള്ള അന്വേഷണത്തിന്റെ ഭാഗമായി വരേണ്ടതാണ്. അന്വേഷണത്തില്‍ ലഭിച്ച വിവരം അല്ലെങ്കില്‍ പരാതി വ്യാജമാണെന്ന് കണ്ടാല്‍ വ്യാജ പ്രഥമ വിവര റിപ്പോര്‍ട്ട് സമര്‍പ്പിച്ചതിന് കുറ്റവിചാരണയുള്‍പ്പെടെയുള്ള നടപടികള്‍ക്ക് വ്യവസ്ഥയുണ്ടെന്നും കോടതി ഓര്‍മിപ്പിച്ചു.

ഒരു സ്ത്രീക്ക് ശല്യപ്പെടുത്തുന്ന എസ് എം എസ് അയച്ചാൽ അത് വിവരസാങ്കേതിക നിയമപ്രകാരം കുറ്റകരമാണ്. ഇഷ്ടമില്ലാത്ത ഫോട്ടോ എടുത്താൽ കേരള പോലീസ് നിയമപ്രകാരവും കേസെടുക്കാം. ഇത്തരം കുറ്റങ്ങളെല്ലാം താരതമേ്യന ശിക്ഷ കുറവ് ലഭിക്കുന്നതും, പരമ്പരാഗതമായ എല്ലാ ബുദ്ധിമുട്ടുകളും, നേരിടുന്ന ഒരു കേസനേ്വഷണവുമാണ് നിലവിലുള്ളത്. അതുകൊണ്ടു കൂടിയാണ് സ്ത്രീയുടെ സ്വകാര്യതയും മാന്യതയും സംരക്ഷണ നിയമം 2013 എന്ന പേരിൽ പുതിയ ബില്ലിന് കേരള നിയമസഭ രൂപം നൽകിയത്. യഥാർത്ഥത്തിൽ ഒരു പുതിയ നിയമം തന്നെ.

CRIME AND INVESTIGATION - A CASE STUDY - POLICE INVESTIGATION

അന്വേഷണം ശരിയല്ലെങ്കിൽ...

2003 ൽ പാലക്കാടാണ് സംഭവം. ഒരു കുടുംബം ആത്മഹത്യ ചെയ്തു. അച്ചനും അമ്മയും 13 വയസ്സായ പെൺകുട്ടിയുമടങ്ങുന്ന കുടുംബം. മരിക്കുന്ന സമയം പെൺകുട്ടി 9 മാസം ഗർഭിണിയായിരുന്നു,  എന്ന അറിവ് കേരളത്തെയാകെ ഞെട്ടിച്ചു. കേസ് അന്വേഷിക്കുന്ന പോലീസിന് കൃത്യമായ ഒരു തെളിവായി പെൺകുട്ടി എഴുതിയ ആത്മഹത്യാ കുറിപ്പു കൂടി ലഭിച്ചിരുന്നു.  തങ്ങളുടെ മരണകാരണം പ്രതിയാണെന്നായിരുന്നു കുറിപ്പിൽ എഴുതിയിരുന്നത്. പോലീസ് കൃത്യമായി പ്രതിയെ പിടികൂടി. വിചാരണ കോടതി പ്രതിയെ ജീവപര്യന്തം തടവിനും വലിയ തുക പിഴ ഒടുക്കാനും വിധിച്ചു. 13 കാരിയായ പെൺകുട്ടിയെ പീഡിപ്പിച്ച് ഗർഭിണിയാക്കിയതിനും ആത്മഹത്യക്ക് പ്രേരിപ്പിച്ചതിനുമായിരുന്നു ശിക്ഷ. പ്രതി ജയിലിലായി.

ജയിലിൽ നിന്നും ഫയൽ ആക്കിയ അപ്പീൽ കേരള ഹൈക്കോടതിയിൽ വാദത്തിന് എത്തി. അപ്പീൽ വിധി പ്രമാദമായി; കാരണം വിചാരണ കോടതി ജീവപര്യന്തം തടവിന് ശിക്ഷിച്ച പ്രതിയെ നിരുപാധികം വിട്ടയച്ചുകൊണ്ടായിരുന്നു വിധി. സ്ത്രീകൾക്കെതിരെയുള്ള കുറ്റങ്ങൾ വാദം കേൾക്കുന്ന പ്രത്യേക ബെഞ്ചാണ് വിധി പറഞ്ഞത്. മരിച്ചു പോയ അച്ചന്റെയും അമ്മയുടെയും പതിമൂന്നുകാരിയായ മകളുടെയും ആത്മാക്കൾ കൂടി സങ്കടത്തിലായേക്കാവുന്ന അവസ്ഥ. ആരാണിതിന് ഉത്തരവാദി? പെൺകുട്ടിയെ ഗർഭിണിയാക്കിയത് ആരാണെന്ന ചേദ്യത്തിന് ഉത്തരമില്ല. ആത്മഹത്യയ്ക്ക് പ്രേരിപ്പിച്ചത് ആരാണ് എന്നതിനും ഉത്തരമില്ല. പക്ഷെ ഒരു കാര്യം കോടതിക്കും ഉറപ്പാണ്- പെൺകുട്ടി അവിഹിതമായി ഗർഭിണിയായിരുന്നു. അതു തന്നെയാണ് ആ കുടുംബത്തിന്റെ ആത്മഹത്യക്ക് കാരണവും. പക്ഷെ കോടതിയും നിസ്സഹായാവസ്ഥയിലായിരുന്നു.  

 

കേസന്വേഷണവും വിചാരണയും

ക്രിമിനൽ കേസുകളുടെ അന്വേഷണവും തുടർന്നുണ്ടാകുന്ന വിചാരണയും എപ്പോഴും പരസ്പരപൂരങ്ങളാണ്. കൃത്യമായ അന്വേഷണം നടത്തി കോടതിയിൽ ഫയലാക്കുന്ന ചാർജുകളിൽ മാത്രമേ പ്രതി ശിക്ഷിക്കപ്പെടാറുളളൂ. സാക്ഷികളിലൂടെയും മറ്റ് തെളിവുകളിലൂടെയും സംഭവത്തിന്റെ പച്ചയായ യാഥാർത്ഥ്യം ബോധ്യം വന്നാൽ വിചാരണ കോടതി പ്രതിക്കു ശിക്ഷ നൽകും. അത് നിയമപരവും ശാസ്ത്രീയവുമല്ലെങ്കിൽ മേൽ കോടതികൾ അത് റദ്ദാക്കുകയും ചെയ്യും. പലകേസുകളിലും പ്രതിയെ പിടികൂടുന്നതു കളർഫോട്ടോയിൽ അന്വേഷണ ഉദ്യോഗസ്ഥന്റെ പേരു സഹിതം വാർത്തിൽ വരും. പിന്നീട് അവർ ജാമ്യത്തിലിറങ്ങുന്നതോ കേസിൽ വെറുതെ വിടുന്നതോ വാർത്തയാകാറില്ല. 


കോടതിയിൽ പോലീസ് ഫയൽ ചെയ്യുന്ന ചാർജ്ഷീറ്റുകൾ പ്രകാരം സാക്ഷി മൊഴി നൽകിയില്ലെങ്കിലും, കേസ് വെറുതെ വിടും. സിനിമാസ്റ്റൈൽ അന്വേഷണവും കോടതിമുറികളുമാണ് സാധാരണയായി ആളുകളുടെ മനസ്സിൽ ഉണ്ടാകുന്നത്. നിയമപരമായ പഴുതുകൾ ശേഷിപ്പിക്കാതെ തുടക്കം മുതൽ തന്നെ നല്ല രീതിയിൽ നടത്തുന്ന അന്വേഷണമാണ് പ്രതിയെ ശിക്ഷിക്കാൻ കോടതിയെ സഹായിക്കുന്നത്. ഇല്ലാത്ത സാക്ഷികളെ ഉണ്ടാക്കുമ്പോഴും കളവായി തൊണ്ടി മുതലുകൾ സൃഷ്ടിക്കുമ്പോഴുമൊക്കെ എവിടെയെങ്കിലും പാളിച്ചകൾ ഉണ്ടാകുകയും കേസ് വെറുതെ വിടുകയും ചെയ്യുന്നു. 


ഈ കേസിലെ പതിമൂന്നുകാരിയും അച്ചനുമമ്മയും വീട്ടിൽ പെപ്‌സിയിൽ വിഷം കലർത്തി കുടിച്ച് മരിച്ചുകിടക്കുമ്പാഴും അതൊന്നുമറിയാതെ സ്‌കൂൾ വിദ്യാർത്ഥിയായ മകൻ ക്‌ളാസ് കഴിഞ്ഞ് തിരികെ എത്തി. വീട് അടച്ചു കിടക്കുന്നതു കണ്ട് അന്വേഷിച്ച് ബന്ധുക്കൾ എത്തിയപ്പോഴാണ് അകത്തെ മുറിയിൽ മരിച്ചു കിടക്കുന്നവരെ കണ്ടത്. വിവരം പോലീസിൽ അറിയിച്ചു. 13 കാരി ഗർഭിണിയാണെന്ന വിവരം മരണത്തിന് ഏതാനും ദിവസങ്ങൾക്കു മുമ്പ് അയൽവാസികളും ബന്ധുക്കളും അറിഞ്ഞിരുന്നുവെന്നും   ഗർഭത്തിനു കാരണക്കാരനായ മനോജ് (പേര് സാങ്കൽപ്പികം) സ്ഥിരമായി അവിടെ വരാറുണ്ടെന്നും കഴിഞ്ഞ ദിവസം രാവിലെ കുടംബനാഥനും ഇയാളും തമ്മിൽ തർക്കമുണ്ടായെന്നും, 13 കാരിയുടെ കാര്യത്തിൽ തീരുമാനമുണ്ടായില്ലെങ്കിൽ തങ്ങൾ മരിച്ചു കളയുമെന്നും പറയുന്നത് കേട്ടുവെന്നതിന് സാക്ഷികളുമുണ്ടായിരുന്നു. 


അറസ്റ്റ് വളരെ പെട്ടന്ന്

ആത്മഹത്യാ കുറിപ്പു കൂടിയായപ്പോൾ പേലീസിനെ പ്രതിയെ അധികം അന്വേഷിക്കേണ്ടി വന്നില്ല. അറസ്റ്റും റിമാന്റും ഒക്കെ വളരെ പെട്ടന്ന് നടന്നു. പ്രതി പോലീസിൽ എന്ത് കുറ്റസമ്മതം നടത്തിയാലും തൊണ്ടി മുതൽ കണ്ടെടുക്കുന്നതിനൊഴികെ മറ്റൊന്നിനും കോടതിയിൽ നിയമസാധുതയില്ല. അല്ലെങ്കിൽ മജിസ്‌ട്രേറ്റിന് മുന്നിൽ ഹാജരാക്കി മൊഴി എടുക്കണമായിരുന്നു. ഇതൊക്കെ അറിവുള്ള പോലീസ് ചുരുക്കം ചില സെൻഷേണൽ കേസുകളിൽ ഇത് ചെയ്യും. അല്ലാത്ത കേസിലൊക്കെ ഗതി ഇതു തന്നെ. 

ഈ കേസിൽ സാഹചര്യത്തെളിവുകളുടെ അടിസ്ഥാനത്തിലാണ് വിചാരണകോടതി പ്രതിയെ ശിക്ഷിച്ചത്. പ്രതിയാണ് 13കാരിയുടെ വയറ്റിലുണ്ടായിരുന്ന കുട്ടിയെ പിതാവെന്ന് സാഹചര്യത്തെളിവുകളുടെ അടിസ്ഥാനത്തിൽ മാത്രമാണ് തെളിയിക്കാൻ പ്രോസിക്യൂഷൻ  ശ്രമിച്ചത്. അത് വിചാരണകോടതി അംഗീകരിക്കുകയും ചെയ്തു. വയറ്റിലുള്ള കുട്ടിയുടെ ഡി എൻ എ പരിശോധന കൂടി നടത്തിയരുന്നെങ്കിൽ പ്രതി തന്നെയാണ് കുട്ടിയുടെ പിതാവെന്നതിന് രേഖാമൂലമുള്ള തെളിവുകൂടി ആകുമായിരുന്നു. എന്നാൽ അന്വേഷണ ഉദ്യോഗസ്ഥൻ അത് ചെയ്തില്ല.

കേസന്വേഷണവും നിയമപാലനവും

കേരള പോലീസിൽ കേസ് അന്വേഷണത്തിനും ലോ & ഓർഡർ പാലിക്കുന്നതിനും വെവ്വേറെ ടീം ഉണ്ടാകണെമന്നത് ദീർഘകാല ആവശ്യമായിരുന്നു. ഇതു സംബന്ധിച്ച് ഏതാനും ചില സർക്കുലറുകളും ഈയിയെ പോലീസ് മേധാവി പറപ്പെടുപ്പിവിച്ചിരുന്നു. എന്നാൽ ഇന്നും സാങ്കേതികമായി ഒരേ ഓഫീസർമാർ തന്നെയാണ് ഈ രണ്ട് വിഭാഗത്തിലും കാര്യങ്ങൾ ചെയ്യുന്നത്. ക്രൈം ബ്രാഞ്ച് പോലുള്ള വിംഗുകളിൽ ലോക്കൽ പോലീസിൽ നിന്നു തന്നെ സ്ഥലം മാറ്റം കിട്ടി വരുന്നവരാണുള്ളത്. മാത്രമല്ല, പ്രത്യേകമായി ഏൽപ്പിക്കുന്ന കേസുകൾ മാത്രമാണ് അവർ കൈകാര്യം ചെയ്യുന്നത്. 

പ്രതിഭാഗം കോടതിയിൽ എന്ത് വാദങ്ങൾ ഉന്നയിക്കുമെന്ന് ആദ്യമേ മനസ്സിൽ കണ്ടുകൊണ്ടുവേണം ക്രിമിനൽ കേസ് അന്വേഷണം നടത്താൻ. എത്ര സത്യമുണ്ടായാലും നിയമം വ്യാഖ്യാനിച്ചിരിക്കുന്ന രീതിയിൽ അത് അന്വേഷണത്തിന്റെ ഭാഗമായി തെളിവു സഹിതം കോടതിയിൽ എത്തിയാൽ മാത്രമാണ് ശിക്ഷയിൽ അവസാനിക്കുന്നത്. അതും സാക്ഷികൾ കൂറുമാറിയില്ലെങ്കിൽ. അതുകൊണ്ടു തന്നെ ക്രിമിനൽ നിയമ നടപടികളിൽ പരിജ്ഞാനമുള്ളവരായിരിക്കണം അന്വേഷണ ഉദ്യോഗസ്ഥർ. ഇന്ന് നിയമപരമായി യാതൊരു വിദ്യാഭ്യാസ്യ യോഗ്യതയും സബ് ഇൻസ്‌പെക്ടർ തസ്തികയിൽ തെരഞ്ഞെടുക്കുന്നതിന് ആവശ്യമില്ല. ഒന്നുകിൽ ഈ തെഞ്ഞെടുപ്പ രീതിക്ക് മാറ്റമുണ്ടാകണം. അല്ലെങ്കിൽ ദീർഘകാലം ഈ ഹൗസ് ട്രെയിനിംഗ് നൽകണം. ഇതു രണ്ടുമില്ലെങ്കിൽ എന്താണ് സംഭവിച്ചുകൊണ്ടിരിക്കുന്നതെന്ന് കണക്കുകൾ പരിശോധിച്ചാൽ അറിയാം. എങ്ങനെയെങ്കിലും പ്രതിയെ പിടികൂടി റിമാന്റിലാക്കിയതുകൊണ്ട് കാര്യമില്ല. പ്രോസിക്യൂഷൻ വിജയകരമായി നടത്തി ശിക്ഷ വാങ്ങിക്കുന്നതിലൂടെയാണ് നിയമവാഴ്ച നടപ്പിലാകുന്നത്. 

കോടതി പറഞ്ഞത്

കേസ് വെറുതെ വിട്ടെങ്കിലും കോടതി ശക്തമായ രീതിയിൽ അന്വേഷണത്തിന്റെ അപാകത സൂചിപ്പിച്ചിട്ടുണ്ട്. കോടതി വിധിയുടെ ഒരു പകർപ്പ് ആഭ്യന്തര വകുപ്പിന് അയച്ചു കൊടുക്കാനും ഉത്തരവുണ്ട്. - മനോജാണ് ഞങ്ങളുടെ മരണത്തിനു കാരണം; ഞങ്ങൾ യാത്രയാകുന്നു - ഇതാണ് ആതമ്ഹത്യാക്കുറിപ്പ്. എന്നാൽ ആത്മഹത്യക്കുള്ള പ്രേരണയാകണമെങ്കിൽ മറ്റു തെളിവുകളൊന്നുമില്ലാത്തതിനാൽ  ഇതു മാത്രം പോര എന്നാണ് കോടതി പറഞ്ഞത്. മരിച്ച 13 കാരിയുടെ വയറ്റിലുളള കുട്ടിയുടെ അച്ചൻ മനോജാണ് എന്ന് ബന്ധിപ്പിക്കുന്ന യാതൊന്നും തന്നെ ആത്മഹത്യാക്കുറിപ്പിലില്ല എന്നതും കോടതി ചൂണ്ടിക്കാട്ടി. അന്വേഷണ സമയം എന്തു കൊണ്ട് ഡി എൻ എ പരിശോധനയ്ക്ക് ഭ്രൂണത്തിന്റെ സാമ്പിൾ അയച്ചുകൊടുത്തില്ല എന്ന ചോദ്യത്തിന് പോലീസ് ഉദ്യോഗസ്ഥൻ നൽകിയ മറുപടി ഇങ്ങനെയാണ് - പോസ്റ്റ്‌മോർട്ടം റിപ്പോർട്ട് കിട്ടിയപ്പോഴേക്കും ശരീരം മറവ് ചെയ്തിരുന്നു. ഡി എൻ എ ടെസ്റ്റിന്റെ ചെലവ് ഭാരിച്ചതായതിനാലും അതിനു മുതിർന്നില്ല.- 

എന്നാൽ വസ്തുത അതല്ലെന്ന് കോടതി രേഖകൾ വ്യക്തമാക്കുന്നു. ഒന്നുകിൽ അന്വേഷണ ഉദ്യോഗസ്ഥന്റെ അറിവില്ലായ്മ, അല്ലെങ്കിൽ മനപൂർവ്വമുള്ള വീഴ്ച. കാരണം മരണത്തിനു രണ്ടു മൂന്നു ദിവസം മുമ്പു തന്നെ പെൺകുട്ടി ഗർഭിണിയായിരുന്നുവെന്ന് എഫ് ഐ ആർ പ്രകാരം വ്യക്തമാണ്. പിന്നെ എന്തുകൊണ്ട് അത്തരം അന്വേഷണം നടത്തിയില്ല എന്ന ചോദ്യത്തിന് ഉത്തരമില്ല. 


ഇത് ഒറ്റപ്പെട്ട സംഭവമല്ല. വെറുതെ വിട്ടുപോകുന്ന മിക്ക കേസുകളിലും അന്വേഷണത്തിന്റെ അപാകതയാകും കാരണം. ഏറ്റവും നല്ല ചെറിയ ഉദാഹരണം വാഹനാപകട കേസുകൾ തന്നെ. ആൾ മരിച്ചാൽ പിന്നെ അയാളുടെ ബന്ധുക്കളെയാരെയെങ്കിലുമായിരിക്കും അപകടത്തിന്റെ  ദൃക്‌സാക്ഷികളാക്കുക. അവരാകട്ടെ അപകടശേഷം സ്ഥലത്തെത്തിയവരായിരിക്കും. പിന്നീട് കേസ് കോടതിയിൽ എത്തുമ്പോൾ അവർ ഉള്ള സത്യം പറയും, കേസും വെറുതെ വിടും. പൊതുവിൽ കേസ് അന്വേഷണത്തിന് ലോക്കൽ പോലീസിന് ഇനിയും പരിജ്ഞാനം ആവശ്യമായിരിക്കുന്നു. പോലീസിനെ പഠിപ്പിക്കാൻ വരുന്നോ എന്ന ഈഗോ കൂടിയാകുമ്പോൾ സാധാരണക്കാരന് ഒന്നും അന്വേഷണഘട്ടത്തിൽ പ്രത്യേകിച്ച് പറയാനുമില്ല, പറഞ്ഞാൽ ഒട്ടു ഗൗരവത്തിൽ എടുക്കുകയുമില്ല.

NO DIRECTION TO SUSPEND THE DRIVING LICENSE FOR RIDING WITHOUT HELMET - TRANSPORT COMMISSIONER, KERALA

Sir,

Under the instructions from Social Justice Watch (ER 326/2009), Infant Jesus Building No.2, Banerjee Road, Ernakulam an organization comprising of lawyers and social activists, engaged in imparting legal awareness and legal literacy programs to the general public, I hereby issue the following notice. You may kindly take note-

          THAT it is noticed through the various media reports and incidents reported to our organization, action have been taken by some of the RTO’s in Kerala, for suspension of driving license of persons who were riding motor cycles without wearing helmets (protective head gears). Admittedly using helmet while riding motor vehicles would help to prevent fatal accidents and therefore all are bound to use helmets as per law.
         
          THAT, despite of the good intention you might have in taking strenuous action against helmetless riders, you are not supposed and authorized to issue any direction which is against the provisions of legislation. The Motor Vehicles Act does not contemplate any action of suspension of license for an offence of driving a motor cycle without protective head gear. Any such direction would be an act of ultra vires of the powers granted to you as an officer in executive and it is against the legislative intention behind the Motor Vehicles Act and Rules.  

          THAT, the act of sending notices to suspend driving license to those who are not using helmets while riding motor cycles is illegal and the authorities appointed under the Motor Vehicle Act, 1988 have no jurisdiction to suspend the license of persons in the above said category. Such an action from various RTO’s as per the alleged direction issued by you is creating difficulty, apprehension and unrest among the common run who are using two wheelers in Kerala.
         
       
          THAT, the section 21 and 22 of the Motor Vehicle Act, 1988 laid down the provisions for the suspension or cancellation of licenses in connection with the offences under the Motor Vehicle Act. But those provisions are related to the accused persons who are convicted for offences of required nature and said provisions cannot be used against the persons who drive two wheelers without protective head gear. Section 19 of the said Act specifies the power of the licensing authority to disqualify the driving licenses and revoke such licenses. Driving without helmet is not an act which is likely to cause nuisance or danger to the public and therefore none of the provisions under Section 19 cannot be applied in case of driving motor cycles without helmet, for issuing notices for suspension of license.

          THAT, it is admitted that wearing of protective head gear(helmet) is mandatory as per Section 129 of the Act and 347 of Kerala Motor Vehicle Rules 1989. It also requires that the protective head gear owned by a person shall be of ISI Standard. The offences of not wearing helmets are covered under Section 177 of the Motor Vehicle Act 1988, the general provision for punishment for offences. The Section 177 clearly stipulate whoever violating any of the provisions of this Act be punishable with a fine for Rs.100/- and for subsequent offences with fine upto Rs.300/-.

          THAT, the aforementioned being the legal position, the Act of RTO’s issuing the notices to suspend the license as per your direction is illegal. There is no provision to suspend license for offences covering u/s 177 of the Motor Vehicle Act. Furthermore as per the decision in 2011 (2) KHC 261 Mehaboob Vs. State High Court of Kerala and established provisions of law and offences of Motor Vehicle Act are non cognizable in nature and even the courts cannot take cognizance on a charge sheet submitted by the police or any other enforcing agency upon offences under the Motor Vehicles Act, if such charge is filed without obtaining leave from Magistrate u/s 155(2) of the CRPC.

          THAT, the issuance of such illegal and arbitrary notices to suspend the license will result in giving reply by those persons by taking legal opinions and the concerned officers have to consider the replies and hear the matter and thereby, the Government machinery will have to do this additional work and met with additional expenses. The persons in the Department who issued such illegal notices alone can be made liable for such futile exercise of the Government machinery. Obviously, all these exercise are at the expense of public exchequer and on the basis of a notice issued without authority and legality, the state machinery have to defend it and spend considerable time and staff strength for disposing such petitions. This may affect the other routine work of the RTO offices and after all, all these exercise are futile, because there is no such power for any official as per Motor Vehicles Act to suspend the license of a person who had driven a two wheeler without protective head gear. By knowing all these facts, you are not supposed to issue such a direction, which will cause much loss in terms of money and manpower to the State.

          Therefore you are hereby directed to withdraw any such direction issued by you to suspend the driving licenses of persons who drove two wheelers without wearing protective head gear OR instruct the officers in your Department not to issue any illegal notice of suspension of license for the offence of driving two wheeler without using protective head gear, within 7 days of receipt of this notice and failing which, I got clear instructions to initiate appropriate legal proceedings only and those officers who issue such illegal directions and notices alone will be liable for the cost and consequences thereof.

Non possession of Aadhar card is not a bar to get benefits...Supreme Court ordered that, possession of an Aadhaar card shall not be a requirement for availing any governmental benefit or service.

The Supreme Court, as an interim measure today, directed that the possession of an Aadhaar card shall not be a requirement for availing any governmental benefit or service. The direction was issued by the Court in a Public Interest Litigation (PIL) filed by former Karnataka High Court Judge Justice KS Puttaswamy [Justice KS Puttaswamy (Retd.) v. Union of India & Ors., WP (c) 494/2012] challenging the constitutional validity of the Aadhaar scheme.
The matter was heard by a Division Bench comprising of Justices BS Chauhan and SA Bobde. The Court after hearing the parties also directed that no illegal migrants should be issued an Aadhaarcard.
The petitioner, Justice (Retd) Puttaswamy has sought the quashing of the Aadhaar scheme on the ground that it violates the right to privacy guaranteed under Article 21 of the Constitution in as much as it required the individuals obtaining an Aadhaar number to part with personal information, such as biometrics, iris scans and fingerprints. Justice Puttaswamy has also submitted that there are no safeguards or penalties and no legislative backing for obtaining personal information, and the proposed legislation introduced by the Government had been rejected by the Parliamentary Standing Committee on Finance.
He has further contended that the Aadhaar scheme was linked to various governmental services and benefits like food security under the newly enacted Food Security Act, LPG subsidy, Employees’ Provident Fund, and other DBT benefits. Hence, he argues that an Aadhaar card is mandatory to avail these benefits, contrary to the government’s claim that it is a voluntary scheme. He has also alleged that unchecked allotment of Aadhaar numbers to all residents, including illegal migrants, was jeopardising national security and that scheme was introduced to gain political mileage.
Senior Counsel Anil Divan appeared for the petitioner and was assisted by Advocate Ankit Goel. Divan submitted that Aadhaar card has been made mandatory for registration of marriages in Jharkhand, for teaching and non-teaching staff to draw salaries in Maharashtra and for availing various government scholarships. He, therefore, sought for interim directions to safeguard the rights of the citizens. Appearing for the Central government, Solicitor General Mohan Parasaran and Additional Solicitor General L Nageswar Rao opposed any interim relief arguing that Aadhaarwas purely a voluntary scheme.
The Court, however, issued interim directions to the effect that Aadhaar card shall not be mandatory till the matter is decided and no Aadhaar should be issued to illegal migrants. It agreed to hear all the issues involved and posted the matter for final hearing for a non miscellaneous day. Since both Justice Chauhan and Justice Bobde are part of the Constitution Bench hearing a criminal writ petition, the case will be heard only after the conclusion of the Constitution Bench matter.  
Earlier, the Delhi High Court had also issued notice to the Central Government, Government of Delhi and the Unique Identification Authority of India in a petition filed by NGO Beghar Foundation seeking quashing of the Aadhaar scheme on similar grounds.

Cancellation/ suspension of license on driving without helmet..other traffic offences.. Whether legal?

The Transport Commissioner of Kerala, (2013) has issued directions via news media to suspend the licenses of persons who are riding motor vehicles without using helmet. Off course, these kind of direction may create panic among people and the retributive theory of punishment may work out. But is this legal ? Is it possible in a highly literate State like Kerala?

The punishment for driving without helmet will come under the general category in section 177 of the Motor Vehicles Act and the fine prescribed is only Rs 100. Can any Transport Commissioner or any officer act against the legislation ? The basic fact that these kind of directions may reduce accident death and it will cause more people to obey the law. But how far is this legal?
In strict sense, there cannot be a fine more than Rs 100 for booking a person under section 177 of Motor Vehicles Act for riding without a helmet. 
Likewise, in several junctions, the amount of fine such as Rs 1000.. etc are seen printed on boards for traffic violations. But imposing fine and fixing the quantum of fine whether it can be maximum or otherwise, it is the duty of the judiciary, and executive officers have no power to intervene in such matters. 
SUSPENSION OF DRIVING LICENSE - CANNOT BE ARBITRARY

Recent news show that, even on riding a motor cycle without helmet would invite suspension of the license. The section 20,21,22,23 of Motor Vehicles Act deals with the provisions of suspension, cancellation etc of the license. 
But those action can be done only on found guilty. If the person is not pleading guilty and contesting the matter, then also the question of aforesaid suspension by the detecting officer cannot be done. 
In one of the case in the year 1991 itself, Js Thulasidas of Kerala High Court held in Divakaran V. State of Kerala that, the cancellation/suspension of license cannot be done in capricious and arbitrary way. The interesting fact is that, the then lawyer who appeared in the said case Mr. P R Ramachandra Menon is a sitting judge in High Court of Kerala.

എല്ലാ സര്‍ക്കാര്‍ ഓഫീസുകളിലും പബ്ലിക് ഇന്‍ഫര്‍മേഷന്‍ ഓഫീസര്‍മാരെയും അസിസ്റ്റന്റ് പബ്ലിക് ഇന്‍ഫര്‍മേഷന്‍ ഓഫീസര്‍മാരെയും നിയോഗിച്ചിട്ടുണ്ട്. ഏതെങ്കിലും ഒരു കാര്യത്തെക്കുറിച്ച് വിവരം ലഭിക്കേണ്ടവര്‍ 10 രൂപ ഫീസ് സഹിതം ബന്ധപ്പെട്ട പബ്ലിക് ഇന്‍ഫര്‍മേഷന്‍ ഓഫീസര്‍ക്ക് അപേക്ഷ നല്‍കണം. രേഖാമൂലമോ ഇലക്ട്രോണിക് മാധ്യമം വഴിയോ അപേക്ഷ നല്‍കാം. അപേക്ഷ എഴുതി നല്കാന്‍ കഴിയാത്ത വ്യക്തി പറയുന്ന കാര്യങ്ങള്‍ രേഖപ്പെടുത്തി അപേക്ഷ തയ്യാറാക്കുന്നതിന് പബ്ലിക് ഇന്‍ഫര്‍മേഷന്‍ ഓഫീസര്‍ സഹായിക്കണം. അപേക്ഷകന്‍ വിവരം തേടുന്നത് എന്തിനാണെന്ന് വെളിപ്പെടുത്തേണ്ടതില്ല. ബന്ധപ്പെടുന്നതിനുള്ള വിലാസം മാത്രമേ അപേക്ഷയില്‍ കാണിക്കേണ്ടതുള്ളു. വിവരങ്ങളും രേഖകളും ലഭിക്കുന്നതിനുള്ള ഫീസുകള്‍ സര്‍ക്കാര്‍ നിശ്ചയിച്ചിട്ടുണ്ട്. ദാരിദ്ര്യരേഖയ്ക്ക് താഴെയുള്ളവരെ അവ തെളിയിക്കുന്നതിനുള്ള രേഖകള്‍ ഹാജരാക്കുന്ന പക്ഷം നിര്‍ദ്ദിഷ്ട ഫീസ് ഈടാക്കുന്നതില്‍ നിന്നും ഒഴിവാക്കിയിട്ടുണ്ട്.
അപേക്ഷ ലഭിച്ച് 30 ദിവസത്തിനകം പബ്ലിക് ഇന്‍ഫര്‍മേഷന്‍ ഓഫീസര്‍ അപേക്ഷകന് വിവരം നല്‍കണം. അസിസ്റ്റന്റ് പബ്ലിക് ഇന്‍ഫര്‍മേഷന്‍ ഓഫീസര്‍ വഴി ലഭിച്ച അപേക്ഷയാണെങ്കില്‍ 35 ദിവസത്തിനകം വിവരം നല്‍കിയാല്‍ മതി. എന്നാല്‍ വ്യക്തിയുടെ ജീവനെയോ സ്വാതന്ത്ര്യത്തെയോ ബാധിക്കുന്ന വിവരമാണ് ആവശ്യപ്പെടുന്നതെങ്കില്‍ അത് 48 മണിക്കൂറിനകം നല്‍കിയിരിക്കണം. ആവശ്യപ്പെടുന്ന വിവരം ലഭിക്കുന്നില്ലെങ്കിലോ അപൂര്‍ണ്ണവും അവാസ്തവവുമായ വിവരമാണ് കിട്ടിയതെങ്കിലോ അക്കാര്യത്തില്‍ പരാതിയുള്ള വ്യക്തിക്ക് അപ്പീല്‍ സംവിധാനവും നിയമത്തില്‍ വിഭാവനം ചെയ്തിട്ടുണ്ട്. നിയമം അനുശാസിക്കും വിധം വിവരം നല്‍കുന്നില്ലെങ്കില്‍ ബന്ധപ്പെട്ട ഉദ്യോഗസ്ഥനെതിരെ ശിക്ഷണ നടപടികളും നിയമം വ്യവസ്ഥ ചെയ്യുന്നു. സംസ്ഥാന ഇന്‍ഫര്‍മേഷന്‍ കമ്മീഷനാണ് വിവരാവകാശ നിയമം നടപ്പിലാക്കുന്നതും അവയിലെ പരാതികള്‍ തീര്‍പ്പാക്കുന്നതും ശിക്ഷാ നടപടികള്‍ സ്വീകരിക്കുന്നതുമായ അധികാരസ്ഥാനം.

Motor accident cases - what to do after accident- criminal case and claim case - Motor Vehicles Act.

Motor Accidents are common on the roads. Pursuant to the accident, altercation between the parties are also common in some minor accidents. Cursing each other and alleging fault upon the other side, people gathering and watching them around and finally police will come and direct both the vehicles to be taken to the Police Station...these are routine in busy routes in Kerala.

What are the cases follow?
If a motor accident is occurred and any of the party suffered injury, then offences under section 279, 337/338 of Indian Penal Code are usually charged. If the driver is not a person who is the profession of a driver or a Government Driver, people are ready to plead guilty of the above said offences and for the time being, the Magistrate courts in which these cases are tried will allow the accused to plead guilty by paying fine amount only. This can be done even in the absence of the accused through pleader. 
If any one dies in the Motor Accident, then the offence under section 304A of IPC will be charged and accused cannot go with fine alone, on pleading guilty in the said offence.

What the injured to do?
Rather than picking quarrel on the cause of the accident, it is better for the injured to get admitted in the hospital at the earliest. At the time of first instance itself, the cause of injury must be revealed to the duty doctor. Also mention the number of the vehicle which hit the injured.

Motor Accidents Claims Tribunal
On releasing from the hospital, the injured can claim compensation from the accused/driver and owner of the vehicle. They will be indemnified by the Insurance Company and the insurance company will pay compensation for the owner to the injured. For this purpose, all the bills, salary certificate, loss of income etc need to be brought in evidence. There is no limitation period for filing claim. The claim can be filed at the place of accident or where the claimant resides.

Right to be represented by a lawyer- proceedings under the provision of Maintenance and Welfare of Parents and Senior Citizens Act

The Section 17 of the Maintenance and Welfare of the Parents and Senior Citizens Act denies the right to be represented by a lawyer as far as the parties are concerned. This question was mooted before the High Court of Kerala and now it is settled position that, in view of the provisions of section 30 of the Advocates Act, the provisions in various statutes which deprives the right of legal representation for the parties had been watered down. In the result, the section 17 of the Senior Citizens Act (in short) cannot be a ground to deny the right to be represented by a lawyer in the proceedings.
However, this aspect is still not known to many of the presiding officers/RDOs exercising jurisdiction on the basis of this Act.
The Decision rendered by High Court of Kerala declared this right categorically. ..

"The issue involved in this case is with regard to the right of the petitioner to be represented through a lawyer before the Maintenance Tribunal & Revenue Divisional Officer in a proceeding filed under the provisions of The Maintenance and Welfare of Parents and Senior Citizens Act, 2007.....

(3) KLT SN 150 ( case number 151) Venkatachalam v.Ajith Kumar C. Shah holding that, it is open for the persons like the petitioner to appoint an 'authorised agent' who can appear on behalf of the party....
.....The learned counsel for the petitioner however submits that, the idea and understanding of the second respondent with regard to the rights and liberties of the petitioner, to be represented through a lawyer, is not at all correct. More so, in view of the notification issued by the Central Government bringing Section 30 of the Advocates Act 1961 in to force with effect from 15/6/2011......
.........It is also brought to the notice of this Court that, there was an occasion for this Court to have considered similar issue, with reference to Section 30 of the Advocates Act, in respect of the proceedings before the Family Court, in the decision reported in 2011 (3) KLT 936 Saji v.Union of
India. With regard to the decision sought to be relied on from the part of the second respondent, it is seen that it was with reference to the rights and liberties of the party to be represented before the forum under the Consumer Protection Act 1986, 'through an authorised agent'. It however does not relate to the right of a lawyer to enter appearance on behalf of a litigant by virtue of the mandate under Section 30 of the Advocates Act 1961.

After hearing both the sides, this Court finds that, there is no dispute as to the fact that Section 30 of the Advocates Act, which was lying dormant right from the date of incorporation, till the parliament decided to give effect to the said provision with effect from 15/6/2011. By virtue of the said provision, the provisions contained in various statutes, restricting the right of a Lawyer, placing an
embargo with regard to the right to appear before the concerned forum Court/Tribunal has rather become watered down. The position has been discussed by this Court in detail as per the decision cited supra ie., 2011 (3) KLT 936 Saji v.Union of India........

Twenty per cent seats in Stage Carriers in Kerala shall be marked for senior citizens. In accordance with the implementation of senior citizens act, the Kerala Motor Vehicle Rules are amended in this regard.

REGULATION FOR THE WORKING OF THE BOARD OF CONTROLCONSTITUTED UNDER THE ORPHANAGES AND OTHER CHARITABLE HOMES (SUPERVISION AND CONTROL) AMENDMENT ACT 2013

The Social Justice (C) Department of Government of Kerala published notification [G. O (P) No.52/2013/SJD Dated 22/6/2013 as S.R.O. No. 527/2013 in K.G. Ext No.1867 dt 28/06/2013] for regulating the working of board of control constituted under the Orphanages and Other Charitable Homes Act 1960.

It is amended in the Regulation 9, that, the following terms are included. – All admissions to a recognized home shall be based on a Destitution Certificate for an orphan in form No.I or a Destitution Certificate for a non-orphan in form II from the village officer of the village in which the person permanently resides.

This is the last amendment as on September 2013 in this law. The number of destitute are increasing, especially those who are in the old age. Most often they are abandoned in their own houses, when the children are roaming away for better pastures of life and profession. But this legislation is intended to regulate the orphanages and other charitable homes and to have a general standard for the betterment of the inmates. The moot point is what is the role of Government in this area? Regulations are always welcome and they are necessary. But Government need to pump more funds in this area and Government run homes are to be established more in number.

Now the situation is grim, and there exist a large number of charitable homes assuring care to the destitute and old age people. Obviously many of them are not registered but they are providing better amenities to their inmates. But want of registration does not make them a legally equipped home. Running a home without recognition is a cognizable offence, the same need to be tried in magistrate court.

Therefore, all the amendments and new regulations are significant and the managements of the respective homes are duty bound to comply with the same.
