IMPOSING A CONDITION TO DEPOSIT ORIGINAL TITLE DEED - ONEROUS BAIL CONDITION- High Court of Kerala

The decision of a Sessions Judge, while granting bail to the accused, to surrender the original title deeds of the sureties in the executing court and keep the same in court custody till the disposal of the case is not good in law. The Honourable High Court observed that the condition imposed by the court below is an onerous condition. The impugned order does not show that the petitioner is involved in any other crime.
The High Court (Js Sunil Thomas) directed that the original title deeds can be taken back by the sureties after verification and submission of copy is suffice. Advocate Sherry J Thomas appeared for the Petitioner.
