MONEY LENDING LICENSE IN KERALA

Operation KUBERA - the 2014 action of Kerala Police to book illegal money lenders made the money lenders who are doing the business without license to run from pillar to post.
There are instances where some people are using this as an occasion to file a petition against the money lender, whom they owed and thereafter, to get rid of the liability for ever.
However, if proper steps are taken, money lending business can be conducted legally, in all sense.
The Kerala Government legislated Kerala Money-lenders Act, 1958 to regulate the business of money lenders.
The details of legal formalities-

Sec 3. Money-lender to obtain licence.― (1) From the date on which the provisions of this Act are brought into force in any area, no person, firm or joint family [18].[“or
unincorporated association of individuals shall commence or”] carry on or continue business as a money-lender at any place in such area without a licence obtained under this Act or in contravention of the terms thereof:

Provided that nothing in this section shall be deemed to prohibit a person who has applied for a licence to carry on or to continue business as a money-lender pending orders on his application.
(2) Where a money-lender has more than one shop or place of business, whether in the same town or village or in different towns or, villages he shall obtain a separate licence in respect of each shop or place of business.

6. A licensee who lends fifty lakh rupees or above, in
an year

                                                             Two lakh rupees.

Dishonour of Cheque – Directions issued to Trial Courts

 Many of the directions given by the various High Courts, in our view, are worthy of emulation by the
Criminal Courts all over the country dealing with cases under Section 138 of the Negotiable Instruments
Act, for which the following directions are being given :-

DIRECTIONS:

(1) Metropolitan Magistrate/Judicial Magistrate (MM/JM), on the day when the
complaint under Section 138 of the Act is presented, shall scrutinize the complaint and, if
the complaint is accompanied by the affidavit, and the affidavit and the documents, if
any, are found to be in order, take cognizance and direct issuance of summons.

(2) MM/JM should adopt a pragmatic and realistic approach while issuing summons.
Summons must be properly addressed and sent by post as well as by e-mail address got
from the complainant. Court, in appropriate cases, may take the assistance of the police
or the nearby Court to serve notice to the accused. For notice of appearance, a short date
be fixed. If the summons is received back un-served, immediate follow up action be
taken.

(3) Court may indicate in the summon that if the accused makes an application for
compounding of offences at the first hearing of the case and, if such an application is
made, Court may pass appropriate orders at the earliest.

(4) Court should direct the accused, when he appears to furnish a bail bond, to ensure his
appearance during trial and ask him to take notice under Section 251Cr.P.C. to enable
him to enter his plea of defence and fix the case for defence evidence, unless an
application is made by the accused under Section 145(2) for re- calling a witness for
cross-examination.

(5) The Court concerned must ensure that examination-in-chief, cross- examination and
re-examination of the complainant must be conducted within three months of assigning
the case. The Court has option of accepting affidavits of the witnesses, instead of
examining them in Court. Witnesses to the complaint and accused must be available for
cross-examination as and when there is direction to this effect by the Court.

22. We, therefore, direct all the Criminal Courts in the country dealing with Section 138 cases to follow
the above-mentioned procedures for speedy and expeditious disposal of cases falling under Section 138 of
the Negotiable Instruments Act.

23. Writ Petition is, accordingly, disposed of, as above.

അനാവശ്യ ego മൂലം ഉണ്ടാക്കുന്ന അനിഷ്ടസംഭവങ്ങള്‍ക്ക് യാതൊരു കുറവുമില്ല. വിവരം ഉള്ളവരും ഇല്ലാത്തവരും ഒരുമിച്ചു ഒരേ സ്വഭാവം കാണിക്കും ഒരേ ഒരു സ്ഥലമായി ഇന്ന് പൊതു റോഡുകള്‍ മാറിയിരിക്കുന്നു. അതിന്‍റെ അനന്തര ഫലം ചിലപ്പോള്‍  ചീത്തവിളിയില്‍ അവസാനിക്കും. ചിലപ്പോള്‍ അക്രമത്തിലും. ഗതാഗത കുരുക്കിനിടയിലൂടെ വാഹനം കുത്തിക്കയറ്റി ഓടിക്കാന്‍ ശ്രമിച്ചതില്‍ ഉണ്ടായ തര്‍ക്കം കഴിഞ്ഞ ദിവസം ഒരു സ്ത്രീയെ വരെ ആക്രമിക്കുന്നതില്‍ എത്തി. വിനോദ യാത്രക്ക് റോഡില്‍ വിനോദം ഇല്ല അവിടെയും വണ്ടിയെ മറികടക്കുന്നതില്‍ തര്‍ക്കം- ഒടുവില്‍ കൊട്ടേഷന്‍ സംഘത്തിന് ജോലി, പിന്നെ പോലീസിനും.
എല്ലാവര്‍ക്കും തിരക്കാണ്
ജീവിതത്തില്‍ നിങ്ങള്‍ ആയുമായിക്കൊള്ളട്ടെ; വാഹനമോടിക്കുമ്പോള്‍ നിങ്ങള്‍ ഡ്രൈവര്‍ മാത്രമാണ്. ഒരു മിനിറ്റ് വാഹനം ബ്ലോക്കായാല്‍ പിന്നെ നിരയായി കിടക്കാന്‍ ഇവിടാരും തയ്യാറല്ല. എല്ലാവര്ക്കും ആദ്യം എത്തണം. നിര തെറ്റിച്ചു എല്ലാ വണ്ടിയും കുത്തിക്കയറ്റി പിന്നെ യഥാര്‍ത്ഥ ബ്ലോക്കിന് കാരണം മാറിയാലും വാഹനം ഓടിക്കാനാകാത്ത അവസ്ഥ. അതാണ് കൊച്ചി. വണ്ടികളെല്ലാം നിരത്തി ഇട്ടാലും ഒരിഞ്ചു ഉണ്ടെങ്കില്‍ അതിലൂടെയും വരും മിടുക്കന്മാര്‍. എന്തെങ്കിലും ആരെങ്കിലും പ്രതികരിച്ചാല്‍ --അതും സൂക്ഷിച്ചു വേണം. കൊട്ടേഷന്‍ കൂട്ടുകാരുള്ളവരാണോ, കണ്ജവാണോ, എന്തും ആകാം. ചിലപ്പോള്‍ പിന്നീടാകാം പ്രതികരണം.
നിയമങ്ങള്‍ക്കു  ഒരു കുറവുമില്ല
നിയമമില്ലാത്തത് കൊണ്ടല്ല; ഒരു ചെറിയ ചീത്ത വാക്ക് പറഞ്ഞാല്‍ മൂന്നു മാസം വരെ ശിക്ഷ [284(b) IPC] കൊടുക്കാന്‍ അത് മതി. ഒരാളെ ഭീഷണിപ്പെടുത്തിയാല്‍ ഏഴു വര്ഷം വരെ വേണമെങ്കില്‍ ശിക്ഷ [506 part II IPC] കൊടുക്കാനുള്ള നിയമവും ഉണ്ട്. പൊതുനിരത്തില്‍ അപകടകരമായി വാഹനമോടിച്ചാല്‍ [279 IPC] ആര് മാസം തടവ്‌ അല്ലെങ്കില്‍ പിഴ. അപകടകരമായി വാഹനമോടിച്ച് ആര്‍ക്കെങ്കിലും പരിക്കുണ്ടാക്കിയാല്‍ [338 IPC] രണ്ടു വര്ഷം തടവ്‌ അല്ലെങ്കില്‍ പിഴ. അടിക്കും ഇടിക്കും ഒക്കെ വേറെ നിയമങ്ങള്‍. പോലീസ് നിയമനുസരിച്ചുള്ള കുറ്റങ്ങള്‍ വേറെ. എന്നാലും ചെറിയ കാര്യത്തിനാണേല്‍ പോലും റോഡില്‍ തെറിയും ഭീഷണിയും പതിവാകുന്നു.
പോലീസാണേല്‍ വാഹന പരിശോധനയോടു പരിശോധന; ദിവസക്കോട്ട തികക്കണമല്ലോ- അതറിയണമെങ്കില്‍ വൈകുന്നേരത്തെ വയര്‍ലെസ്സ് സന്ദേശങ്ങള്‍ ശ്രദ്ധിച്ചാല്‍ മതി.
തെറി സംസ്കാരത്തില്‍ നിന്ന് ചിരി സംസ്കാരത്തിലേക്ക്
ഇനി സമാധാനമായി വാഹനവുമായി കൊച്ചിയില്‍ നീങ്ങണമെങ്കില്‍  വഴി രണ്ടുണ്ട്. ഒന്നുകില്‍ എന്തുകണ്ടാലും കേട്ടാലും ഒന്നും അറിയാത്ത പൊട്ടനെ പോലെ ഇരിക്കുക.
രണ്ടാമത്തേത്; തെറിയുടെ സംസ്കാരത്തില്‍ നിന്ന് ചിരിയുടെ സംസ്കാരത്തിലേക്ക് മാറാന്‍ ഒരു ചിരി നമ്മളില്‍ നിന്ന് തന്നെ തുടങ്ങുക..

നോട്ടയുടെ കോട്ടം - NEGATIVE VOTE NOTA - Its NEGATIVE.

നോട്ടയുടെ കോട്ടം
കേരളത്തിലെ 20 പാര്‍ലമെന്‍ട് മണ്ഡലങ്ങളിലും മത്സരിക്കുന്ന ഒരു സ്ഥാനാര്‍ഥി ഇക്കുറി ആദ്യമായി ഉണ്ടാകും. “നോട്ട”. ജീവനുള്ള സ്ഥാനാര്‍ഥികള്‍ക്കാര്‍ക്കും, വോട്ടു ചെയ്യാന്‍ തല്പ്പര്യമില്ലാത്തവര്‍ക്ക് നോട്ടക്ക് വോട്ടു ചെയ്യാം. എന്തിനെയും എതിര്‍ക്കുന്ന കുറേപ്പേര്‍ ഇപ്പോള്‍ നോട്ടയെയും നോക്കി നടക്കുന്നുണ്ട്.
പക്ഷെ നോട്ടക്കൊരു കുഴപ്പമുണ്ട്. എത്ര പേര്‍ വോട്ടുചെയ്താലും നോട്ട ജയിക്കില്ല. ഏറ്റവും കൂടുതല്‍ വോട്ട് നോട്ടക്ക് കുത്തിയാലും നോട്ട ജയിക്കില്ല. കാരണം ഇത് കോടതി ഉണ്ടാക്കിയ വോട്ടയതുകൊണ്ടാണ്. കോടതിക്ക് വോട്ടുണ്ടാക്കാന്‍ അധികാരമുണ്ടോ എന്നത് വേറെ ചോദ്യം.
സ്ഥാനാര്‍ഥികള്‍ക്കാര്‍ക്കും വോട്ടു ചെയ്യാന്‍ തല്പ്പര്യമില്ലത്തവര്‍ക്ക് തങ്ങളുടെ പ്രതിഷേധം രഹസ്യമായി അറിയിക്കാന്‍ അവസരം ഉണ്ടാകണമെന്ന വാദമാണ് നോട്ടയുടെ പിതാവ്. കാര്യം ശരിയാണ്. നാളിതുവരെയും പ്രതിഷേധ വോട്ടു ചെയ്യുന്നവരെ എളുപ്പത്തില്‍ കണ്ടുപിടിക്കാനാകുമായിരുന്നു. കാരണം അവര്‍ ബൂത്തില്‍ എത്തിയതായി രേഖയുണ്ടാകും; പക്ഷെ വോട്ടു ചെയ്തതായി രേഖയുണ്ടാകില്ല.

പക്ഷെ എന്നുവച്ച് നോട്ടക്ക് വോട്ടു കുതിയിട്ടെന്താ കാര്യം ? അത് വെള്ളത്തില്‍ വരച്ച വര പോലെയല്ലേ. നിശ്ചിത ശതമാനം വോട്ടു നോട്ടക്ക് ലഭിച്ചാല്‍ തിരഞ്ഞെടുപ്പ് അസാധുവാകുമെന്നാണ് നിയമമെങ്കില്‍ പ്രതിഷേധിച്ചു നോട്ടക്ക് കുത്തിയത് കൊണ്ട് ഗുണമുണ്ടാകും. ഇതിപ്പോള്‍ വെറുതെ വെയില്‍ കൊണ്ട് സ്വയം സമാധാനിച്ചു മടങ്ങാം. അതാണ് നോട്ടയുടെ കോട്ടം. പിന്നെ നോട്ടക്ക് കുത്തി വോട്ടു കളയുന്നതിലും നല്ലത് നോട്ടയെ മറന്നു വീട്ടിലെ കാര്യം നോക്കുന്നതല്ലേ !

ക്രൈം ബുക്ക്‌ - posing with another's profile photo- face book

ക്രൈം ബുക്ക്‌
പാത്തുക്കുട്ടിയമ്മയ്ക്കും ഫേസ് ബുക്ക്‌ അക്കൗണ്ട്‌ ! അതിനു അതിശയിക്കേണ്ട കാര്യം ഇല്ല. പ്രായഭേദമെന്യേ ഇന്ന് ഒരു പുതിയ മുഖം എല്ലാവരും ആഗ്രഹിക്കുന്നു. സാഹചര്യവും സൌകര്യവും  ഒത്തു വരുന്നവര്‍ അത് ഫേസ് ബുക്ക്‌ അക്കൗണ്ടിലൂടെ യാഥാര്‍ത്ഥ്യമാക്കും. ചിലര്‍ നിവൃത്തിയില്ലാതെ പേരിനു ഒരു അക്കൗണ്ട്‌ തുടങ്ങും. എന്തായാലും ഫേസ് ബുക്ക്‌ ഇന്ന് പലപ്പോഴും ഒരു ക്രൈം ബുക്ക്‌ ആയി പ്രവര്‍ത്തിക്കുന്ന സംഭവങ്ങള്‍ ഏറി വരുന്നു.
മുഖം കടമെടുക്കുന്നവര്‍
നിങ്ങളുടെ മകളുടെ മുഖത്തിന്റെ ഫോട്ടോ തന്റെ ഫോട്ടോ ആണെന്ന് അവകാശപ്പെട്ട് ഒരാള്‍ ഫേസ് ബുക്ക്‌ അക്കൗണ്ട്‌ തുടങ്ങിയാല്‍ അതിനു അനുവദിക്കുമോ? അതോ നിങ്ങളുടെ മകളുടെ ഫോട്ടോ ദുരുപയോഗം ചെയ്യുന്നുവെന്നു പരാതി പറയുമോ ?
എന്നാല്‍ ഫേസ് ബുക്ക്‌ അക്കൗണ്ടില്‍ നല്ലൊരു വിഭാഗം ആളുകള്‍ തങ്ങളുടെതല്ലാത്ത ഫോട്ടോയില്‍ മുഖം മിനുക്കി നില്‍ക്കുന്നുണ്ട്. സ്വന്തം ഫോട്ടോ ഇട്ടാല്‍ ആരെങ്കിലും അത് ദുരുപയോഗം ചെയ്യുമോയെന്നു ഭയന്ന് അറിഞ്ഞോ അറിയാതെയോ മറ്റൊരാളുടെ ഫോട്ടോ എടുത്തു ഉപയോഗിക്കുന്നു. ഏതെങ്കിലും സിനിമക്കാരുടെയോ സെലിബ്രിട്ടികളുടെയോ ഫോട്ടോ സ്വന്തം പ്രൊഫൈല്‍ ഫോട്ടോയായി കൊണ്ടുനടക്കുമ്പോള്‍ ആലോചിക്കേണ്ട കാര്യം, സ്വന്തം മുഖം അങ്ങനെ മറ്റൊരാള്‍ കൊണ്ടുനടന്നാല്‍ പരാതി ഉണ്ടോ എന്നാണ്.

ഫോട്ടോയിലെ യഥാര്‍ത്ഥ മുഖമുള്ളയാള്‍ക്ക് എന്തെങ്കിലും ശല്യം അതുമൂലം തോന്നുന്നുവെന്ന് പരാതി വന്നാല്‍ പിന്നെ അഴി എണ്ണാo. ഈ മുഖം തന്റെ സ്വന്തം മുഖമല്ലെന്നു അറിഞ്ഞുകൊണ്ട് അത് ഉപയോഗിച്ച് അതിലെ യഥാര്‍ത്ഥ വ്യക്തികള്‍ക്ക് ശല്യം,അസൌകര്യം, അപകടം, തടസ്സം, അപമാനം, മനോവേദന, ശത്രുത, എന്നിവയില്‍ ഏതെങ്കിലും ബുദ്ധിമുട്ട് ഉണ്ടായാല്‍ പിന്നെ ഫേസ് ബുക്ക്‌, ക്രൈം ബുക്കായി മാറും.

ഏപ്രില്‍ ഒന്ന് മുതല്‍ തുറന്ന സ്ഥലത്ത് ജോലി ചെയ്യുന്നവര്‍ക്ക് ഉച്ചക്ക് 12 മുതല്‍ 3 വരെ വിശ്രമം നല്‍കാന്‍ തൊഴിലുടമ ബാധ്യസ്ഥനാകും. കേരളത്തില്‍ ഇത്തവണ ചൂട് കൂടിവന്ന സാഹചര്യത്തിലാണ് കേരള ലേബര്‍ കമ്മിഷണര്‍ പുതിയ ഉത്തരവ് ഇറക്കിയത്. കുറഞ്ഞ കൂലി ഉറപ്പാക്കാനുള്ള നിയമത്തിന്റെ അധികാരങ്ങള്‍ ഉപയോഗിച്ചാണ്‌ ഈ ഉത്തരവ് ഇറക്കിയത്.
രാവിലെ 7 മുതല്‍ വൈകീട്ട് 7 വരെയുള്ള സമയത്ത് ജോലി ക്രമീകരിച്ചു കൊണ്ട് ഉച്ചക്ക് 12 മുതല്‍ 3 വരെ വിശ്രമം നല്‍കണമെന്നാണ് ഉത്തരവ്. ഇനി തല്ക്കാലം കേരളത്തില്‍ ചൂട് കുറയുന്നത് വരെ നട്ടുച്ച വെയിലത്ത്‌ ആരും ജോലി ചെയ്തു ശാരീരിക അസ്വസ്ഥതകള്‍ ഉണ്ടാകാതിരിക്കാനാണ് ലേബര്‍ കമ്മിഷണര്‍ ഈ ഉത്തരവ് ഇറക്കിയത്.

മിനിമം വെജെസ് (കുറഞ്ഞ കൂലി) നിയമപ്രകാരം തൊഴിലാളികളുടെ തൊഴില്‍ സമയം ക്രമീകരിക്കാന്‍ ലേബര്‍ കമ്മിഷണര്‍ക്ക് അധികാരമുണ്ട്‌. പണി വേഗം അവസാനിപ്പിച്ചു വീട്ടില്‍ പോകാന്‍ തൊഴിലാളി തീരുമാനിച്ചു നട്ടുച്ച വെയിലില്‍ പണിയെടുക്കാന്‍ തയ്യാറായാലും ഉത്തരവിന്റെ ലന്ഘനം ശ്രദ്ധയില്‍ പെട്ടാല്‍ തൊഴിലുടമ പിഴ ഒടുക്കേണ്ടി വരും. സമുദ്ര നിരപ്പില്‍ നിന്ന് 3000 അടി ഉയരത്തിന് മുകളില്‍ ഉള്ള തൊഴിലിടങ്ങളില്‍ ഇതു ബാധകമായിരിക്കില്ല.

വാഹനാപകടം ഉണ്ടായാല്‍ എന്ത് സംഭവിക്കും ? അപകടത്തില്‍ കാര്യമായ പരിക്ക് പറ്റിയില്ലെങ്കില്‍ ഉടനടി ഇരു കൂട്ടരും റോഡിലിറങ്ങി പരസ്പരം ചീത്തവിളിയായിരിക്കും. പിന്നെ ആളുകൂടും, പോലീസ് വരും ഇരുകൂട്ടരും മൊബൈല്‍ ഫോണില്‍ ബന്ധുക്കളെയും കൂട്ടുകാരെയും ഒക്കെ വിളിച്ചു സംശയം തീര്‍ക്കല്‍, ആകെ ബഹളം.
യഥാര്‍ത്ഥത്തില്‍ വാഹനാപകടം ഉണ്ടായാല്‍ പരിക്ക് പറ്റിയ ആള്‍ക്ക് അപകടത്തിനു കാരണമായ വാഹനത്തിന്റെ ഇന്‍ഷുറന്‍സ് കമ്പനിയില്‍ നിന്നും നഷ്ടപരിഹാരം ലഭിക്കും. പക്ഷെ ഇരു കൂട്ടര്‍ക്കും ഇന്‍ഷുറന്‍സും ലൈസന്സുമൊക്കെ ഉണ്ടാകണമെന്ന് മാത്രം.
വാഹനാപകടമുണ്ടായാല്‍ രണ്ടു കേസുണ്ടാകും. ഒന്ന് – പോലിസ് ചാര്‍ജ് ചെയ്യുന്ന ക്രിമിനല്‍ കേസും, രണ്ട്- പരികുപറ്റിയതോ മരണപ്പെട്ടതോ ആയ  ആള്‍ക്ക് വേണ്ടി ഫയല്‍ ആക്കുന്ന  നഷ്ടപരിഹാര കേസും. അപകടത്തില്‍ മരണം ഉണ്ടായില്ലെങ്കില്‍ കുറ്റം സമ്മതിച്ചാലും ഫൈന്‍ അടച്ചു പോകാവുന്ന വകുപ്പുകള്‍ പ്രകാരമായിരിക്കും ക്രിമിനല്‍ കേസ്. ചുരുക്കത്തില്‍ നിലവില്‍ വാഹനാപകടം ഉണ്ടായാലും ഇടിച്ചയാള്‍ മരിച്ചിട്ടില്ലെങ്കില്‍ വലിയ പ്രശ്നമില്ല. കോടതിയില്‍ പോകാതെ തന്നെ വക്കീലിനെ വച്ച് ഫൈന്‍ അടച്ചു പോകാവുന്നതെയുള്ളു. (ഈയിടെയായി ചില കേസുകളില്‍ മോട്ടോര്‍ വാഹന വകുപ്പ് അധികൃതര്‍ ലൈസന്‍സ് താല്‍ക്കാലികമായി സസ്പെന്ഡ് ചെയ്യുന്നുമുണ്ട്)
പിന്നീടു നഷ്ടപരിഹാരത്തിനായി കേസ് വിധിയായാലും ഇന്‍ഷുറന്‍സ് കമ്പനി തുക നല്‍കും. ഇടിച്ചയാള്‍ മരിച്ചുപോയ സംഭവങ്ങളില്‍ ക്രിമിനല്‍ കേസില്‍ കുറ്റം സമ്മതിച്ചാല്‍ ജയില്‍ ശിക്ഷ ഉണ്ടാകും അത് കൊണ്ട് സാക്ഷികളെ വിസ്തരിച്ചു കേസ് നടത്തി വെറുതെ വിടാനുള്ള വിധി നേടണം.

പരിക്ക് പറ്റിയ ആളെ സംബന്ധിച്ചിടത്തോളം നഷ്ടപരിഹാര കേസ് മാത്രം നടത്തുന്ന  വക്കീലന്മാരുടെ എജെന്റുമാര്‍ ആശുപത്രിയില്‍ പല തവണ എത്തിയിട്ടുണ്ടാകും. മരണം സംഭവിച്ച കേസില്‍ ബന്ധുക്കളെ തേടിയായിരിക്കും ഇവരുടെ വരവ്. എന്താണെങ്കിലും ആലോചിച്ചു അന്വേഷിച്ചു കേസ് നല്‍കിയാല്‍ മതി. ആശുപത്രി ബില്ലുകളും മറ്റു രേഖകളും ഒക്കെയായി സാവധാനം നഷ്ടപരിഹാര കേസ് നല്‍കിയാല്‍ മതി. ആശുപത്രി ചെലവും, വേദനക്കും ജോലി നഷ്ടത്തിനും, പരിക്കുകള്‍ക്കുമൊക്കെയായി കണക്കുകള്‍ പ്രകാരമുള്ള തുകയും കേസിന്റെ ഗതിയനുസരിച്ച് ലഭിക്കും. ഇന്‍ഷുറന്‍സ് ഇല്ലാത്ത വണ്ടിയാണെങ്കില്‍ തുക ഉടമ നല്‍കേണ്ടി വരും.

MACT CLAIM - Motor accidents - dishonour of cheque issued by the insured- the cancellation of policy shall be intimated to the registering authority by the insurance company

Motor Vehicles Act - Accident- The certified copies of FIR, scene Mahassar, AMVI reports and charge sheet filed by the police before he criminal court are admissible in evidence in MACT, without formal proof. (AIR 2011 SC 1504)

MACT claim- No bills are produced by the claimant. Even then a sum  can be allowed as compensation for medical expenses. Courts must adopt humanistic and realistic approach. 2010 KHC 6215.
MACT claim - cheque given by the vehicle owner dishonoured and the insurance policy become void due to non payment of premium. Against the claim, it was contended that notice regarding the cancellation of insurance policy need to be served on the registering authority. In Daddappa case, the Supreme Court held that, intimation regarding cancellation of policy shall be given to the insured and the RTO concerned. The intimation of cancellation of the policy shall be given tothe RTO. 2008 ACJ 581 - Daddappa & Others V. Branch Manager, National Insurance Co. Ltd.

They are also consumers......Apartment owners waiting for completion indefinite...

Those who booked their flats with various projects are also consumers who are waiting for the offered service of the builders to get completed. If the builder fails to provide the flat in stipulated time and condition, the consumers can move the Consumer Disputes Redressal Forum for the redressal fo their grievance. Moving civil court may cause advance payment of 10 % of the total value as Court Fee. Therefore, the settled position in law that, those who booked flats for their personal use from the builders will also come under the purview of consumers.
Builder converted the area for common recreation use as per the project to commercial purpose. Such disputes can also be handled in Consumer Courts. 2013 1 KHC 252

Self financing educational institutions - KSEB bill - conversion of Tariff from LT VI B to commercial tariffs - legality


The question is whether the self financing educational institutions are liable to pay commercial tariff as prescribed by KSERC ?

The judgments of High Court of Kerala in Brother Joseph Antony cases (etc) are under challenge before the Supreme Court of India. The  SLP No. 30968/09 is admitted by the SC and the operation of the order of the Division Bench of High Court of Kerala is stayed.
Pointing out this aspects, the High Court of Kerala again in another Writ Appeal, held that though the tariff can be converted to commercial, but the arrears cannot be claimed by the KSEB, till the final disposal of the Case. [(Writ Appeal 660/2010) Permanant Lok Adalat (Public Utility Services) OP No. 173/2012.)]


 “The question raised in the Writ Appeal is whether self financing educational institutions 
are liable to pay commercial tariff as prescribed by the Electricity Regulatory Commission. 
Even though similar parties succeeded in this Court to get the tariff cancelled, the Hon 
Supreme Court admitted SLP No. 30968/09 and granted stay against operation of the 
Division Bench Judgment of this Court. When the order of the Division Bench is stayed by 
the Hon Supreme Court, tariff revives and the KSEB is free to collect commercial tariff from self-financing educational institutions” and the Court disposed of the Writ Appeal with the following direction. 

“(1) KSEB is authorised to collect tariff in terms of the Regulatory Commission but the 

same will be subject to the result of the judgment of the Supreme Court in the batch of 
SLPs pending before the Supreme Court. 

(2) However, no arrears will be recovered until the Supreme Court decides the matter and 
thereafter recovery of arrears will be based on judgment of the Supreme Court, which will 
be applicable in appellant’s case also.”

When this is the present status as on date, the KSEB Assistant Engineers issuing notices, to the consumers for pending arrears are against the directions of  High court of Kerala and against the settled position by the KSE Ombudsman.

KOCHI: Tenants won't be eligible for protection from eviction if they are not occupying the rented premises any longer, the Kerala high court held.

The ruling by a division bench comprising Justices K T Sankaran and P Ubaid came while considering a petition filed by C P Paul of Vytilla questioning Ernakulam rent control court's order to evict him from a building on MG Road in Kochi.

After taking a portion of Alangadan Buildings (1,200 square feet) on MG Road on rent, Paul had given the premises to his daughter and son-in-law for running a dental clinic. This was after he bought a five-storied building with total space of 30,000 square feet in the same locality, where he is running a hotel.

Declining to interfere in the rent control court's order, the judgment authored by Justice Ubaid said only those who are in possession of rented property has protection from eviction under Kerala Buildings (Lease and Rent Control) Act. Unscrupulous tenants, who try to continue on the premises by all means possible even when they have ceased to occupy the premises, or have otherwise handed over the premises to somebody, would not get the benefit of the protection under the Act. When such tenants come before the court, it must be the concern of the court that the provisions of the Act are not allowed to be misused, the court held.

The Act was introduced in Kerala with the social object of protecting tenants from unscrupulous and arbitrary eviction, while protecting the interests of landlords, the court pointed out.

In Lourdes Hospital v. Dr. Abraham Mathew, 2013 (4) KHC 347, the Kerala High Court held that a Hospital, even if it is involved only in charity work, comes within the definition of a ‘Shop’ under Section 2(15) of the Kerala Shops and Commercial Establishments Act, 1960. The court was dealing with the question of payment of gratuity to a superannuated employee. Relying on the definition of the Shop, the court held that Payment of Gratuity Act, 1972 adopts the definition of ‘Shop’ by reference and all establishments which were covered by the definition at the time of adoption, remains covered under the Gratuity Act.

Therefore, it is held that the prescription of minimum wages for Managers, in the notification cannot be sustained
Petitioners, an Association and two Industries engaged in the Rubber Product
Industry, has approached the High Court challenging the notification revising
minimum wages and providing for such minimum wages to be paid to various
categories of employees engaged in the Rubber Products Industry. They
raised manifold contentions. The first one was that the imposition of service
weightage was bad in law. The next one was with respect to payment of
monthly salary to managerial staff. The next contention was with respect to
the disparity between the employers engaged in a particular industry. And
finally, for inclusion of Managers for whom also the minimum wages has been
prescribed. The Court repelled all the contentions except the last one.
Partly allowing the writ petition, the Court held:
A counter affidavit has been filed by the Government which would indicate
that what was intended was to cover “Managers without administrative and
managerial powers who come within the purview of the Act. It is also admitted that any Manager having managerial, administrative and financial powers does not come within the purview of the term ‘employee’”. Such a distinction  is merely illusory and Managers definitely would not come within the definition of ‘employee’ as defined under the Act. The provision of ‘minimum wages’ to Managers in Ext. P5 cannot be enforced by the Government and to that extent, Ext. P5 would be set aside. However, in all other respects, Ext. P5 is confirmed. 2013 4 KHC 841

The scheme for compensation under section 357A of criminal procedure code is to be implemented in Kerala soon....
