ഭരണഘടനയുടെ അനുച്ഛേദം 300A പ്രകാരം സംരക്ഷിക്കപ്പെട്ടിട്ടുള്ള പൗരൻ്റെ സ്വത്തവകാശവും പരിസ്ഥിതി സംരക്ഷണവും തമ്മിലുള്ള തർക്കങ്ങൾ, രാജ്യത്തെ പരിസ്ഥിതിലോലമായ തീരദേശ മേഖലകളിൽ ഗുരുതരമായ ഭരണപരമായ പ്രതിസന്ധികൾ സൃഷ്ടിക്കാറുണ്ട്. നിയമം അനുശാസിക്കുന്ന മുൻകൂർ നടപടിക്രമങ്ങൾ പാലിക്കാതെ, കേവലം ചട്ടങ്ങൾ ചൂണ്ടിക്കാട്ടി തദ്ദേശ സ്വയംഭരണ സ്ഥാപനങ്ങൾ ഏകപക്ഷീയമായി കെട്ടിട നിർമ്മാണ പെർമിറ്റുകൾ നിരസിക്കുകയോ തടഞ്ഞുവെക്കുകയോ ചെയ്യുന്നതാണ് പലപ്പോഴും തർക്കങ്ങൾക്ക് വഴിവെക്കുന്നത്.

2025 മെയ് 28-ന് ബീന മാത്യു വേഴ്സസ് സ്റ്റേറ്റ് ഓഫ് കേരള (W.A. No. 1944 of 2023) എന്ന കേസിൽ ജസ്റ്റിസ് അമിത് റാവൽ, ജസ്റ്റിസ് മുരളീ കൃഷ്ണ എസ്. എന്നിവരടങ്ങിയ കേരള ഹൈക്കോടതി ഡിവിഷൻ ബെഞ്ച് സുപ്രധാനമായ ഒരു വിധി പ്രസ്താവിച്ചു: തണ്ണീർത്തടങ്ങൾ കണ്ടെത്തി തരംതിരിച്ച് വിജ്ഞാപനം ചെയ്യാനുള്ള നിയമപരമായ നടപടിക്രമങ്ങൾ പൂർത്തിയാക്കാതെ, 2010-ലെ തണ്ണീർത്തട (സംരക്ഷണവും പരിപാലനവും) ചട്ടങ്ങൾ യാന്ത്രികമായി പ്രയോഗിച്ച് കെട്ടിട നിർമ്മാണ പെർമിറ്റുകളോ അവയുടെ കാലാവധി നീട്ടുന്നതിനുള്ള അപേക്ഷകളോ നിരസിക്കാൻ തദ്ദേശ സ്ഥാപനങ്ങൾക്ക് അധികാരമില്ല.

കേസിൻ്റെ പശ്ചാത്തലം

കോട്ടയം ജില്ലയിലെ കുമരകം വില്ലേജിൽ 27.44 ആർസ് ഭൂമി ഹർജിക്കാരിയുടെ ഉടമസ്ഥതയിലുണ്ടായിരുന്നു. ഇതിൽ സർവേ നമ്പർ 328/34-ൽ ഉൾപ്പെട്ട 5.73 സെന്റ് സ്ഥലത്ത് വീട് നിർമ്മിക്കുന്നതിനായി 2010 ഡിസംബർ 22-ന് അവർ കുമരകം ഗ്രാമപഞ്ചായത്തിൽ അപേക്ഷ സമർപ്പിച്ചു. 1999-ലെ കേരള മുനിസിപ്പാലിറ്റി കെട്ടിട നിർമ്മാണ ചട്ടങ്ങൾ (KMBR) പ്രകാരം 2010 ഡിസംബർ 28-ന് പഞ്ചായത്ത് 2013 ഡിസംബർ 27 വരെ സാധുതയുള്ള പെർമിറ്റ് അനുവദിച്ചു. തുടർന്ന് ഇതിൻ്റെ കാലാവധി 2016 ഡിസംബർ 27 വരെ നീട്ടി നൽകുകയും ചെയ്തു.

1999-ലെ KMBR ചട്ടം 15A പ്രകാരം 2016 ഡിസംബറിൽ വീണ്ടും കാലാവധി നീട്ടാൻ അപേക്ഷിച്ചപ്പോൾ പഞ്ചായത്ത് അത് നിരസിച്ചു. തുടർന്നുണ്ടായ നിയമപോരാട്ടങ്ങളിൽ പഞ്ചായത്ത് നിലപാടുകൾ മാറ്റിക്കൊണ്ടിരുന്നു—ആദ്യം 2005-ലെ ടൂറിസം സോൺ വിജ്ഞാപനവും, പിന്നീട് 2011-ലെ സി.ആർ.സെഡ് (CRZ) വിജ്ഞാപനവും, ഒടുവിൽ 2010-ലെ തണ്ണീർത്തട ചട്ടങ്ങളിലെ ചട്ടം 4(1)(vi)-ഉം നിരസിക്കലിന് കാരണമായി നിരത്തി. ചട്ടം 4(1)(vi) പ്രകാരം 'ശരാശരി ഉയർന്ന വെള്ളപ്പൊക്ക നിരപ്പിൽ' (Mean High Flood Level - HFL) നിന്ന് 50 മീറ്ററിനുള്ളിൽ ബോട്ട് ജെട്ടികൾ ഒഴികെയുള്ള സ്ഥിരം നിർമ്മാണങ്ങൾ നിരോധിച്ചിട്ടുണ്ട്. നിർദ്ദിഷ്ട നിർമ്മാണം കായൽ അതിർത്തിയിൽ നിന്ന് 3.30 മീറ്റർ മാത്രം അകലെയാണെന്ന (പിന്നീട് രേഖപ്പെടുത്തിയ ജിയോ-കോർഡിനേറ്റുകൾ പ്രകാരം 17.35 മീറ്റർ) സാങ്കേതിക റിപ്പോർട്ടിന്റെ അടിസ്ഥാനത്തിൽ, സിംഗിൾ ബെഞ്ച് റിട്ട് ഹർജിയും പുനഃപരിശോധനാ ഹർജിയും തള്ളി. ഇതിനെതിരെയാണ് ഡിവിഷൻ ബെഞ്ചിൽ അപ്പീൽ സമർപ്പിച്ചത്.

അപ്പീലിലെ പ്രധാന നിയമപ്രശ്നങ്ങൾ

ഡിവിഷൻ ബെഞ്ച് പ്രധാനമായും പരിഗണിച്ച ചോദ്യങ്ങൾ ഇവയാണ്:

  1. ചട്ടം 6(3) പ്രകാരമുള്ള തണ്ണീർത്തട നിർണ്ണയവും വിജ്ഞാപന നടപടികളും പൂർത്തിയാക്കാതെ, തദ്ദേശ സ്ഥാപനങ്ങൾക്ക് തണ്ണീർത്തട ചട്ടങ്ങളിലെ 4(1)(vi) പ്രകാരമുള്ള നിയന്ത്രണങ്ങൾ യാന്ത്രികമായി പ്രയോഗിക്കാനാകുമോ?
  2. ഉയർന്ന വെള്ളപ്പൊക്ക നിരപ്പ് (HFL) കൃത്യമായി നിർണ്ണയിച്ച് അടയാളപ്പെടുത്താതെ 50 മീറ്റർ ദൂരപരിധി നിയന്ത്രണം ഏർപ്പെടുത്താൻ സാധിക്കുമോ?
  3. 2011 ജനുവരി 6-ന് നിലവിൽ വന്ന സി.ആർ.സെഡ് വിജ്ഞാപനം, അതിനുമുമ്പ് അനുവദിച്ച പെർമിറ്റുകൾക്ക് മുൻകാല പ്രാബല്യത്തോടെ ബാധകമാകുമോ?
  4. റവന്യൂ രേഖകളിൽ 'പുരയിടം' എന്ന് രേഖപ്പെടുത്തിയിട്ടുള്ള ഭൂമിയെ, കൃത്യമായ നിയമനടപടികളിലൂടെ തരംമാറ്റാതെ തണ്ണീർത്തടമായി കണക്കാക്കാൻ കഴിയുമോ?

കോടതിയുടെ സുപ്രധാന കണ്ടെത്തലുകൾ

1. ചട്ടം 6(3) പ്രകാരമുള്ള തിരിച്ചറിയലും വിജ്ഞാപനവും അത്യന്താപേക്ഷിതമാണ് (Sine Qua Non) യാതൊരു അടിസ്ഥാനവുമില്ലാതെ പരിസ്ഥിതി നിയന്ത്രണങ്ങൾ അടിച്ചേൽപ്പിക്കാൻ കഴിയില്ലെന്ന് ഹൈക്കോടതി വ്യക്തമാക്കി. 2010-ലെ തണ്ണീർത്തട ചട്ടങ്ങളിലെ ചട്ടം 6(2), 6(3) പ്രകാരം, ഓരോ തണ്ണീർത്തടത്തിന്റെയും കൃത്യമായ അതിർത്തികൾ, സ്വാധീന മേഖലകൾ വ്യക്തമാക്കുന്ന സ്കെയിൽ മാപ്പുകൾ, വിസ്തൃതി, നിലവിലുള്ള അവകാശങ്ങൾ എന്നിവ ഉൾപ്പെടുത്തി സംസ്ഥാന സർക്കാർ 'ലഘുരേഖ' (Brief Document) തയ്യാറാക്കേണ്ടതുണ്ട്. തുടർന്ന് ചട്ടം 6(6) പ്രകാരം പൊതുജനങ്ങളിൽ നിന്ന് ആക്ഷേപങ്ങൾ ക്ഷണിച്ചുകൊണ്ട് ഔദ്യോഗിക ഗസറ്റ് വിജ്ഞാപനം പുറപ്പെടുവിക്കുകയും വേണം.

വേമ്പനാട്ട് കായൽ ഉൾപ്പെടെയുള്ള റാംസർ സൈറ്റുകൾക്ക് പോലും ഇത്തരം ലഘുരേഖകൾ തയ്യാറാക്കുകയോ വിജ്ഞാപനം ചെയ്യുകയോ ചെയ്തിട്ടില്ലെന്ന് കേന്ദ്ര പരിസ്ഥിതി-കാലാവസ്ഥാ വ്യതിയാന മന്ത്രാലയം 2023 സെപ്റ്റംബർ 25-ന് പുറപ്പെടുവിച്ച മെമ്മോറാണ്ടം ചൂണ്ടിക്കാട്ടി കോടതി വ്യക്തമാക്കി. ഗോവ ഫൗണ്ടേഷൻ വേഴ്സസ് യൂണിയൻ ഓഫ് ഇന്ത്യ ((2014) 6 SCC 590), ഗൾഫ് ഗോവൻസ് ഹോട്ടൽസ് വേഴ്സസ് യൂണിയൻ ഓഫ് ഇന്ത്യ ((2014) 10 SCC 673) എന്നീ സുപ്രീം കോടതി വിധികളെ ആധാരമാക്കി, നിയമപരമായ നടപടിക്രമങ്ങൾ കൃത്യമായി പാലിക്കപ്പെടണമെന്ന് ബെഞ്ച് ഓർമ്മിപ്പിച്ചു. ഭൂമിയുടെ മേലുള്ള നിയന്ത്രണങ്ങൾ ഒരു പൗരന്റെ സ്വത്തവകാശത്തെ ബാധിക്കുന്നതിനാൽ, പൊതുജനങ്ങളുടെ ആക്ഷേപങ്ങൾ കേൾക്കാതെയുള്ള അത്തരം നിയന്ത്രണങ്ങൾ നിയമപരമായി നിലനിൽക്കില്ല.

2. ഉയർന്ന വെള്ളപ്പൊക്ക നിരപ്പ് (HFL) നിർണ്ണയിച്ചിട്ടില്ല കഴിഞ്ഞ പത്ത് വർഷത്തെ "ശരാശരി ഉയർന്ന വെള്ളപ്പൊക്ക നിരപ്പിൽ" (HFL) നിന്നാണ് 50 മീറ്റർ ദൂരം കണക്കാക്കേണ്ടത്. എന്നാൽ പഞ്ചായത്തോ സംസ്ഥാന തണ്ണീർത്തട അതോറിറ്റിയോ ഇത്തരമൊരു നിരപ്പ് ശാസ്ത്രീയമായി നിർണ്ണയിക്കുകയോ രേഖപ്പെടുത്തുകയോ ചെയ്തിട്ടില്ല. പകരം, തന്നിഷ്ടപ്രകാരം കായൽ അതിർത്തിയിൽ നിന്നോ ചില ജിയോ-കോർഡിനേറ്റുകളിൽ നിന്നോ ദൂരം അളക്കുകയാണ് ചെയ്തത്. കൃത്യമായ ഒരു അടിത്തറ നിശ്ചയിക്കാതെ 50 മീറ്റർ നിയന്ത്രണം നടപ്പിലാക്കുന്നത് നിയമവിരുദ്ധമാണ്.

3. സി.ആർ.സെഡ് വിജ്ഞാപനത്തിന് മുൻകാല പ്രാബല്യമില്ല കേരള തീരദേശ പരിപാലന അതോറിറ്റിയുടെ (KCZMA) 2014 ജനുവരി 16-ലെ കത്ത് പരിശോധിച്ച്, 2011 ജനുവരി 6-നാണ് പുതിയ സി.ആർ.സെഡ് വിജ്ഞാപനം നിലവിൽ വന്നതെന്ന് കോടതി നിരീക്ഷിച്ചു. അതിനാൽ, അതിനുമുമ്പ് (2010 ഡിസംബർ 28-ന്) നിയമപരമായി അനുവദിച്ച കെട്ടിട നിർമ്മാണ പെർമിറ്റുകൾക്ക് 2011-ലെ വിജ്ഞാപനം ബാധകമല്ല.

4. റവന്യൂ രേഖകളിലെ പ്രാമുഖ്യം (പുരയിടം) ഭൂമി 'പുരയിടം' ആണെന്ന് വ്യക്തമാക്കുന്ന കരമടച്ച രസീതുകളും കൈവശാവകാശ സർട്ടിഫിക്കറ്റുകളും ഹർജിക്കാരി ഹാജരാക്കിയിരുന്നു. പ്രസ്തുത ഭൂമി തണ്ണീർത്തടമായോ അതീവ ദുർബല തീരദേശ മേഖലയായോ (CVCA) പ്രഖ്യാപിച്ചിട്ടുണ്ടെങ്കിൽ അത് റവന്യൂ രേഖകളിൽ രേഖപ്പെടുത്തേണ്ടതായിരുന്നു. റവന്യൂ രേഖകളിൽ മാറ്റമില്ലാത്ത സാഹചര്യത്തിൽ, കരഭൂമിയെ തണ്ണീർത്തടമായി വ്യാഖ്യാനിക്കാൻ പഞ്ചായത്തിന് അധികാരമില്ല.

പൗരന്റെ അവകാശങ്ങൾ തടയുന്നതിന് മുമ്പ് അധികാരികൾ നിബന്ധനകൾ കർശനമായി പാലിക്കണം

സിംഗിൾ ബെഞ്ചിന്റെ ഉത്തരവുകൾ റദ്ദാക്കിക്കൊണ്ട് അപ്പീൽ അനുവദിച്ച ഡിവിഷൻ ബെഞ്ച്, നിയമാനുസൃതമായ ഫീസ് ഈടാക്കി രണ്ടു മാസത്തിനകം കെട്ടിട നിർമ്മാണ പെർമിറ്റ് പുതുക്കി നൽകാൻ കുമരകം ഗ്രാമപഞ്ചായത്തിന് നിർദ്ദേശം നൽകി.

ബീന മാത്യു വേഴ്സസ് സ്റ്റേറ്റ് ഓഫ് കേരള എന്ന ഈ വിധി സുപ്രധാനമായ ഒരു സന്ദേശമാണ് നൽകുന്നത്: ഔദ്യോഗിക സർക്കുലറുകളോ സ്വന്തം വ്യാഖ്യാനങ്ങളോ ഉപയോഗിച്ച് ഭരണകൂടങ്ങൾക്ക് പരിസ്ഥിതി നിയമങ്ങൾ ഏകപക്ഷീയമായി അടിച്ചേൽപ്പിക്കാനാകില്ല. ശാസ്ത്രീയ സർവേ, ഡോക്യുമെന്റേഷൻ, പൊതുജന പങ്കാളിത്തം എന്നിവ നിയമം നിഷ്കർഷിക്കുന്നുണ്ടെങ്കിൽ, ഒരു പൗരന്റെ ഭരണഘടനാപരമായ സ്വത്തുപയോഗ അവകാശങ്ങളെ ഹനിക്കുന്നതിന് മുമ്പ് അധികാരികൾ ആ നടപടിക്രമങ്ങൾ പൂർണ്ണമായും പാലിച്ചിരിക്കണം.

​The tension between environmental conservation and private property rights protected under Article 300A of the Constitution has produced significant administrative friction in India’s ecologically sensitive coastal belts. A frequent point of conflict arises when local self-governing bodies unilaterally reject or stall building permits by invoking overarching statutory regimes without adhering to the procedural preconditions codified within those very statutes.

​In a pivotal ruling delivered on May 28, 2025, a Division Bench of the Kerala High Court comprising Justice Amit Rawal and Justice Muralee Krishna S. in Bina Mathew v. State of Kerala (W.A. No. 1944 of 2023) held that local authorities cannot mechanically apply prohibitions under the Wetlands (Conservation and Management) Rules, 2010 to deny or refuse extensions of building permits without first executing the mandatory statutory exercise of identification, classification, and notification.

​Background of case
​The appellant owned contiguous parcels of land aggregating to 27.44 Ares in Kumarakom Village, Kottayam District. On December 22, 2010, she applied to the Kumarakom Grama Panchayat for a residential building permit on 5.73 cents under Survey No. 328/34. The Panchayat sanctioned the permit under the Kerala Municipality Building Rules (KMBR), 1999 on December 28, 2010, initially valid until December 27, 2013. The permit was subsequently extended up to December 27, 2016.
​When the appellant sought a further statutory renewal in December 2016 pursuant to Rule 15A of KMBR, 1999, the Panchayat declined to renew the permit. Over protracted rounds of writ litigation, the Panchayat shifted its stance—citing first a 2005 tourism notification, then setback limits under the Coastal Regulation Zone (CRZ) Notification, 2011, and ultimately relying on Rule 4(1)(vi) of the Wetlands (Conservation and Management) Rules, 2010. Rule 4(1)(vi) restricts permanent constructions (except boat jetties) within 50 meters of the Mean High Flood Level (HFL). Relying on technical reports showing that the proposed structure was only 3.30 meters (or 17.35 meters by later geocoordinates) from the lake boundary, the learned Single Bench dismissed the writ petition and subsequent review petition, holding that the construction violated the Wetland Rules, 2010.

​Legal Issues in Appeal
​The Division Bench addressed the following legal questions:
1. ​Can local authorities mechanically invoke the prohibitions of Rule 4(1)(vi) of the Wetland Rules, 2010 without complying with the identification and notification mandates under Rule 6(3)?
2. ​Can a 50-meter restriction from the "Mean High Flood Level" be imposed in the absence of an established, demarcated HFL baseline?
3. ​Does the CRZ Notification, 2011 apply retrospectively to building permits sanctioned prior to its commencement on January 6, 2011?
4. ​Can land classified as purayidam (garden land) in revenue records be treated as regulated wetland without formal reclassification following due process?

​The Jurisprudential Ratio

1. Identification and Notification Under Rule 6(3) are Sine Qua Non

The High Court underscored that environmental prohibitions cannot be enforced in the abstract. Under Rule 6(2) and 6(3) of the Wetland Rules, 2010 (as well as the framework under the 2017 Rules), the State Government must prepare a "Brief Document" for each wetland, delineating its geographic boundaries, zone of influence with accurate scale maps, size, and pre-existing rights and privileges. This must be followed by public notification inviting objections from affected parties under Rule 6(6).

​The Court cited an Office Memorandum dated September 25, 2023, from the Ministry of Environment, Forests & Climate Change (MoEFCC), which revealed that the exercise of compiling brief documents and notifying wetlands—including designated Ramsar sites like Vembanad Lake—had not been executed. Drawing from the Supreme Court’s landmark precedents in Goa Foundation v. Union of India ((2014) 6 SCC 590) and Gulf Goans Hotels Co. Ltd. v. Union of India ((2014) 10 SCC 673), the Bench reiterated that procedural checks are indispensable safeguards. Because restrictions on land use impinge directly on citizens' rights to hold and enjoy property under Article 300A, the statutory procedure of notifying the intent and inviting public objections is mandatory before any ban on development can be enforced.

2. The Absence of Demarcated High Flood Level (HFL)

Rule 4(1)(vi) of the 2010 Rules mandates a setback calculated from the "mean high flood level observed in the past ten years". The Court found that neither the Panchayat nor the State Wetland Authority Kerala (SWAK) had ever determined or demarcated this baseline on the ground. Instead, the authorities mechanically calculated setback distances from arbitrary lake boundaries or ad-hoc geocoordinates. In the absence of a verified HFL landmark established through due process, imposing a 50-meter ban was legally unsustainable.

3. Prospective Operation of CRZ Notification, 2011

The Bench clarified the timeline governing coastal regulations. Relying on internal clarifications issued by the Kerala Coastal Zone Management Authority (KCZMA) itself (letter dated January 16, 2014), the Court noted that the CRZ Notification, 2011 came into force on January 6, 2011. Consequently, its provisions do not apply retrospectively to valid building permits legally sanctioned prior to that date—such as the appellant’s initial permit granted on December 28, 2010.

4. Primacy of Revenue Records (Purayidam)

The appellant placed on record certified revenue receipts and possession certificates demonstrating that the property was consistently registered as purayidam (garden land). The High Court observed that had any lawful exercise declaring the area as wetland or as a Critically Vulnerable Coastal Area (CVCA) been executed, such classification would necessarily have been entered in the revenue records. In the absence of any revenue entry altering its character, the Panchayat had no authority to treat dry garden land as a regulated wetland

Authority must strictly satisfy the conditions before curtailing citizens rights

​The Division Bench set aside the Single Judge’s orders, allowed the appeal, and directed the Kumarakom Grama Panchayat to issue the building permit within two months upon payment of statutory fees.
Bina Mathew v. State of Kerala establishes a critical administrative precedent: ecological preservation and statutory conservation schemes cannot be enforced via informal administrative circulars or speculative interpretations. Where a statute prescribes a specific method—comprising scientific survey, documentation, and stakeholder participation—authorities must strictly satisfy those conditions precedent before curtailing a citizen's constitutional right to develop private land.

ഭരണഘടനയുടെ അനുച്ഛേദം 300A പ്രകാരം സംരക്ഷിക്കപ്പെട്ടിട്ടുള്ള പൗരൻ്റെ സ്വത്തവകാശവും പരിസ്ഥിതി സംരക്ഷണവും തമ്മിലുള്ള തർക്കങ്ങൾ, രാജ്യത്തെ പരിസ്ഥിതിലോലമായ തീരദേശ മേഖലകളിൽ ഗുരുതരമായ ഭരണപരമായ പ്രതിസന്ധികൾ സൃഷ്ടിക്കാറുണ്ട്. നിയമം അനുശാസിക്കുന്ന മുൻകൂർ നടപടിക്രമങ്ങൾ പാലിക്കാതെ, കേവലം ചട്ടങ്ങൾ ചൂണ്ടിക്കാട്ടി തദ്ദേശ സ്വയംഭരണ സ്ഥാപനങ്ങൾ ഏകപക്ഷീയമായി കെട്ടിട നിർമ്മാണ പെർമിറ്റുകൾ നിരസിക്കുകയോ തടഞ്ഞുവെക്കുകയോ ചെയ്യുന്നതാണ് പലപ്പോഴും തർക്കങ്ങൾക്ക് വഴിവെക്കുന്നത്.

2025 മെയ് 28-ന് ബീന മാത്യു വേഴ്സസ് സ്റ്റേറ്റ് ഓഫ് കേരള (W.A. No. 1944 of 2023) എന്ന കേസിൽ ജസ്റ്റിസ് അമിത് റാവൽ, ജസ്റ്റിസ് മുരളീ കൃഷ്ണ എസ്. എന്നിവരടങ്ങിയ കേരള ഹൈക്കോടതി ഡിവിഷൻ ബെഞ്ച് സുപ്രധാനമായ ഒരു വിധി പ്രസ്താവിച്ചു: തണ്ണീർത്തടങ്ങൾ കണ്ടെത്തി തരംതിരിച്ച് വിജ്ഞാപനം ചെയ്യാനുള്ള നിയമപരമായ നടപടിക്രമങ്ങൾ പൂർത്തിയാക്കാതെ, 2010-ലെ തണ്ണീർത്തട (സംരക്ഷണവും പരിപാലനവും) ചട്ടങ്ങൾ യാന്ത്രികമായി പ്രയോഗിച്ച് കെട്ടിട നിർമ്മാണ പെർമിറ്റുകളോ അവയുടെ കാലാവധി നീട്ടുന്നതിനുള്ള അപേക്ഷകളോ നിരസിക്കാൻ തദ്ദേശ സ്ഥാപനങ്ങൾക്ക് അധികാരമില്ല.

കേസിൻ്റെ പശ്ചാത്തലം

കോട്ടയം ജില്ലയിലെ കുമരകം വില്ലേജിൽ 27.44 ആർസ് ഭൂമി ഹർജിക്കാരിയുടെ ഉടമസ്ഥതയിലുണ്ടായിരുന്നു. ഇതിൽ സർവേ നമ്പർ 328/34-ൽ ഉൾപ്പെട്ട 5.73 സെന്റ് സ്ഥലത്ത് വീട് നിർമ്മിക്കുന്നതിനായി 2010 ഡിസംബർ 22-ന് അവർ കുമരകം ഗ്രാമപഞ്ചായത്തിൽ അപേക്ഷ സമർപ്പിച്ചു. 1999-ലെ കേരള മുനിസിപ്പാലിറ്റി കെട്ടിട നിർമ്മാണ ചട്ടങ്ങൾ (KMBR) പ്രകാരം 2010 ഡിസംബർ 28-ന് പഞ്ചായത്ത് 2013 ഡിസംബർ 27 വരെ സാധുതയുള്ള പെർമിറ്റ് അനുവദിച്ചു. തുടർന്ന് ഇതിൻ്റെ കാലാവധി 2016 ഡിസംബർ 27 വരെ നീട്ടി നൽകുകയും ചെയ്തു.

1999-ലെ KMBR ചട്ടം 15A പ്രകാരം 2016 ഡിസംബറിൽ വീണ്ടും കാലാവധി നീട്ടാൻ അപേക്ഷിച്ചപ്പോൾ പഞ്ചായത്ത് അത് നിരസിച്ചു. തുടർന്നുണ്ടായ നിയമപോരാട്ടങ്ങളിൽ പഞ്ചായത്ത് നിലപാടുകൾ മാറ്റിക്കൊണ്ടിരുന്നു—ആദ്യം 2005-ലെ ടൂറിസം സോൺ വിജ്ഞാപനവും, പിന്നീട് 2011-ലെ സി.ആർ.സെഡ് (CRZ) വിജ്ഞാപനവും, ഒടുവിൽ 2010-ലെ തണ്ണീർത്തട ചട്ടങ്ങളിലെ ചട്ടം 4(1)(vi)-ഉം നിരസിക്കലിന് കാരണമായി നിരത്തി. ചട്ടം 4(1)(vi) പ്രകാരം 'ശരാശരി ഉയർന്ന വെള്ളപ്പൊക്ക നിരപ്പിൽ' (Mean High Flood Level - HFL) നിന്ന് 50 മീറ്ററിനുള്ളിൽ ബോട്ട് ജെട്ടികൾ ഒഴികെയുള്ള സ്ഥിരം നിർമ്മാണങ്ങൾ നിരോധിച്ചിട്ടുണ്ട്. നിർദ്ദിഷ്ട നിർമ്മാണം കായൽ അതിർത്തിയിൽ നിന്ന് 3.30 മീറ്റർ മാത്രം അകലെയാണെന്ന (പിന്നീട് രേഖപ്പെടുത്തിയ ജിയോ-കോർഡിനേറ്റുകൾ പ്രകാരം 17.35 മീറ്റർ) സാങ്കേതിക റിപ്പോർട്ടിന്റെ അടിസ്ഥാനത്തിൽ, സിംഗിൾ ബെഞ്ച് റിട്ട് ഹർജിയും പുനഃപരിശോധനാ ഹർജിയും തള്ളി. ഇതിനെതിരെയാണ് ഡിവിഷൻ ബെഞ്ചിൽ അപ്പീൽ സമർപ്പിച്ചത്.

അപ്പീലിലെ പ്രധാന നിയമപ്രശ്നങ്ങൾ

ഡിവിഷൻ ബെഞ്ച് പ്രധാനമായും പരിഗണിച്ച ചോദ്യങ്ങൾ ഇവയാണ്:

  1. ചട്ടം 6(3) പ്രകാരമുള്ള തണ്ണീർത്തട നിർണ്ണയവും വിജ്ഞാപന നടപടികളും പൂർത്തിയാക്കാതെ, തദ്ദേശ സ്ഥാപനങ്ങൾക്ക് തണ്ണീർത്തട ചട്ടങ്ങളിലെ 4(1)(vi) പ്രകാരമുള്ള നിയന്ത്രണങ്ങൾ യാന്ത്രികമായി പ്രയോഗിക്കാനാകുമോ?
  2. ഉയർന്ന വെള്ളപ്പൊക്ക നിരപ്പ് (HFL) കൃത്യമായി നിർണ്ണയിച്ച് അടയാളപ്പെടുത്താതെ 50 മീറ്റർ ദൂരപരിധി നിയന്ത്രണം ഏർപ്പെടുത്താൻ സാധിക്കുമോ?
  3. 2011 ജനുവരി 6-ന് നിലവിൽ വന്ന സി.ആർ.സെഡ് വിജ്ഞാപനം, അതിനുമുമ്പ് അനുവദിച്ച പെർമിറ്റുകൾക്ക് മുൻകാല പ്രാബല്യത്തോടെ ബാധകമാകുമോ?
  4. റവന്യൂ രേഖകളിൽ 'പുരയിടം' എന്ന് രേഖപ്പെടുത്തിയിട്ടുള്ള ഭൂമിയെ, കൃത്യമായ നിയമനടപടികളിലൂടെ തരംമാറ്റാതെ തണ്ണീർത്തടമായി കണക്കാക്കാൻ കഴിയുമോ?

കോടതിയുടെ സുപ്രധാന കണ്ടെത്തലുകൾ

1. ചട്ടം 6(3) പ്രകാരമുള്ള തിരിച്ചറിയലും വിജ്ഞാപനവും അത്യന്താപേക്ഷിതമാണ് (Sine Qua Non) യാതൊരു അടിസ്ഥാനവുമില്ലാതെ പരിസ്ഥിതി നിയന്ത്രണങ്ങൾ അടിച്ചേൽപ്പിക്കാൻ കഴിയില്ലെന്ന് ഹൈക്കോടതി വ്യക്തമാക്കി. 2010-ലെ തണ്ണീർത്തട ചട്ടങ്ങളിലെ ചട്ടം 6(2), 6(3) പ്രകാരം, ഓരോ തണ്ണീർത്തടത്തിന്റെയും കൃത്യമായ അതിർത്തികൾ, സ്വാധീന മേഖലകൾ വ്യക്തമാക്കുന്ന സ്കെയിൽ മാപ്പുകൾ, വിസ്തൃതി, നിലവിലുള്ള അവകാശങ്ങൾ എന്നിവ ഉൾപ്പെടുത്തി സംസ്ഥാന സർക്കാർ 'ലഘുരേഖ' (Brief Document) തയ്യാറാക്കേണ്ടതുണ്ട്. തുടർന്ന് ചട്ടം 6(6) പ്രകാരം പൊതുജനങ്ങളിൽ നിന്ന് ആക്ഷേപങ്ങൾ ക്ഷണിച്ചുകൊണ്ട് ഔദ്യോഗിക ഗസറ്റ് വിജ്ഞാപനം പുറപ്പെടുവിക്കുകയും വേണം.

വേമ്പനാട്ട് കായൽ ഉൾപ്പെടെയുള്ള റാംസർ സൈറ്റുകൾക്ക് പോലും ഇത്തരം ലഘുരേഖകൾ തയ്യാറാക്കുകയോ വിജ്ഞാപനം ചെയ്യുകയോ ചെയ്തിട്ടില്ലെന്ന് കേന്ദ്ര പരിസ്ഥിതി-കാലാവസ്ഥാ വ്യതിയാന മന്ത്രാലയം 2023 സെപ്റ്റംബർ 25-ന് പുറപ്പെടുവിച്ച മെമ്മോറാണ്ടം ചൂണ്ടിക്കാട്ടി കോടതി വ്യക്തമാക്കി. ഗോവ ഫൗണ്ടേഷൻ വേഴ്സസ് യൂണിയൻ ഓഫ് ഇന്ത്യ ((2014) 6 SCC 590), ഗൾഫ് ഗോവൻസ് ഹോട്ടൽസ് വേഴ്സസ് യൂണിയൻ ഓഫ് ഇന്ത്യ ((2014) 10 SCC 673) എന്നീ സുപ്രീം കോടതി വിധികളെ ആധാരമാക്കി, നിയമപരമായ നടപടിക്രമങ്ങൾ കൃത്യമായി പാലിക്കപ്പെടണമെന്ന് ബെഞ്ച് ഓർമ്മിപ്പിച്ചു. ഭൂമിയുടെ മേലുള്ള നിയന്ത്രണങ്ങൾ ഒരു പൗരന്റെ സ്വത്തവകാശത്തെ ബാധിക്കുന്നതിനാൽ, പൊതുജനങ്ങളുടെ ആക്ഷേപങ്ങൾ കേൾക്കാതെയുള്ള അത്തരം നിയന്ത്രണങ്ങൾ നിയമപരമായി നിലനിൽക്കില്ല.

2. ഉയർന്ന വെള്ളപ്പൊക്ക നിരപ്പ് (HFL) നിർണ്ണയിച്ചിട്ടില്ല കഴിഞ്ഞ പത്ത് വർഷത്തെ "ശരാശരി ഉയർന്ന വെള്ളപ്പൊക്ക നിരപ്പിൽ" (HFL) നിന്നാണ് 50 മീറ്റർ ദൂരം കണക്കാക്കേണ്ടത്. എന്നാൽ പഞ്ചായത്തോ സംസ്ഥാന തണ്ണീർത്തട അതോറിറ്റിയോ ഇത്തരമൊരു നിരപ്പ് ശാസ്ത്രീയമായി നിർണ്ണയിക്കുകയോ രേഖപ്പെടുത്തുകയോ ചെയ്തിട്ടില്ല. പകരം, തന്നിഷ്ടപ്രകാരം കായൽ അതിർത്തിയിൽ നിന്നോ ചില ജിയോ-കോർഡിനേറ്റുകളിൽ നിന്നോ ദൂരം അളക്കുകയാണ് ചെയ്തത്. കൃത്യമായ ഒരു അടിത്തറ നിശ്ചയിക്കാതെ 50 മീറ്റർ നിയന്ത്രണം നടപ്പിലാക്കുന്നത് നിയമവിരുദ്ധമാണ്.

3. സി.ആർ.സെഡ് വിജ്ഞാപനത്തിന് മുൻകാല പ്രാബല്യമില്ല കേരള തീരദേശ പരിപാലന അതോറിറ്റിയുടെ (KCZMA) 2014 ജനുവരി 16-ലെ കത്ത് പരിശോധിച്ച്, 2011 ജനുവരി 6-നാണ് പുതിയ സി.ആർ.സെഡ് വിജ്ഞാപനം നിലവിൽ വന്നതെന്ന് കോടതി നിരീക്ഷിച്ചു. അതിനാൽ, അതിനുമുമ്പ് (2010 ഡിസംബർ 28-ന്) നിയമപരമായി അനുവദിച്ച കെട്ടിട നിർമ്മാണ പെർമിറ്റുകൾക്ക് 2011-ലെ വിജ്ഞാപനം ബാധകമല്ല.

4. റവന്യൂ രേഖകളിലെ പ്രാമുഖ്യം (പുരയിടം) ഭൂമി 'പുരയിടം' ആണെന്ന് വ്യക്തമാക്കുന്ന കരമടച്ച രസീതുകളും കൈവശാവകാശ സർട്ടിഫിക്കറ്റുകളും ഹർജിക്കാരി ഹാജരാക്കിയിരുന്നു. പ്രസ്തുത ഭൂമി തണ്ണീർത്തടമായോ അതീവ ദുർബല തീരദേശ മേഖലയായോ (CVCA) പ്രഖ്യാപിച്ചിട്ടുണ്ടെങ്കിൽ അത് റവന്യൂ രേഖകളിൽ രേഖപ്പെടുത്തേണ്ടതായിരുന്നു. റവന്യൂ രേഖകളിൽ മാറ്റമില്ലാത്ത സാഹചര്യത്തിൽ, കരഭൂമിയെ തണ്ണീർത്തടമായി വ്യാഖ്യാനിക്കാൻ പഞ്ചായത്തിന് അധികാരമില്ല.

പൗരന്റെ അവകാശങ്ങൾ തടയുന്നതിന് മുമ്പ് അധികാരികൾ നിബന്ധനകൾ കർശനമായി പാലിക്കണം

സിംഗിൾ ബെഞ്ചിന്റെ ഉത്തരവുകൾ റദ്ദാക്കിക്കൊണ്ട് അപ്പീൽ അനുവദിച്ച ഡിവിഷൻ ബെഞ്ച്, നിയമാനുസൃതമായ ഫീസ് ഈടാക്കി രണ്ടു മാസത്തിനകം കെട്ടിട നിർമ്മാണ പെർമിറ്റ് പുതുക്കി നൽകാൻ കുമരകം ഗ്രാമപഞ്ചായത്തിന് നിർദ്ദേശം നൽകി.

ബീന മാത്യു വേഴ്സസ് സ്റ്റേറ്റ് ഓഫ് കേരള എന്ന ഈ വിധി സുപ്രധാനമായ ഒരു സന്ദേശമാണ് നൽകുന്നത്: ഔദ്യോഗിക സർക്കുലറുകളോ സ്വന്തം വ്യാഖ്യാനങ്ങളോ ഉപയോഗിച്ച് ഭരണകൂടങ്ങൾക്ക് പരിസ്ഥിതി നിയമങ്ങൾ ഏകപക്ഷീയമായി അടിച്ചേൽപ്പിക്കാനാകില്ല. ശാസ്ത്രീയ സർവേ, ഡോക്യുമെന്റേഷൻ, പൊതുജന പങ്കാളിത്തം എന്നിവ നിയമം നിഷ്കർഷിക്കുന്നുണ്ടെങ്കിൽ, ഒരു പൗരന്റെ ഭരണഘടനാപരമായ സ്വത്തുപയോഗ അവകാശങ്ങളെ ഹനിക്കുന്നതിന് മുമ്പ് അധികാരികൾ ആ നടപടിക്രമങ്ങൾ പൂർണ്ണമായും പാലിച്ചിരിക്കണം.

ദേശീയപാതകളും റോഡ് സുരക്ഷയും: ഭൂമി വിനിയോഗമാറ്റം, കെട്ടിട നിർമ്മാണ നിയന്ത്രണങ്ങൾ ഉൾപ്പെടെയുള്ള സുപ്രീം കോടതി നിർദ്ദേശങ്ങൾ


ദേശീയപാതകളും റോഡ് സുരക്ഷയും: ഭൂമി വിനിയോഗമാറ്റം, കെട്ടിട നിർമ്മാണ നിയന്ത്രണങ്ങൾ ഉൾപ്പെടെയുള്ള സുപ്രീം കോടതി നിർദ്ദേശങ്ങൾ


ദേശീയപാതയോരങ്ങളിലെ കെട്ടിട നിർമ്മാണ നിയന്ത്രണങ്ങൾ ഉൾപ്പെടെയുള്ള കർശന സുരക്ഷാ നിർദ്ദേശങ്ങൾ സംബന്ധിച്ച് സുപ്രീം കോടതി 2026 ഏപ്രിൽ മാസം 13ന് പുറത്തിറക്കിയ ഉത്തരവ് സംബന്ധിച്ച നടപടികൾ പലയിടത്തും ആരംഭിച്ചു കഴിഞ്ഞു. (Suo Moto Writ Petition (Civil) No. 9 of 2025) കേസിൽ
രാജ്യത്ത് ദേശീയപാതകളിലുണ്ടാകുന്ന ഗുരുതരമായ അപകടങ്ങളും റോഡ് സുരക്ഷാ വീഴ്ചകളും ഗൗരവമായി കണ്ടാണ് സുപ്രീം കോടതി ഇങ്ങനെ ഒരു ഉത്തരവ് പുറപ്പെടുവിച്ചത്. 

രാജസ്ഥാനിലെ ഫലോഡിയിലും തെലങ്കാനയിലെ രംഗറെഡ്ഡിയിലുമായി ഉണ്ടായ ദാരുണമായ റോഡ് അപകടങ്ങളിൽ 34 പേരുടെ ജീവൻ നഷ്ടപ്പെട്ട സംഭവത്തെ തുടർന്നാണ് സുപ്രീം കോടതി സ്വമേധയാ (Suo Moto) ഈ കേസ് പരിഗണിച്ചത്. ഭരണഘടനയുടെ 21-ാം അനുച്ഛേദം ഉറപ്പുനൽകുന്ന 'ജീവിക്കാനുള്ള അവകാശത്തിന്റെ' (Right to Life) ഭാഗമാണ് യാത്രക്കാരുടെ സുരക്ഷ എന്ന് നിരീക്ഷിച്ചാണ് ഉത്തരവ്. ദേശീയപാത അതോറിറ്റിയുടെയും സത്യവാങ്മൂലം പരിഗണിച്ചും കോടതി നിയോഗിച്ച അമിക്ക ക്യൂറിയുടെയും കേന്ദ്രസർക്കാരിനെ പ്രതിനിധീകരിച്ച് സോളിസിറ്റർ ജനറലിൻ്റെയും നിർദ്ദേശങ്ങളും അഭിപ്രായങ്ങളും പരിഗണനയിലെടുത്തു കൂടിയാണ് കോടതി ഈ ഉത്തരവ് പുറത്തിറക്കിയിരിക്കുന്നത്.

ദേശീയപാതയോരങ്ങളിലെ അനധികൃത നിർമ്മാണങ്ങളും നിയന്ത്രണങ്ങളും

ദേശീയപാതകളുടെ ഇരുവശങ്ങളിലുമുള്ള സുരക്ഷാ മേഖലകളിലും റൈറ്റ് ഓഫ് വേ (Right of Way - ROW) പരിധികളിലും അനധികൃതമായി നിർമ്മിക്കുന്ന ധാബകൾ, ഭക്ഷണശാലകൾ, മറ്റ് വാണിജ്യ കെട്ടിടങ്ങൾ എന്നിവ സംബന്ധിച്ച്  കർശനമായ നിർദ്ദേശങ്ങളാണ് നൽകിയിട്ടുള്ളത്:

പുതിയ നിർമ്മാണങ്ങൾക്ക് പൂർണ്ണ നിരോധനം: ദേശീയപാതകളുടെ 'റൈറ്റ് ഓഫ് വേ' (ROW) പരിധിക്കുള്ളിൽ പുതിയ ധാബകളോ ഭക്ഷണശാലകളോ മറ്റ് വാണിജ്യ കെട്ടിടങ്ങളോ നിർമ്മിക്കുന്നതും പ്രവർത്തിപ്പിക്കുന്നതും അടിയന്തര പ്രാബല്യത്തോടെ നിരോധിച്ചിരിക്കുന്നു.

അനധികൃത നിർമ്മിതികളുടെ പൊളിച്ചുമാറ്റൽ: നിലവിലുള്ളതോ പുതിയതോ ആയ എല്ലാ അനധികൃത നിർമ്മാണങ്ങളും 60 ദിവസത്തിനകം പൊളിച്ചുനീക്കാൻ ജില്ലാ കളക്ടർമാർക്കും മജിസ്‌ട്രേറ്റുമാർക്കും കോടതി കർശന നിർദ്ദേശം നൽകിയിട്ടുണ്ട്.

ലൈസൻസുകളും എൻ.ഒ.സി (NOC) കളും: ഹൈവേ സുരക്ഷാ മേഖലകളിൽ വരുന്ന ഏതെങ്കിലും സൈറ്റുകൾക്ക് ലൈസൻസോ, എൻ.ഒ.സിയോ, വ്യാപാര അനുമതിയോ നൽകുന്നതിന് മുമ്പ് ദേശീയപാത അതോറിറ്റിയുടെയോ (NHAI/PWD) മുൻകൂർ അനുമതി നിർബന്ധമാക്കിയിരിക്കുന്നു. നിലവിലുള്ള ഇത്തരം ലൈസൻസുകൾ 30 ദിവസത്തിനകം പുനഃപരിശോധിക്കേണ്ടതാണ്.

ഭൂവിനിയോഗ മാറ്റത്തിനുള്ള കർശന നിയന്ത്രണം: ദേശീയപാതയുടെ മധ്യഭാഗത്തുനിന്ന് (Mid-point) പാർപ്പിട ആവശ്യങ്ങൾക്ക് 40 മീറ്ററും വാണിജ്യ ആവശ്യങ്ങൾക്ക് 75 മീറ്ററും ഉള്ളിൽ ഭൂമി വിനിയോഗമാറ്റം (Change of Land Use) നിരോധിച്ചുകൊണ്ട് എല്ലാ സംസ്ഥാനങ്ങളും 60 ദിവസത്തിനകം ഔദ്യോഗിക വിജ്ഞാപനം പുറപ്പെടുവിക്കണം. ഇന്ത്യൻ റോഡ് കോൺഗ്രസ് (IRC) മാനദണ്ഡങ്ങൾക്കനുസൃതമാണിത്.

റോഡ് സുരക്ഷ ഉറപ്പാക്കുന്നതിനായി സുപ്രീം കോടതി പുറപ്പെടുവിച്ച മറ്റ് സുപ്രധാന നിർദ്ദേശങ്ങൾ താഴെ പറയുന്നവയാണ്:

• ജില്ലാ ഹൈവേ സുരക്ഷാ ടാസ്ക് ഫോഴ്സ്: ദേശീയപാത കടന്നുപോകുന്ന എല്ലാ ജില്ലകളിലും 15 ദിവസത്തിനകം ജില്ലാ മജിസ്‌ട്രേറ്റിന്റെ നേതൃത്വത്തിൽ 'ഡിസ്ട്രിക്റ്റ് ഹൈവേ സേഫ്റ്റി ടാസ്ക് ഫോഴ്സ്' രൂപീകരിക്കണം. ജില്ലാ കളക്ടറും പോലീസ് മേധാവിയും ഇതിന്റെ പൂർണ്ണ ഉത്തരവാദിത്തം വഹിക്കണം.

Matrimony in India is historically grounded in cultural sanctity and deep spiritual reverence. As the biblical adage solemnly reminds us: "What God has joined together, let no one separate" (Matthew 19:6; Mark 10:9). Yet, human realities often diverge from ecclesiastical ideals. When two individuals enter into a marriage only to realize immediately that it was an irreparable mistake, should secular law force them to sit at the fence and endure agonizing paralysis for a compulsory calendar year?

In a landmark and jurisprudentially transformative decision—AAA v. Union of India [2022 (7) KHC 532]—the Division Bench of the Kerala High Court, comprising Justice A. Muhamed Mustaque and Justice Shoba Annamma Eapen, tackled this critical dilemma. The Court took the decisive step of striking down the mandatory one-year separation period prescribed under Section 10A of the Divorce Act, 1869, declaring it an unconstitutional infringement of fundamental rights under Articles 14 and 21 of the Constitution.

1. The Factual matrix 

The controversy arose out of a distressing, real-world marital situation. Two young Christians solemnized their marriage on January 30, 2022, in accordance with Christian ceremonies. Very shortly thereafter, they realized that their union was an irreconcilable mistake; the marriage had never been consummated.

Rather than dragging each other into a toxic adversarial dispute, the couple demonstrated mature wisdom: they mutually agreed to part ways peacefully. On May 31, 2022—barely four months after the wedding—they approached the Family Court, Ernakulam, filing a joint petition for dissolution of marriage by mutual consent under Section 10A of the Divorce Act, 1869, accompanied by an application under Section 151 of the Code of Civil Procedure.

The Family Court registry refused to number the petition, citing the bar against filing a mutual divorce petition within one year of marriage/separation under Section 10A. On the judicial side, the Family Court rejected their plea, holding that a one-year separation period is an indispensable statutory requirement.

Challenging this order, the couple approached the High Court through an Original Petition [O.P. (FC) No. 398 of 2022] and a Writ Petition [W.P. (C) No. 28317 of 2022] challenging the constitutional validity of the mandatory waiting period under Section 10A.

2. Legislative Evolution & The Unaddressed Vacuum

The Divorce Act was originally enacted in 1869 during British rule to govern matrimonial causes for Christians, modeled after the British Act of 1858. While Britain discarded that archaic legislation in 1923, India retained it for decades. Pursuant to the 164th Report of the Law Commission and deliberations with community leaders, Parliament introduced significant reforms via the Indian Divorce (Amendment) Act, 2001 (Act 51 of 2001).

Among the changes was the introduction of Section 10A to provide for divorce by mutual consent. However, while other secular and personal laws—such as Section 13B of the Hindu Marriage Act, 1955, and Section 28 of the Special Marriage Act, 1954—stipulated a one-year separation, Section 10A imposed an onerous two-year minimum period of living separately.

In 2010, the Division Bench of the Kerala High Court in Saumya Ann Thomas v. Union of India [2010 (1) KHC 811] stepped in, holding that compelling Christians to wait two years while other citizens had to wait one year violated Article 14 (Equality) and Article 21 (Right to Life). Consequently, Saumya Ann Thomas read down the two-year period in Section 10A to one year.

The Legislative Lacuna Left Unresolved

While Saumya Ann Thomas harmonized the time frame to one year, it left a deeper structural defect intact:
 
Under Section 14 of the Hindu Marriage Act and Section 29 of the Special Marriage Act, the Legislature provided an express "safety valve": Courts possess discretionary power to relax the one-year bar in instances of exceptional hardship or exceptional depravity.
 
In contrast, the Divorce Act, 1869 contained no statutory waiver or relaxation clause whatsoever. Christian couples undergoing unbearable agony were denied access to a judicial remedy before the lapse of a full calendar year.

3. The Statutory Paradox: Rewarding Acrimony, Penalizing Dignity

Speaking for the Division Bench, Justice A. Muhamed Mustaque laid bare the glaring contradiction embedded in the statute:
S.10 of the Divorce Act permits divorce on fault grounds. It is possible for a spouse to file a petition for divorce without any waiting period. The Court may be able to grant a divorce even before the period of one year, on being satisfied with the ground for divorce. One of the grounds to obtain a divorce is willful non-consummation of marriage. On recognizing the existence of this ground on the basis of fault, one may be able to obtain a divorce from the Court by not contesting the same. However, if they have shown wisdom, to avoid stigma, the Court cannot permit to move the petition without the lapse of a period of one year after separation. This exactly is the dilemma and hardship for the parties in these cases."

The irony is profound: If an estranged spouse chose to sling mud, invent acrimonious fault grounds, or publicly air humiliating allegations like non-consummation under Section 10, the doors of the Family Court were immediately open. But if both spouses chose to act with grace, mutual dignity, and silence under Section 10A, the law locked the courthouse doors and ordered them to suffer compulsory matrimonial paralysis for a year.

4. Jurisprudential Cornerstones of the Ruling

The High Court’s decision to strike down the provision was anchored in constitutional jurisprudence and legal philosophy:
 
Paternalism vs. Autonomy: The Court referenced John Stuart Mill’s classical treatise 'On Liberty' regarding the State's authority to curb individual actions to protect society and familial relationships. However, drawing upon Ronald Dworkin’s doctrine in 'Taking Rights Seriously', the Bench held that individual rights are "political trumps". When liberty is taken away to act according to one's will without any procedural safety net to relieve exceptional fallout, statutory paternalism degenerates into state oppression.

Right to an Efficacious Judicial Remedy (Article 21): The Bench established that the Right to Life encompasses access to a judicial remedy. Referencing Article 8 of the Universal Declaration of Human Rights (UDHR), the Court affirmed that statutory bars that extinguish a citizen's right to seek timely relief against hardship are arbitrary and unconstitutional.
Accordingly, the High Court held:
 "We hold that the fixation of the minimum period of separation of one year as stipulated under S.10A is violative of the fundamental right and accordingly, strike it down."

5. A Clarion Call for a Uniform Marriage Code

Before parting with the case, the Division Bench made a notable observation regarding matrimonial law reform under Article 44:

Reorienting Family Justice: The Bench observed that modern Family Courts have become adversarial battlegrounds because substantive matrimonial laws were designed to adjudicate disputes on fault grounds rather than promote the common welfare of the parties.
 
Secular Parity: In a secular nation, state concern must focus on the common welfare of its citizens rather than differentiations based on religious affiliations. The Union Government was urged to seriously consider enacting a Uniform Marriage Code where the law aids parties in resolving differences, focuses on the welfare of the individuals, and eliminates the need to fight on preordained fault grounds.

6. Key Takeaways for Litigants & Practitioners

Removal of Mandatory Waiting Bar: Christian couples in Kerala undergoing genuine, irremediable hardship are no longer barred by an inflexible statutory one-year separation period before filing a joint petition under Section 10A.
 
Elimination of Pretextual Litigation: Litigants are no longer driven to fabricate fault-based allegations under Section 10 simply to gain immediate entry into the Family Court.

Discretion in Dispensing Redundant Appearances: Where parties have clearly and consistently demonstrated an irreversible breakdown (as verified through interactions), Courts need not prolong their agony with redundant appearances.

The judgment in AAA v. Union of India is a landmark milestone in Indian matrimonial jurisprudence. Matrimonial law cannot exist merely to protect an empty legal shell at the cost of human dignity and mental well-being. By striking down the mandatory one-year separation rule under Section 10A, the Kerala High Court reaffirmed that while entering into marriage is a matter of personal choice, the right to exit an unworkable union with dignity and without state-enforced suffering is an inalienable fundamental right.

• HTL (വേലിയേറ്റ രേഖ) നിർണ്ണയം: 26.11.2021-ലെ S.O. 4886(E) ഭേദഗതി പ്രകാരം, 1991 ഫെബ്രുവരി 19-ന് മുൻപ് നിർമ്മിച്ച ബണ്ടുകളോ സ്ലൂയിസ് ഗേറ്റുകളോ ഉള്ളിടത്ത് HTL അവയുടെ അതിർത്തിയായി നിജപ്പെടുത്തും. എന്നാൽ ഉപ്പുവെള്ളം കയറി ബണ്ടിന് അപ്പുറം കണ്ടൽക്കാടുകൾ രൂപപ്പെട്ടിട്ടുണ്ടെങ്കിൽ, ആ പ്രദേശം CRZ-IA ആയി സംരക്ഷിക്കപ്പെടേണ്ടതും മറ്റ് പ്രവർത്തനങ്ങൾക്ക് ഉപയോഗിക്കാൻ പാടില്ലാത്തതുമാണ്.

പോസ്റ്റ്-ഫാക്റ്റോ പരിസ്ഥിതി അനുമതികളിലെ നിയമപരമായ മാറ്റങ്ങൾ

വനശക്തി വേഴ്സസ് യൂണിയൻ ഓഫ് ഇന്ത്യ കേസിൽ (29.07.2026) മൂന്നംഗ സുപ്രീം കോടതി ബെഞ്ച് നടത്തിയ വിധിന്യായത്തിൽ CRZ, EIA ചട്ടങ്ങൾ പ്രകാരമുള്ള പോസ്റ്റ്-ഫാക്റ്റോ അനുമതികളെക്കുറിച്ച് സുപ്രധാന നിരീക്ഷണങ്ങൾ നടത്തിയിട്ടുണ്ട്.
• 2006-ലെ വിജ്ഞാപനത്തിൽ ഭേദഗതി വരുത്താതെ മുൻകൂർ അനുമതിയില്ലാതെ തുടങ്ങിയ പദ്ധതികൾക്ക് നേരിട്ട് പോസ്റ്റ്-ഫാക്റ്റോ അനുമതി നൽകാനാവില്ലെന്ന് സുപ്രീം കോടതി വ്യക്തമാക്കി.
• കോമൺ കോസ് (2017), അലെംബിക് ഫാർമസ്യൂട്ടിക്കൽസ് (2020) എന്നീ മുൻവിധികളിലെ നിരീക്ഷണങ്ങൾ അതത് നിയമസാഹചര്യങ്ങളിൽ പരിഗണിക്കേണ്ടതാണെന്നും, പൊതുതാൽപ്പര്യം മുൻനിർത്തി നിയമാനുസൃതമായ ഭേദഗതികളിലൂടെ ആശ്വാസ പദ്ധതികൾ കൊണ്ടുവരുന്നതിൽ കേന്ദ്ര സർക്കാരിന് തടസ്സമില്ലെന്നും കോടതി ചൂണ്ടിക്കാട്ടി.
• 2017-ലെ ഭേദഗതി വിജ്ഞാപനം കൃത്യമായ നിയമപരിരക്ഷയുള്ളതാണെന്ന് കോടതി ശരിവെച്ചെങ്കിലും, 2021-ലെ ഓഫീസ് മെമ്മോറാണ്ടം (OM) ഭരണഘടനാ വിരുദ്ധമാണെന്ന് കണ്ട് റദ്ദാക്കി. വിജ്ഞാപനങ്ങളിൽ ഔദ്യോഗിക ഭേദഗതി വരുത്താതെ വെറും ഭരണപരമായ ഉത്തരവുകളിലൂടെ പോസ്റ്റ്-ഫാക്റ്റോ അനുമതികൾ നൽകരുതെന്ന് സർക്കാരിന് നിർദ്ദേശം നൽകി. എന്നാൽ പൂർണ്ണ നീതി ഉറപ്പാക്കാൻ അനുയോജ്യമായ കേസുകളിൽ ഭരണഘടനയുടെ 142-ാം അനുച്ഛേദം പ്രയോഗിക്കാൻ സുപ്രീം കോടതിക്ക് അധികാരമുണ്ടെന്നും വ്യക്തമാക്കി.
ഇതിനുപുറമെ, ഗ്രീൻ ഹോപ്പർ ഹോട്ടൽസ് ആന്റ് റിസോർട്സ് വേഴ്സസ് യൂണിയൻ ഓഫ് ഇന്ത്യ (2024 KHC 1141) കേസിൽ കേരള ഹൈക്കോടതി, 2023-ലെ കാഡസ്ട്രൽ മാപ്പിന് കേന്ദ്ര സർക്കാരിന്റെ അംഗീകാരം ലഭിച്ചതിനുശേഷം മാത്രമേ 2019-ലെ വിജ്ഞാപനത്തിന്റെ പൂർണ്ണ പ്രയോജനം നിർമ്മാണാനുമതികൾക്ക് ബാധകമാകൂ എന്ന് വിധിച്ചിരുന്നു.

വൻകിട പദ്ധതികളും സാധാരണക്കാരുടെ വീടുകളും

ക്രഡായ് വേഴ്സസ് വനശക്തി (2025 KHC OnLine 6946) കേസിൽ, CRZ വിഷയങ്ങളിൽ പോസ്റ്റ്-ഫാക്റ്റോ അനുമതികൾ പൂർണ്ണമായി നിഷേധിക്കുന്നത് ശരിയല്ലെന്ന് സുപ്രീം കോടതി നിരീക്ഷിച്ചിരുന്നു. 1986-ലെ പരിസ്ഥിതി സംരക്ഷണ നിയമം ഇത് വ്യക്തമായി വിലക്കുന്നില്ല. പാരിസ്ഥിതിക മാനദണ്ഡങ്ങൾ പാലിക്കുകയും, അനുമതി നിഷേധിക്കുന്നത് മൂലമുണ്ടാകുന്ന ദോഷഫലങ്ങൾ ക്രമവൽക്കരണത്തേക്കാൾ വലുതായിരിക്കുകയും ചെയ്യുന്ന അസാധാരണ സാഹചര്യങ്ങളിൽ, കർശന നിബന്ധനകളോടെ മുൻകാലപ്രാബല്യത്തോടെയുള്ള അനുമതി പരിഗണിക്കാവുന്നതാണ്. തൊഴിലാളികളുടെ ഉപജീവനവും സാമ്പത്തിക ആഘാതങ്ങളും കോടതികൾക്ക് അവഗണിക്കാനാവില്ല.
വൻകിട വാണിജ്യ പദ്ധതികൾക്കായുള്ള മുൻകൂർ പരിസ്ഥിതി അനുമതി (EC) തർക്കങ്ങളിൽ നിന്നും തീർത്തും വ്യത്യസ്തമായ സാഹചര്യത്തിലാണ് തീരദേശവാസികളുടെ ചെറിയ പാർപ്പിടങ്ങൾ നിൽക്കുന്നത്. 20,000 ചതുരശ്ര മീറ്ററിന് മുകളിലുള്ള കെട്ടിടങ്ങൾക്ക് മാത്രമാണ് 2006-ലെ EIA വിജ്ഞാപനം ബാധകമാകുന്നത്; സാധാരണ പാർപ്പിടങ്ങൾക്ക് ഈ മുൻകൂർ അനുമതി ബാധകമല്ല.
അതുകൊണ്ടുതന്നെ, വകുപ്പ് 9(iv) പ്രകാരമുള്ള പാർപ്പിടങ്ങളുടെ ക്രമവൽക്കരണത്തെ വൻകിട വാണിജ്യ പദ്ധതികളുടെ അതേ കർശന മാനദണ്ഡങ്ങൾ വെച്ച് അളക്കരുതെന്നും, ഇതിൽ നിയമപരമായ വ്യക്തത ആവശ്യമാണെന്നും വ്യക്തമാണ്. പ്രത്യേക ഇളവ് പദ്ധതികളിലൂടെയോ (Amnesty Scheme) വിജ്ഞാപനത്തിലെ നിയമാനുസൃത ഭേദഗതികളിലൂടെയോ തീരദേശവാസികളുടെ ഈ പ്രശ്നത്തിന് അടിയന്തര പരിഹാരം കാണേണ്ടതുണ്ട്. നിരവധിയായ സാധാരണക്കാരുടെ വീടുകളുടെ അനുമതി അപേക്ഷകളും നിയമപോരാട്ടങ്ങളും മുടങ്ങിക്കിടക്കുന്ന കേരളം പോലുള്ള സംസ്ഥാനങ്ങളിൽ ഈ വിഷയത്തിൽ അനുകമ്പാപൂർവ്വമായ സത്വര നടപടികൾ അത്യന്താപേക്ഷിതമാണ്.

INCLUDED IN PANCHAYATH ASSET REGISTER 

- Legal Issues 

Obstructing a person's access to the public road is illegal, arbitrary, and violative of the fundamental right to property and  the right to life guaranteed under Article 300A and Article 21 of the Constitution of India, respectively.  As per Section 169 of the Kerala Panchayat Raj Act, 1994, all public roads in a Panchayat area (not being under the control of the Government or other local authorities) vest in the Village Panchayat. The Panchayat is statutorily mandated to maintain, repair, and protect such roads from encroachment. 


The Panchayath authorities are under a mandatory statutory duty as per Section 170 of the Kerala Panchayat Raj Act, 1994, to remove any unauthorized obstruction or encroachment on a public road. The failure of the to do so, constitutes a gross dereliction of official duty.

It is a settled principle of law that once a pathway is entered in the Asset Register of the Panchayat, it assumes the character of a public road. In Kurian Paul V. Inspector of Police 2023 2 KHC 275 Honourable High Court of Kerala  held that the Asset Register is a statutory document maintained under Kerala Panchayath Raj (Accounts0 Rules 2011 and its entries are presumed to be correct unless established otherwise. Further, the local authority has a statutory obligation to ensure that public pathways are kept free from encroachments.   The Honourable High Court in Mariam Beevi V. Secretary Athirampuzha Gramapanchayath and others 2015 3 KHC 199 held that once a private road is meant to connect properties and becomes part of network of roads, it serves a public purpose and ceases to have exclusivity.

തീര മേഖലയിൽ ഇപ്പോൾ അടിയന്തരമായി ചെയ്യേണ്ടത്...

തീര മേഖലയിൽ ഇപ്പോൾ അടിയന്തരമായി ചെയ്യേണ്ടത്... 

കേരളത്തിൽ തീര നിയന്ത്രണ മേഖല (CRZ) വിജ്ഞാപനത്തിന്റെ ഭാഗമായി വീടുകൾ പണിയുന്നതിന് നിരവധി തദ്ദേശവാസികൾ ബുദ്ധിമുട്ട് അനുഭവിക്കുന്നുണ്ട് എന്നത് ഒരു യാഥാർത്ഥ്യമാണ്. പക്ഷേ അതേസമയം പരിസ്ഥിതി സംരക്ഷണങ്ങളുടെ ഭാഗമായി നിയമം നടപ്പിൽ വന്നപ്പോൾ അതിനെതിരെ കാര്യമായ പ്രതികരണങ്ങൾ ഒന്നും ആ ഘട്ടത്തിൽ 1991, 2011 എന്നീ കാലയളവുകളിൽ ഉണ്ടായില്ല.

ഇപ്പോൾ മലയോര മേഖലയിൽ പരിസ്ഥിതി ലോല മേഖല (ESA) സംബന്ധിച്ച് ഏഴാമത് കരട് പുറത്തിറങ്ങിയപ്പോൾ അതുമായി ബന്ധപ്പെട്ടുള്ള പ്രതിഷേധങ്ങൾ തീരമേഖലയിലുള്ള ആളുകളും കണ്ടുമനസ്സിലാക്കേണ്ടതാണ്. തങ്ങൾക്ക് ഭവന നിർമ്മാണത്തിനോ മറ്റു നിർമ്മാണങ്ങൾക്കോ സാധ്യത നിഷേധിക്കുന്ന തരത്തിൽ പരിസ്ഥിതി പ്രവർത്തനങ്ങളുടെ ഭാഗമായിട്ടാണെങ്കിലും വിജ്ഞാപനങ്ങൾ വരുമ്പോൾ അതിനെതിരെ ഉടനടി പ്രതികരിക്കാൻ മലയോര മേഖലയിൽ കാണിക്കുന്ന ജാഗ്രതയും പ്രത്യേകതയും ഒന്നും തീരമേഖലയിൽ ഉണ്ടാകാറില്ല.
എന്നിരുന്നാലും കോസ്റ്റൽ റെഗുലേഷൻ സോൺ വിജ്ഞാപനം (CRZ Notification) 2019 പുറത്തിറങ്ങിയപ്പോൾ താരതമ്യേന ഇളവുകൾ തദ്ദേശവാസികൾക്ക് ലഭ്യമായിട്ടുണ്ട്. അത്തരത്തിൽ ഇളവുകൾ വന്നത് തന്നെ നിരന്തരമായി ചിലരെല്ലാം ഇതിന്റെ പിറകെ ഉണ്ടാവുകയും, തദ്ദേശവാസികളുടെ ഭവന നിർമ്മാണം ജന്മാവകാശമാണെന്ന് പറഞ്ഞുകൊണ്ടിരിക്കുകയും ചെയ്തതിന്റെ ഫലമാണ്.

നിലവിലുള്ള കോസ്റ്റൽ റെഗുലേഷൻ സോൺ വിജ്ഞാപനം (CRZ Notification 2019) ഇളവുകൾ 2019 ജനുവരിയിൽ തന്നെ വിജ്ഞാപനം ചെയ്തുവെങ്കിലും അത് നടപ്പിലായത്, അതായത് അതിന്റെ കോസ്റ്റൽ സോൺ മാനേജ്മെന്റ് പ്ലാൻ (CZMP) പുറത്തിറങ്ങിയത് 2024 ഒക്ടോബർ മാസമാണ്. ഫലത്തിൽ അഞ്ചു വർഷം കാത്തിരുന്നതിനു ശേഷമാണ് കേരളത്തിലെ തീരവാസികൾക്ക്, തദ്ദേശവാസികൾക്ക് ഭവന നിർമ്മാണത്തിനുള്ള ഇളവുകൾക്ക് അവസരം കിട്ടിയത്. 

അതേസമയം ആ കാലയളവിനുള്ളിൽ നിർമ്മാണം നടത്തിയ ആളുകൾക്ക് ഇപ്പോൾ ഇളവുകൾ ഉണ്ടെങ്കിലും അതിന്റെ ക്രമവൽക്കരണ നടപടികൾക്ക് പുതിയ ഇളവുകളുടെ അടിസ്ഥാനത്തിൽ സാധ്യതയില്ല. അത് സംബന്ധിച്ച വിഷയം സുപ്രീം കോടതിയുടെ പരിഗണനയിൽ ഇരുന്നിരുന്നതും പിന്നീട് അത് കേന്ദ്ര സർക്കാരിന് തീരുമാനിക്കാം എന്ന തരത്തിൽ ആ വിധി നിലവിൽ തുടരുന്നു എന്നുള്ളതാണ് വസ്തുത.

തെറ്റ് തിരുത്താൻ ഉള്ള സമയം 

2024 ഒക്ടോബർ മാസം പുറത്തിറങ്ങിയ കോസ്റ്റൽ സോൺ മാനേജ്മെന്റ് പ്ലാൻ സംബന്ധിച്ച മാപ്പിൽ പല തെറ്റുകളും കടന്നുകൂടിയിട്ടുണ്ട് എന്ന് നിരവധി പരാതികൾ ഉയർന്നുവന്നിരുന്നു. മാപ്പ് പുറത്തിറങ്ങുന്നത് സംബന്ധിച്ച് അഞ്ചു വർഷത്തിൽ ഒരിക്കൽ മാത്രമാണ് തിരുത്തലുകൾ ഉണ്ടാകേണ്ടത്. അതുതന്നെ സ്വാഭാവികമായും ഉണ്ടാകണമെന്നുമില്ല. ഈ സാഹചര്യത്തിൽ തങ്ങളുടെ ഭൂമി പുരയിടമായി റവന്യൂ രേഖകളിൽ ഉണ്ടെങ്കിലും CRZ മാപ്പിൽ അത് '1B' എന്ന് പറയുന്ന വെള്ളക്കെട്ട് പ്രദേശമോ അല്ലെങ്കിൽ കണ്ടൽക്കാടുകളുടെ ബഫർ സോണുകളായിട്ടോ ഒക്കെ തെറ്റായി രേഖപ്പെടുത്തിയിരിക്കുന്നത് തിരുത്തൽ വരുത്തണമെന്ന് ആവശ്യപ്പെട്ട് നിരവധി നിവേദനങ്ങൾ അധികാരികൾക്ക് ലഭിക്കുകയുണ്ടായി.
പഞ്ചായത്തുകളും സംസ്ഥാന ഭരണകൂടവും ഇക്കാര്യത്തിൽ പ്രത്യേകിച്ച് തീരുമാനങ്ങളൊന്നും എടുക്കാൻ കഴിയാത്ത സാഹചര്യത്തിൽ, പരാതികളെല്ലാം കേന്ദ്രതലത്തിലുള്ള മാപ്പ് തിരുത്തലുമായി ബന്ധപ്പെട്ട കാര്യങ്ങളിലേക്ക് കടക്കുകയാണുണ്ടായത്. 

ഒടുവിൽ ചില ആളുകൾ കോടതിയെ സമീപിക്കുകയും, കോടതിയിൽ കേരള കോസ്റ്റൽ സോൺ മാനേജ്മെന്റ് അതോറിറ്റി (KCZMA) തിരുത്തൽ നടപടികൾ തുടങ്ങിയിട്ടുണ്ട് എന്ന് കോടതിയെ അറിയിക്കുകയും, ആ കാര്യങ്ങൾ രേഖപ്പെടുത്തി കോടതി 'കരഭൂമിയാണെങ്കിൽ നിർമ്മാണത്തിന് അനുമതി നൽകുക' എന്ന നിബന്ധനകളോടുകൂടിയ ഉത്തരവുകളിലൂടെയൊക്കെ ചില കേസുകൾ തീർപ്പാക്കുകയും ചെയ്തിരുന്നു. 

കോടതിയിൽ തിരുത്തൽ നടപടികൾ ആരംഭിച്ചു എന്ന് രേഖപ്പെടുത്തിയിരുന്നെങ്കിലും യഥാർത്ഥത്തിൽ ആ നടപടികൾ ആരംഭിച്ചിരുന്നില്ല. പിന്നീട് വൈപ്പിൻ ഇടവനക്കാട് കേന്ദ്രീകരിച്ച് പ്രവർത്തിക്കുന്ന ചില ആളുകൾ വിവരാവകാശ നിയമപ്രകാരം അപേക്ഷ നൽകുകയും, എന്നാണ് തിരുത്തൽ നടപടികൾ തുടങ്ങിയത് എന്നൊക്കെ ആരായുകയും ചെയ്തതിനെ തുടർന്നാണ് തിടുക്കത്തിൽ കേരളത്തിലെ തദ്ദേശ ഭരണകൂടങ്ങൾക്ക് സംസ്ഥാന തദ്ദേശ സ്വയംഭരണ വകുപ്പിൽ നിന്ന് മാപ്പിലെ തിരുത്തലുകൾ വരുത്തുന്നതിനുള്ള ഫോർമാറ്റ് ഉൾപ്പെടെ അയച്ചു നൽകിയത്.

സ്ലൂയിസ് ബണ്ട് ഗേറ്റുകൾ (Sluice bund gates) മാർക്ക് ചെയ്യേണ്ടതായ സ്ഥലങ്ങളിൽ അവ മാർക്ക് ചെയ്യാത്ത കാര്യങ്ങൾ റിപ്പോർട്ട് ചെയ്യാനും, അതുപോലെ കണ്ടൽക്കാടുകൾക്ക് ചുറ്റും — സ്വകാര്യ ഭൂമിയിലെ കണ്ടൽക്കാടുകൾ ആണെങ്കിൽ അതിനു ചുറ്റും ബഫർ സോൺ ആവശ്യമില്ല — എന്നാൽ അക്കാര്യങ്ങളിലും തെറ്റായി ബഫർ സോൺ ഉൾപ്പെട്ട വിഷയങ്ങളിലും പൊതുവിൽ മാപ്പിലെ തിരുത്തലുകൾ സംബന്ധിച്ച കാര്യങ്ങളിലുമെല്ലാം പൊതുജനങ്ങൾക്ക്, തീരവാസികൾക്ക് പരാതി നൽകാനുള്ള സമയമാണ് ഇപ്പോൾ.
ഈ സമയത്താണ് പരാതി ഉണ്ടെങ്കിൽ നൽകേണ്ടത്. ദൗർഭാഗ്യവശാൽ ഈ കാര്യങ്ങൾ കേരളത്തിലെ  തീരദേശ പഞ്ചായത്തുകൾ പൂർണ്ണമായും ഈ വിഷയം  ഏറ്റെടുത്ത അവസ്ഥയിലല്ല. ചില ആളുകൾ അറിഞ്ഞ് പരാതികൾ നൽകുന്നതല്ലാതെ, ചുരുക്കം ചില തീരപ്രദേശത്തെ ഗ്രാമപഞ്ചായത്തുകൾ ഇതിനുവേണ്ടിയുള്ള ബോധവൽക്കരണ പരിപാടികൾ നടത്തുന്നുണ്ട് എന്നതുമല്ലാതെ, പൊതുവായി ഈ തെറ്റ് തിരുത്തലിനു വേണ്ടിയും ആളുകൾക്ക് ഗുണകരമായ കാര്യങ്ങൾ ഉണ്ടാകുന്നതിനു വേണ്ടിയുമുള്ള ഒരു പ്രയത്നം ഉണ്ടായി കാണുന്നില്ല.

ഈ ഉത്തരവാദിത്വം ഏറ്റെടുക്കണം 

കേരളത്തിന്റെ തീരവാസികളുമായി ബന്ധപ്പെട്ട് പ്രവർത്തിക്കുന്ന സംഘടനകൾ ഈ ഉത്തരവാദിത്വം ഏറ്റെടുക്കണം. സംഘടനകളും ഇത്തരത്തിലുള്ള പൊതുപ്രവർത്തകരും ഈ ഉത്തരവാദിത്വം ഏറ്റെടുത്ത് ആവശ്യമായ ആളുകളെക്കൊണ്ട് തിരുത്തൽ വരുത്തിക്കാനുള്ള പരാതികൾ നൽകാൻ ഈ അവസരം പ്രയോജനപ്പെടുത്താൻ ശ്രമിക്കണം.
ഇതൊക്കെയാണെങ്കിൽ കൂടി K-Smart മാപ്പുകളിലെ തെറ്റുകൾ കാരണവും പല തദ്ദേശ ഭരണകൂടങ്ങളിലും ഇത്തരത്തിലുള്ള പെർമിറ്റുകൾ നിഷേധിക്കപ്പെടുന്നുണ്ട്. പൊതുവിൽ CRZ മാപ്പിലെ തെറ്റ് തിരുത്താനുള്ള ഈ അവസരം പരമാവധി പ്രയോജനപ്പെടുത്താൻ തീരമേഖലയിൽ വീടുകൾ വെയ്ക്കുന്നതിനു വേണ്ടി കാത്തിരിക്കുന്ന, അവിടെ ഭൂമിയുള്ളവർ ചെയ്യേണ്ട അത്യാവശ്യമായ ഒരു കാര്യം തന്നെയാണ് ഇത്. തങ്ങളുടെ ഭൂമി കോസ്റ്റൽ സോൺ മാനേജ്മെന്റ് അതോറിറ്റി പുറത്തിറക്കിയ വെബ്സൈറ്റിൽ, മാപ്പിൽ പരിശോധിച്ച് തെറ്റായി രേഖപ്പെടുത്തിയിട്ടുണ്ടെങ്കിൽ അത് തിരുത്താനുള്ള അവസരം ഉപയോഗിക്കാതെ വിട്ടുകളയരുത്. നിയമപ്രകാരം അവസരം ലഭിക്കുന്ന സമയങ്ങളിൽ അത് ചെയ്യണം; അല്ലാതെ എല്ലാം കഴിഞ്ഞതിനുശേഷം സമരങ്ങളുമായി ഇറങ്ങിയത് കൊണ്ട് ഒരുപക്ഷേ പരിഹാരം ഉണ്ടാവുമെങ്കിലും കാത്തിരിപ്പ് നീളും.

അമ്പലങ്ങൾ, പള്ളികൾ, മോസ്കുകൾ  മുതലായ ആരാധനാലയങ്ങളുമായി  ബന്ധപ്പെട്ട്  വൻ ജനക്കൂട്ടങ്ങൾ എത്തിച്ചേരുന്ന പരിപാടികൾ മൂലം ഉണ്ടാകുന്ന ഗതാഗത തടസ്സവും അനുബന്ധ വിഷയങ്ങളും പരിഹരിക്കുന്നതിന് കേരള ഹൈക്കോടതി മാർഗ്ഗനിർദ്ദേശങ്ങൾ പുറത്തിറക്കി. എറണാകുളം ജില്ലയിലെ ഒരു ഉത്സവവുമായി ബന്ധപ്പെട്ട കാവടി ഘോഷയാത്ര മൂലമുള്ള ഗതാഗത തടസ്സം സംബന്ധിച്ച  ഹർജിയിലാണ് പൊതുവായ മാർഗനിർദേശങ്ങൾ പുറത്തിറക്കിയത്. 

പൊതുനിരത്തുകളിലെ തടസ്സമില്ലാത്ത സഞ്ചാരം ഉറപ്പാക്കുന്ന കേരള പബ്ലിക് വേയ്‌സ് (റെസ്ട്രിക്ഷൻ ഓഫ് അസംബ്ലീസ് ആൻഡ് പ്രൊസഷൻസ്) ആക്ട്, 2011 പ്രകാരം പൊതു റോഡുകളിൽ ഗതാഗത തടസ്സങ്ങൾ ഒഴിവാക്കുക എന്നത് പോലീസിന്റെ ചുമതലയാണ്. ഈ നിയമത്തിലെ വകുപ്പ് മൂന്ന് പ്രകാരം പൊതുജനത്തിന് തടസ്സമില്ലാതെ പൊതുനിരത്തുകളിലൂടെ സഞ്ചരിക്കുന്നതിന് അവകാശമുണ്ട്.

എന്നിരുന്നാലും ജില്ലാ പോലീസ് മേധാവിക്ക് മതപരമായ ആഘോഷങ്ങളുടെ ഭാഗമായും പൊതു പ്രാധാന്യമുള്ള സാമൂഹിക സാംസ്കാരിക സമ്മേളനങ്ങളും പൊതുയോഗങ്ങളും റാലികളും ഒക്കെ സംബന്ധിച്ച് 24 മണിക്കൂറിൽ അധികരിക്കാത്ത തരത്തിൽ ന്യായമായ നിയന്ത്രണങ്ങൾ ഏർപ്പെടുത്താവുന്നതാണ്. ഇതു സംബന്ധിച്ച് ഏഴ് ദിവസത്തിന് മുമ്പ് തന്നെ ജില്ലാ പോലീസ് മേധാവിക്ക് നടത്തിപ്പുകാർ  അപേക്ഷ  കൊടുക്കണം. 2011 മുതൽ നിയമം നിലവിൽ ഉണ്ടെങ്കിലും ഇപ്പോഴും പല സ്ഥലത്തും ഉത്സവങ്ങളുടെയും പെരുന്നാളുകളുടെയും  ഘോഷയാത്രകളുടെയും പേരിൽ ജനക്കൂട്ടത്തെ നിയന്ത്രിക്കുന്നതിന് ബുദ്ധിമുട്ടുകൾ ഉണ്ടാകുന്നു എന്ന് കണക്കിലെടുത്താണ് കോടതി മാർഗ്ഗനിർദേശങ്ങൾ പുറത്തിറക്കിയത്.

മാർഗ്ഗനിർദ്ദേശങ്ങൾ

1. ഉത്സവത്തിന് മുൻപ് സ്വീകരിക്കേണ്ട നടപടികൾ:

മുൻകൂട്ടി അറിയിക്കുക:ഉത്സവ കമ്മിറ്റികൾ അല്ലെങ്കിൽ സംഘാടകർ ഉത്സവത്തിന്റെ തീയതി, ഘോഷയാത്രയുടെ വിവരങ്ങൾ, സമയം എന്നിവ ഉൾപ്പെട്ട ചാർട്ട് കുറഞ്ഞത് മൂന്നാഴ്ച മുൻപെങ്കിലും ബന്ധപ്പെട്ട ജില്ലാ പോലീസ് മേധാവിക്ക് നൽകണം.

നോഡൽ ഓഫീസറെ നിശ്ചയിക്കുക: അറിയിപ്പ് ലഭിച്ചാൽ ജില്ലാ പോലീസ് മേധാവി ഡെപ്യൂട്ടി പോലീസ് സൂപ്രണ്ട് (Dy.SP) റാങ്കിൽ കുറയാത്ത ഒരു ഉദ്യോഗസ്ഥനെ ഉത്സവത്തിന്റെ ക്രമസമാധാന ചുമതലയ്ക്കായി നിയോഗിക്കണം.

പരിശോധനയും കൂടിയാലോചനയും: നിയോഗിക്കപ്പെട്ട പോലീസ് ഓഫീസർ ഉത്സവ സ്ഥലം സന്ദർശിച്ച് വിവരങ്ങൾ ശേഖരിക്കുകയും സംഘാടകർ, തദ്ദേശസ്വയംഭരണ ഉദ്യോഗസ്ഥർ, റെസിഡന്റ്സ് അസോസിയേഷനുകൾ എന്നിവരുമായി ചർച്ച നടത്തി ആക്ഷൻ പ്ലാൻ തയ്യാറാക്കുകയും വേണം.

പാർക്കിംഗ് സൗകര്യം: വാഹനങ്ങൾക്കായി മതിയായ പാർക്കിംഗ് സൗകര്യം സംഘാടകർ ഒരുക്കിയിട്ടുണ്ടെന്ന് പോലീസ് ഓഫീസർ ഉറപ്പുവരുത്തണം.

2. ഉത്സവ സമയത്ത് പാലിക്കേണ്ടവ
ഗതാഗത നിയന്ത്രണം: റോഡരികുകളിൽ വാഹനങ്ങൾ പാർക്ക് ചെയ്യുന്നത് തടയണം. ആംബുലൻസുകൾക്കും അടിയന്തര വാഹനങ്ങൾക്കും കടന്നുപോകാൻ പ്രത്യേക പാത ഒരുക്കുകയും തിരക്ക് നിയന്ത്രിക്കാൻ പ്രത്യേക എൻട്രി, എക്സിറ്റ് പോയിന്റുകൾ സ്ഥാപിക്കുകയും വേണം.

സ്ത്രീകൾക്കും കുട്ടികൾക്കും സംരക്ഷണം: സ്ത്രീകൾക്കും കുട്ടികൾക്കും ചടങ്ങുകൾ കാണുന്നതിനായി സ്വകാര്യതയും മാന്യതയും ഉറപ്പാക്കുന്ന രീതിയിൽ പ്രത്യേക സ്ഥലങ്ങൾ നിശ്ചയിച്ചു നൽകണം.

ഗ്രീൻ പ്രോട്ടോക്കോൾ:സർക്കാർ നിശ്ചയിച്ചിട്ടുള്ള ഹരിത ചട്ടം കർശനമായി പാലിക്കണം. മാലിന്യങ്ങൾ വേർതിരിച്ച് ശേഖരിക്കാൻ സംവിധാനം വേണം.

പോലീസ് വിന്യാസം:വനിതാ പോലീസ് ഓഫീസർമാർ ഉൾപ്പെടെ ആവശ്യമായ പോലീസ് സേനയെ സ്ഥലത്ത് വിന്യസിക്കണം.

3. ഉത്സവത്തിന് ശേഷം

ശുചീകരണം:ഉത്സവം കഴിഞ്ഞ് 24 മണിക്കൂറിനുള്ളിൽ സംഘാടകർ തദ്ദേശ സ്വയംഭരണ സ്ഥാപനങ്ങളുടെ സഹായത്തോടെ പ്രദേശം വൃത്തിയാക്കി പഴയപടിയാക്കണം.

ഉത്സവങ്ങൾ സുരക്ഷിതമായി നടത്തുക എന്നത് സംഘാടകരുടെ പ്രാഥമിക ഉത്തരവാദിത്തമാണ്.  പൊതുനിരത്തുകളിലെ തടസ്സമില്ലാത്ത സഞ്ചാരം ഉറപ്പാക്കുന്ന കേരള പബ്ലിക് വേയ്‌സ് (റെസ്ട്രിക്ഷൻ ഓഫ് അസംബ്ലീസ് ആൻഡ് പ്രൊസഷൻസ്) ആക്ട്, 2011 കർശനമായി പാലിക്കപ്പെടണം. ഘോഷയാത്രകൾ നടക്കുമ്പോൾ റോഡിന്റെ മുഴുവൻ വീതിയും ഉപയോഗിക്കാതെ ഒരു വശം ഗതാഗതത്തിനായി തുറന്നിടണമെന്നും കോടതിയുടെ രണ്ടംഗ ബഞ്ച് നിർദ്ദേശിച്ചു.ഈ വിധിപ്പകർപ്പ് (WPC 3534/2026) സംസ്ഥാന പോലീസ് മേധാവിക്കും എല്ലാ ദേവസ്വം ബോർഡുകൾക്കും അടിയന്തരമായി കൈമാറാൻ രജിസ്ട്രിയോട് നിർദ്ദേശിച്ചിട്ടുണ്ട്.

ഭൂമി പതിച്ചു നൽകൽ: കേരളത്തിലെ നിയമങ്ങളും ചട്ടങ്ങളും | Land assignment in Kerala |

ഭൂമി പതിച്ചു നൽകൽ: കേരളത്തിലെ നിയമങ്ങളും ചട്ടങ്ങളും

​വ്യക്തികൾക്കും കുടുംബങ്ങൾക്കും കൃഷി, ഭവനനിർമ്മാണം, തൊട്ടടുത്തുള്ള വസ്തുവിന്റെ ഗുണകരമായ അനുഭവം (Beneficial Enjoyment) എന്നീ ആവശ്യങ്ങൾക്കായി സർക്കാർ ഭൂമി പതിച്ചു നൽകുന്നതിന് നമ്മുടെ സംസ്ഥാനത്ത് കൃത്യമായ വ്യവസ്ഥകളുണ്ട്. 1960-ലെ കേരള ഭൂമി പതിവ് നിയമം പ്രകാരം പുറപ്പെടുവിച്ചിട്ടുള്ള വിവിധ ചട്ടങ്ങൾ അനുസരിച്ചാണ് കേരളത്തിൽ സർക്കാർ ഭൂമി പതിച്ചുനൽകുന്നത്.
​തദ്ദേശസ്വയംഭരണ പ്രദേശങ്ങളുടെ അടിസ്ഥാനത്തിൽ ഇതിനായി രണ്ട് പ്രധാന ചട്ടങ്ങളാണുള്ളത്.പഞ്ചായത്ത് പ്രദേശങ്ങളിൽ: 1964-ലെ കേരള ഭൂമി പതിവ് ചട്ടങ്ങൾ, മുനിസിപ്പൽ/കോർപ്പറേഷൻ പ്രദേശങ്ങളിൽ: 1995-ലെ മുനിസിപ്പൽ കോർപ്പറേഷൻ പ്രദേശങ്ങളിലെ ഭൂമി പതിവ് ചട്ടങ്ങൾ. ഇവ കൂടാതെ കൃഷിഭൂമി പതിച്ചുനൽകൽ, കൃഷിക്ക് അനുയോജ്യമായ വനഭൂമി പതിച്ചുനൽകൽ, 01-01-1977-ന് മുൻപ് കൈവശമുള്ള വനഭൂമി പതിച്ചുനൽകൽ, വ്യവസായ ആവശ്യങ്ങൾ, കർഷകത്തൊഴിലാളികളുടെ പുനരധിവാസം, റബർ പ്ലാന്റേഷൻ, വയനാട് കോളനൈസേഷൻ സ്കീം, ഏലം, തേയില, കോഫി തുടങ്ങിയ കൃഷികൾക്കായുള്ള ലീസ് പുതുക്കലും പതിച്ചുനൽകലും എന്നിവയ്ക്കായി പ്രത്യേക ഭൂമി പതിവ് ചട്ടങ്ങളും കേരളത്തിൽ നിലവിലുണ്ട്.

​ഭൂമി പതിവിന് ആർക്കാണ് അധികാരം?

​ആവശ്യങ്ങളുടെ അടിസ്ഥാനത്തിലാണ് ഭൂമി പതിച്ചുനൽകാനുള്ള അധികാരം നിശ്ചയിച്ചിരിക്കുന്നത്:
കൃഷി, ഭവനനിർമ്മാണം എന്നിവയ്ക്കായി വ്യക്തികൾക്കും കുടുംബങ്ങൾക്കും ഭൂമി പതിച്ചുനൽകാനുള്ള അധികാരം തഹസിൽദാർക്കാണ്. ഗുണകരമായ വിനിയോഗത്തിന് (Beneficial Enjoyment) ഭൂമി പതിച്ചുനൽകാനുള്ള അധികാരം റവന്യൂ ഡിവിഷണൽ ഓഫീസർക്ക് (RDO) ആണ്. താലൂക്ക് ഭൂമി പതിവ് കമ്മിറ്റിയുടെ ശുപാർശയോടു കൂടിയാണ് ഇത്തരത്തിലുള്ള അപേക്ഷകൾ പരിഗണിക്കുന്നത്.

​അർഹതാ ലിസ്റ്റും നടപടിക്രമങ്ങളും

​പതിച്ചുനൽകാവുന്ന ഭൂമിയുടെ ലിസ്റ്റ് താലൂക്ക് ലാൻഡ് അസൈൻമെന്റ് കമ്മിറ്റിയുടെ ശുപാർശയോടുകൂടി ജില്ലാ കളക്ടർക്ക് സമർപ്പിക്കുന്നു. ഈ കമ്മിറ്റിയുടെ ശുപാർശ പരിഗണിച്ച് ജില്ലാ കളക്ടറാണ് ലിസ്റ്റിന് അംഗീകാരം നൽകേണ്ടത്. അംഗീകരിച്ച ലിസ്റ്റ് ബന്ധപ്പെട്ട താലൂക്ക് ഓഫീസിലും വില്ലേജ് ഓഫീസിലും സൂക്ഷിക്കേണ്ടതാണ്. കൂടാതെ, പതിച്ചുനൽകാവുന്ന ഭൂമിയുടെ വിവരം കാണിക്കുന്ന രജിസ്റ്റർ താലൂക്ക്, വില്ലേജ് ഓഫീസുകളിൽ അപ്‌ഡേറ്റ് ചെയ്ത് സൂക്ഷിക്കേണ്ടതുണ്ട്.
​പതിച്ചുനൽകുന്ന ഭൂമിയുടെ 25% പട്ടികജാതി/പട്ടികവർഗ്ഗക്കാർക്കായി നീക്കിവെക്കണം,10% വിമുക്തഭടന്മാർക്കായി നീക്കിവെക്കണം, ബാക്കിയുള്ള ഭൂമി വ്യവസ്ഥകൾ പ്രകാരം മുൻഗണനാ ക്രമത്തിലാണ് പതിച്ചുനൽകേണ്ടത്. ഭൂമിയില്ലാത്ത ആളുകൾ (വാർഷിക വരുമാനത്തിന് വിധേയമായി), സ്വന്തമായി ഭൂമിയില്ലാത്തവരും, മിലിട്ടറി സർവീസിലിരിക്കെ മരണമടഞ്ഞവരുടെ ആശ്രിതർക്കോ അല്ലെങ്കിൽ സർവീസിലിരിക്കെ അംഗവൈകല്യം സംഭവിച്ചവർക്കോ (Disabled), 
ചെറിയ തോതിൽ ഭൂമി കൈവശം വെച്ചിരിക്കുന്നവരും, നിശ്ചിത സമയപരിധി കഴിഞ്ഞിട്ടും അത് പതിച്ചു കിട്ടാൻ അപേക്ഷിക്കാൻ കഴിയാത്തവരുമായ ആളുകൾ മുതലായവർക്കാണ് മുൻഗണനാ ക്രമത്തിൽ സ്ഥാനം ഉണ്ടാവുക. 
​ഇത്തരത്തിൽ പതിച്ചു കിട്ടുന്ന ഭൂമി അനന്തരാവകാശികൾക്ക് ലഭിക്കുന്നതാണ്.  വിവാഹിതരെ സംബന്ധിച്ചിടത്തോളം ഭാര്യയുടെയും ഭർത്താവിന്റെയും പേരിൽ സംയുക്തമായാണ് ഭൂമി പതിച്ചുനൽകുന്നത്.

​പട്ടയ അപേക്ഷകളിലെ നടപടിക്രമങ്ങൾ

അപേക്ഷ ലഭിച്ചാൽ അത് ബന്ധപ്പെട്ട വില്ലേജ് ഓഫീസർക്ക് അന്വേഷണത്തിനും റിപ്പോർട്ടിനുമായി അയക്കുന്നു.
ഭൂമി പതിവിന് യോഗ്യമാണെങ്കിൽ വില്ലേജ് ഓഫീസർ വിശദമായ റിപ്പോർട്ട് തഹസിൽദാർക്ക് സമർപ്പിക്കും.
തഹസിൽദാർ രേഖകൾ സൂക്ഷ്മപരിശോധന നടത്തി നോട്ടീസ് പ്രസിദ്ധീകരിക്കും.
ആക്ഷേപങ്ങൾ ഒന്നും ഇല്ലാത്തപക്ഷം പ്രസ്തുത ഭൂമി പതിവ് കമ്മിറ്റിയുടെ പരിഗണനയ്ക്ക് സമർപ്പിക്കും.
പതിവ് കമ്മിറ്റി ശുപാർശ ചെയ്യുന്ന കേസുകളിൽ പതിവധികാരി ഉത്തരവ് നൽകുകയും, നിശ്ചിത തുക ഒടുക്കുന്ന മുറയ്ക്ക് പട്ടയം അനുവദിക്കുകയും ചെയ്യും.
​പതിച്ചു കിട്ടുന്ന ഭൂമി ഏത് ആവശ്യത്തിനാണോ അനുവദിച്ചത്, അത് ഒരു വർഷത്തിനകം പ്രസ്തുത ആവശ്യത്തിനായി വിനിയോഗിച്ചിരിക്കണം. ഭവനനിർമ്മാണത്തിനോ കൃഷിക്കോ വേണ്ടി പതിച്ചു കിട്ടിയ ഭൂമി, അത് വികസിപ്പിക്കുന്നതിനായി ഗവൺമെന്റിലോ ബാങ്കിലോ സർക്കാർ അംഗീകൃത ധനകാര്യ സ്ഥാപനങ്ങളിലോ റബർ ബോർഡിലോ ജാമ്യമായി പണയപ്പെടുത്താവുന്നതാണ്. പതിച്ചു കിട്ടിയത് സ്വന്തം കൈവശഭൂമിയാണെങ്കിൽ അത് പാരമ്പര്യമായി കൈവശം വെക്കാനും അന്യധീനപ്പെടുത്താനും സാധിക്കും.

​പുതിയ ഭേദഗതി: കേരള സർക്കാർ ഭൂമി പതിവ് ചട്ടങ്ങൾ 2026

​പതിച്ചു കിട്ടിയ ഭൂമി മറ്റ് ആവശ്യങ്ങൾക്ക് ഉപയോഗിക്കുന്നതിന് നിയന്ത്രണങ്ങൾ ഉണ്ട്. 2026 മാർച്ച് 15-ന് ഭൂമി മറ്റ് ആവശ്യങ്ങൾക്ക് ഉപയോഗിക്കുന്നതിനുള്ള അനുവാദം നൽകിക്കൊണ്ട് സർക്കാർ പുതിയ ഭേദഗതി ചട്ടങ്ങൾ പുറപ്പെടുവിച്ചു. കേരള സർക്കാർ ഭൂമി പതിവ് ചട്ടങ്ങൾ 2026 (മറ്റ് ആവശ്യങ്ങൾക്ക് ഭൂമി ഉപയോഗിക്കുന്നതിനുള്ള അനുവാദം).
ഈ പുതിയ ചട്ടങ്ങൾ പ്രകാരം 5000 സ്ക്വയർ ഫീറ്റ് വരെയുള്ള വാണിജ്യ കെട്ടിടങ്ങൾക്കും എല്ലാത്തരത്തിലുമുള്ള ഭവനനിർമ്മാണങ്ങൾക്കും അപേക്ഷകന് നിശ്ചിത ഫീസ് ഒടുക്കി അനുവാദം വാങ്ങാവുന്നതാണ്.

CRZ map correction

ഇതാണ് ഏറ്റവും ലേറ്റസ്റ്റ് ആയുള്ള CRZ MAP. വില്ലേജിൽ കരമടയ്ക്കുന്നത് പുരയിടം ആയിട്ടാണെങ്കിലും ചിലരുടെ  സർവ്വേ നമ്പറുകളിൽ മാപ്പിൽ തെറ്റുകൾ കടന്നുകൂടിയിട്ടുണ്ട്. ഈ മാപ്പിൽ തെറ്റുകൾ ഇല്ലാത്ത ചില കേസുകളിൽ തദ്ദേശ ഭരണകൂടങ്ങളിലെ കെ സ്മാർട്ട് മാപ്പിൽ തെറ്റുകൾ ഉണ്ടെന്ന് പരാതികൾ ഉണ്ട്. തെറ്റായി  കണ്ടൽക്കാടുകളുടെ ബഫർ സോൺ ഉൾപ്പെട്ട സംഭവങ്ങളും ഉണ്ട്. കോടതി വ്യവഹാരങ്ങളുടെയും  പരാതികളുടെയും. മറ്റും പശ്ചാത്തലത്തിൽ സംസ്ഥാന അടിസ്ഥാനത്തിൽ തെറ്റുകൾ തിരുത്താനുള്ള നടപടികൾ ഇപ്പോൾ നടന്നുവരുന്നു.

ഒടുവിൽ തിരുത്തലുകൾ അറിയിക്കാനുള്ള ഔദ്യോഗിക നിർദ്ദേശങ്ങൾ തദ്ദേശ ഭരണകൂടങ്ങൾക്ക് ലഭിച്ചു തുടങ്ങി.#CRZ_MAP_ANOMALY

CRZ 2019 വിജ്ഞാപനത്തിന്റെ മാപ്പ് 2024 ൽ പുറത്തിറങ്ങിയതിൽ അപാകതകൾ ഉണ്ടെന്ന് പരാതി ഉയർന്നിരുന്നു. അതിൻറെ അടിസ്ഥാനത്തിൽ തിരുത്തലുകൾ വരുത്താൻ കാലങ്ങളായി ആവശ്യപ്പെട്ടുകൊണ്ടിരിക്കെ 2026 മെയ് മാസം പുറത്തിറങ്ങിയ കേരള ഹൈക്കോടതി വിധിയിൽ മാപ്പ് തിരുത്തൽ  നടപടികൾ ആരംഭിച്ചിട്ടുണ്ട് എന്ന് KCZMA സത്യവാങ്മൂലം നൽകിയിരുന്നു. 

ഒടുവിൽ കഴിഞ്ഞ ദിവസങ്ങളിൽ തിരുത്തലുകൾ അറിയിക്കാനുള്ള ഔദ്യോഗിക നിർദ്ദേശങ്ങൾ തദ്ദേശ ഭരണകൂടങ്ങൾക്ക് ലഭിച്ചു തുടങ്ങി.

ഇതിനൊക്കെയും തിരുത്തലുകൾ അനിവാര്യമാണ്. 300 സ്ക്വയർ മീറ്റർ വരെയുള്ള വീടുകൾ നിർമ്മിക്കാൻ തദ്ദേശവാസികൾക്ക് പെർമിറ്റ് നൽകാൻ തദ്ദേശ ഭരണകൂടങ്ങൾക്ക് തന്നെ അനുവാദം ഉണ്ടെങ്കിലും വിരളമായി മാത്രമേ നൽകാറുള്ളൂ. മാപ്പിലെ തിരുത്തലുകളും മറ്റു പല കാരണങ്ങളും പറഞ്ഞ് ആയിരങ്ങളാണ് ഇപ്പോഴും ഭവന നിർമ്മാണത്തിനായി കാത്തിരിക്കുന്നത്.

The assignment of government land in Kerala is governed by the Kerala Government Land Assignment Act, 1960 and the rules framed thereunder, such as the Kerala Land Assignment Rules, 1964, etc.
The assignment of government land is done after complying with due procedure as per Section 4 of the Kerala Government Land Assignment Act, 1960. When any government land is proposed to be assigned by the prescribed authority, otherwise than by way of lease or license, the Tahsildar of the taluk in which the land is situated, or any officer empowered by the government, shall notify in the prescribed manner that such land will, by public auction or otherwise, be assigned and call upon those who have got any claim to such land to prefer their objections, if any, in writing within a time specified in such notification.
It is also evident by going through Section 8 of the Act that assignment is to take effect with restrictions, conditions, etc., according to their tenure.
It is also specifically mentioned in the provision that all the restrictions, conditions, and limitations contained in any patta or other document evidencing the assignment of government land, or of any interest therein, shall be valid and take effect according to their tenor, notwithstanding any law for the time being in force, or any custom or contract to the contrary.  Rule 8 of the Kerala Land Assignment Rules, 1964 contains the conditions of assignment on registry. Lands granted on registry shall be heritable and alienable.

Key Legal Principles

It is a settled principle that the conditions of assignment, where in statutory rules framed under the Act, have the force of law.

Conditions stipulated in a patta by an executive authority cannot override or abridge specific rights, such as alienability, conferred by these statutory rules.
It is also reported that judicial pronouncements have consistently held that the amendments to land assignment rules—such as the 2009 Amendment to Rule 18 of the Kerala Land Assignment Rules, 1984, which increased the non-alienation period are not retrospective.
 
These amendments apply only to pattas issued after the date the amendment came into force.
Assignments granted prior to such amendments are governed by the rules and conditions in force at the time of original issuance.

Judicial Precedents

A Division Bench of the High Court of Kerala, in Travancore Rayons Limited v. Kerala State Pollution Control Board (2001 (1) KLT 175), after referring to various decisions of the Apex Court, reiterated that:
 It is a cardinal principle of construction that every statute is prima facie prospective, unless it is expressly or by necessary implication made to have retrospective operation.
 
But the rule in general is applicable where the object of the statute is to affect vested rights, to impose new burdens, or to impair existing obligations.

Unless there are words in the statute sufficient to show the intention of the legislature to affect existing rights, it is deemed to be prospective only, not retrospective in its operation.
The question of the retrospective effect of amendments to regulations on assignment has been considered in detail by this Honorable Court on several occasions, especially on the precedent laid down in Bhaskaran P.R. v. State of Kerala and Others (2010 KHC 6210), which describes the positions held by the Supreme Court on various decisions regarding the retrospective nature of an amendment.

Regularisation in CRZ- Proceedings

CRZ വിജ്ഞാപനപ്രകാരം  അനുമതി ഇല്ലാതെ നിർമ്മാണം നടത്തിയ കെട്ടിടങ്ങൾക്ക് ക്രമവൽക്കരണം (Regularisation)  നിയന്ത്രണങ്ങൾക്ക് വിധേയമായി മാത്രമേ ലഭിക്കുകയുള്ളൂ. അതും നിർമ്മാണം നടത്തിയ സമയത്ത് നിയമപ്രകാരം അനുവദനീയമായതും എന്നാൽ അനുവാദം തേടാതിരുന്നതുമായ  നിർമാണങ്ങൾക്ക് മാത്രം. 

ജസ്റ്റിസ് ജെ ബി കോശി കമ്മീഷൻ മുമ്പാകെ തീരവാസികൾക്ക് വേണ്ടി ഇക്കാര്യം ഉന്നയിച്ചിരുന്നു. 2011 CRZ ൽ അനുവദനീയമല്ലാതിരുന്നതും എന്നാൽ 2019 CRZ വിജ്ഞാപനത്തിലുളള ഇളവുകളുടെ അടിസ്ഥാനത്തിൽ അനുവദനീയമായതുമായ  ഭവനനിർമ്മാണങ്ങൾക്ക് ക്രമവൽക്കരണം ലഭ്യമാക്കി നടപടി ഉണ്ടാകണമെന്ന് ജെ ബി കോശി കമ്മീഷൻ ശുപാർശ ചെയ്തിരുന്നു. അതിൻറെ അടിസ്ഥാനത്തിൽ കേരളത്തിൽ CRZ വിഷയങ്ങൾ കൈകാര്യം ചെയ്യുന്ന KCZMA 153 മത് യോഗത്തിൽ (2026 മാർച്ച്) ഇക്കാര്യം കേന്ദ്ര പരിസ്ഥിതി മന്ത്രാലയത്തിന്റെ ശ്രദ്ധയിൽ കൊണ്ടുവരുന്നതിന് തീരുമാനമെടുത്തതിന്റെ മിനുറ്റ്സ്. (ഇമേജ് ഫയലിൽ ഉള്ളത്).  നിരവധി കുടുംബങ്ങളാണ് പുതിയ നിയമത്തിൽ ഇളവ് ഉണ്ടെങ്കിലും ക്രമവൽക്കരണം സാധ്യമല്ല എന്ന കാരണത്താൽ വീടിന് സ്ഥിരം നമ്പർ ലഭിക്കുന്നതിന് തടസ്സം നേരിടുന്നത്.

Police Verification - Cannot give an adverse report about the suitability of employment

Section 53 of the Kerala Police Act, 2011 -- Articles 14 and 16 of the Constitution of India

The scope of a police verification report under Section 53 of the Kerala Police Act, 2011 is confined to furnishing information regarding the character and antecedents of an applicant or employee. The statute does not authorise the police to express an opinion on the suitability or otherwise of a person for appointment to a particular post. 

The power to determine the suitability of a candidate for employment cannot be usurped by the police through an adverse verification report. Such a determination is a matter of employer discretion and administrative assessment. 

Mere involvement in a pending criminal case arising from a motor vehicle accident cannot, by itself, justify a police conclusion that a candidate is unsuitable for employment, particularly when the employment sought has no direct nexus with driving or operation of vehicles. 

A format prescribed for police verification containing a column requiring the police to certify whether a person is “suitable for appointment” is legally unsustainable, as such an assessment falls outside the statutory function contemplated under Section 53 of the Kerala Police Act

Introduction

The implementation of the Coastal Regulation Zone (CRZ) Notification 2019 in the State of Kerala has been characterized by protracted administrative delays and significant spatial anomalies in the published Coastal Zone Management Plan (CZMP) maps. This article examines the systemic errors within the current CZMP, wherein substantial tracts of legally verified dry land have been misclassified as intertidal water bodies (Category CRZ-I B). Such cartographic errors directly impair the constitutional and statutory rights of local inhabitants to construct residential dwellings.

    By analysing the procedural frameworks established under Annexure IV of the 2019 Notification and evaluating recent judicial interventions by the High Court of Kerala, this article highlights the friction between rigid environmental mapping practices and the practical socio-economic needs of coastal communities. Finally, it explores the formulation of interim judicial remedies designed to bypass bureaucratic delays and streamline localized permissions for small-scale residential developments.

    The pragmatic and flexible implementation of Coastal Regulation Zone (CRZ) frameworks to accommodate the fundamental housing needs of local inhabitants is a long-pending demand of India’s coastal communities.  While the central government promulgated the revised CRZ Notification in January 2019 to replace the legacy 2011 framework, its practical execution in Kerala faced severe institutional inertia. The comprehensive implementation of the 2019 Notification was delayed uninterruptedly for over five years, ultimately taking effect only in October 2024.

    Despite the eventual operationalization of the Coastal Zone Management Plan (CZMP), the transition has been marred by widespread cartographic anomalies in the finalized spatial maps. The integration of erroneous baseline data into localized regulatory software—such as the state's K-SMART digital permit architecture—has effectively frozen legitimate local development of many coastal families.

Cartographic Anomalies and Spatial Errors in the CZMP

    The primary grievance articulated by coastal property owners stems from the technical divergence between structural land records and the physical classifications imposed by the published CZMP maps. Under the statutory guidelines, state authorities were required to publish draft maps to invite public suggestions and objections before finalizing the spatial layouts. Although numerous local inhabitants submitted formal complaints pointing out clear geographic discrepancies, many critical errors persisted into the finalized document.

The Dry Land vs. Category CRZ-I B Conflict

    The most disruptive error identified within the current CZMP is the systemic misclassification of unambiguous "dry land" (purayidam) as intertidal or ecologically fragile zones. In numerous instances, properties that are structurally categorized as dry land under municipal revenue records, and explicitly excluded from local paddy land and wetland data banks, have been designated as Category CRZ-I B zones, wherein construction is not permitted.

 Statutory Definition:- Category CRZ-I B specifically denotes intertidal zones, infiltration ponds, and active water bodies located between the Low Tide Line (LTL) and the High Tide Line (HTL).

 Regulatory Impact:- When dry land is legally treated as an active water body within the CZMP, local government bodies are statutorily prohibited from issuing building or occupancy permits.

 Software Compounding:- Because the state's automated K-SMART permit application portal relies entirely on these erroneous spatial maps, applications for valid properties are automatically blocked, preventing any procedural advancement.

Anomalies in connection with sluice bund gates and Mangrove buffer zones  

    Pursuant to the amendment vide S.O. 4886(E) dated 26.11.2021, in paragraph 1, in clause (i), for the Explanation of CRZ Notification 2019, the requisite Explanation is substituted, so as to fix the HTL  in case there exists a bund or a sluice gate constructed prior to the date of notification issued vide S.O. 114(E) dated 19th February, 1991, the HTL shall be restricted up to the line long along the bund or the sluice gate, however, in such a case, area under mangroves arising due to saline water ingress beyond the bund or sluice gate shall be classified as CRZ-IA irrespective of the extent of the area beyond the bund or sluice gate and such areas under mangroves shall be protected and shall not be diverted for any developmental activities. But all those sluice bund gates are not marked in the CZMP map.

    It is further to be noted that as per the clause 1.1(b) of Annexure I of Notification 2019, mangroves in private land will not require a buffer zone. However, in several places in the present map even private lands are spotted as buffer zones near to Category 1A of CRZ.

Statutory Modification Procedures under Annexure IV of CRZ 2019

    Resolving these spatial disputes requires adherence to the strict amendment protocols detailed within the CRZ Notification 2019. Specifically, Annexure IV of the CRZ 2019 Notification governs the formal design, verification, and periodic revision of Coastal Zone Management Plans.

The Role of Technology and Authorized Agencies

According to Clause 3 and Clause 4 of Annexure IV, any finalization or modification of coastal maps must rely strictly on the synthesis of Latest Ground Truth Verification. The  Physical site inspections must also correlate revenue realities with coastal topology.  High-Resolution Satellite Imagery must be used for utilizing  advanced remote sensing data to delineate precise high and low tide lines.

The Clause 3 of Annexure IV of the CRZ 2019 Notification read thus: 

3. Preparation of CZM Maps:

(i) Base Maps of 1:25,000 scale shall be acquired from the Survey of India (SOI) and wherever 1: 25,000 maps are not available, 1: 50,000 maps shall be enlarged to 1: 25,000 for the purpose of base map preparation and these maps will be of the standard specification given below:-

Unit : 7.5 minutes X 7.5minutes

Numbering : Survey of India Sheet Numbering System

Horizontal Datum : Everest or WGS 84

Vertical Datum : Mean Sea Level (MSL)

Topography : Topography in the SOI maps will be updated using latest satellite imageries or aerial photographs

(ii) Coastal Zone Management (CZM) Maps of scale 1:25,000 shall be got prepared by any of the agencies identified by the Ministry of Environment, Forest and Climate Change vide its Office Order number J-17011/8/92-IA-III dated the 14th March, 2014 using the demarcation of the High Tide Line or LTL, as carried out by NCSCM.

(iii) Various regulatory lines viz. at a distance of 20 metres, 50 metres, 200 metres and 500 metres from HTL respectively, as applicable in various CRZ categories, and the Hazard line shall be demarcated and transferred to the CZM maps.

(iv) HTL, LTL and CRZ boundaries, as applicable, shall also be demarcated in the CZM maps along the banks of tidal influenced inland water bodies.

(v) Classification of different coastal zones shall be done as per the CRZ notification and Standard national or international colour codes shall be used.

The clause 7 of Annexure IV of CRZ 2019 deals with revision of coastal zone management plan.

7. Revision of Coastal Zone Management Plans:

(i) Whenever there is a doubt, the concerned State or Union territory Coastal Zone Management Authority shall refer the matter to the National Centre for Sustainable Coastal Management who shall verify the CZMP based on latest satellite imagery and ground truthing.

(ii) If required, the rectified map shall be submitted to Ministry of Environment, Forest and Climate Change for consideration.

The Bureaucratic Challenge of Revision

    When errors are officially contested, Clause 7 of Annexure IV dictates that if a structural doubt arises regarding spatial coordinates or boundary lines, the concerned State Coastal Zone Management Authority (KCZMA) cannot unilaterally alter the map. Instead, the matter must be formally referred to the National Centre for Sustainable Coastal Management (NCSCM) for technical verification. The NCSCM is tasked with reviewing the disputed tracts using real-time satellite imagery and ground-truthing data. This multi-tiered institutional pipeline makes the formal revision of a CZMP an exceptionally tedious, labor-intensive, and time-consuming administrative effort.

Judicial Interventions and Interim Relief Frameworks

    Faced with administrative gridlock, some property owners moved the High Court of Kerala, filing writ petitions to contest the regulatory freeze on their lands. In a series of  litigations—including W.P.(C) No. 3011, No. 4836, No. 9378, and No. 10496 of 2025; vide order dated 20.05.2026, the High Court of Kerala addressed the systemic failures of the state’s coastal mapping apparatus.

Field Verification via District Authorities

   Recognizing that a full, formal map rectification via the NCSCM would take months or years, the High Court established an immediate, fact-finding mechanism through interim orders. The Court directed the District Collector—in their capacity as the Chairperson of the District Level Committee of the KCZMA—to execute urgent physical site inspections.

These inspections, conducted alongside village officers and local self-government secretaries, aimed to verify whether a disputed property was historically dry land or an active water body. In a substantial number of cases, these official field reports concluded that the properties were indeed dry land, contradicting the active CZMP data.

Policy Actions by the KCZMA

Prompted by judicial scrutiny and overwhelming field evidence, the KCZMA convened an extraordinary meeting on August 8, 2025. The Authority formally recorded minutes acknowledging the widespread complaints and authorized a structured modification protocol. The minutes of the meeting dated 8.8.2025 read thus:

"Proposal for modification of HTL in CZMP 2019 based on the applications received from individuals/local bodies

Decision: The Authority has examined the suggestions received for modification of HTL and it was decided to send the same NCSCM as the first phase for further corrections in HTL. It was also decided that any such complaints/suggestions received should be consolidated in 30 days for verification and submission to NCSCM."

 Consolidation of Grievances:- The KCZMA resolved to aggregate all verified public and institutional complaints regarding HTL/LTL anomalies within a strict 30-day window.

 NCSCM Referral: The initial phase of verified corrections was approved for transmission to the NCSCM for formal satellite data reconciliation.

 Institutional Coordination: The KCZMA issued directives to the Principal Director of Local Self-Government Institutions, instructing local bodies to identify and map localized missing features—such as unrecorded sluice bund gates—that had contributed to the original flooding misclassifications.

The Exemption for dwelling units: Balancing Protection and Local Rights

The Clause 7(vi) of CRZ Notification 2019 specialized decentralization rules apply to local communities. It states that, for  self-dwelling units up to a total built up area of 300 square meters, approval shall be accorded by the concerned local Authority, without the requirement of recommendations of concerned Coastal Zone Management Authority and such authorities shall, however, examine the proposal from the perspective of the Coastal Regulation Zone notification before according approval. Therefore, for any residential construction matching or falling below this 300 sq.mtr threshold, the statutory power to grant building approvals is vested directly within the concerned local self-government institution (such as the Municipality or Grama Panchayat), bypassing the need for a protracted clearance process from the state-level KCZMA.

The Judicial Resolution

The High Court held that local bodies cannot indefinitely withhold building permissions for small residential homes simply because a regional map correction process is pending at the national level. The Court ruled that where a property is physically verified as dry land and is otherwise compliant with building rules, the local authority must process the application independently of the pending CZMP map revision, provided the proposed dwelling does not exceed 300 Sq. Mtres. It is also made clear that if any building permit is issued, it will be subject to the final decision of the authorities concerned in connection with map correction. It is also clarified that if any of the building permit applications are rejected and if the petitioners want to submit any regularisation application, the petitioners are free to submit an appropriate application in accordance with the law.

Conclusion

The ongoing judicial management of Kerala’s coastal zone highlights a critical structural flaw - the vulnerability of digital governance systems to inaccurate baseline data. While environmental zoning relies on high-resolution satellite imagery, it must be balanced against ground realities and verified revenue histories.

The interim mechanisms shaped by the High Court of Kerala offer a balanced approach. By tasking district committees with swift field inspections and empowering local bodies to clear small-scale residential projects, the judiciary has protected local inhabitants from bureaucratic delays which are not their fault. Moving forward, the final resolution of these disputes requires close cooperation between the KCZMA, local institutions, and the NCSCM to ensure that upcoming environmental maps are both ecologically accurate and socially just.
